O R D E R:

The Member Secretary, Admission and Fee Regulatory Committee (AFRC) in the reference 6th read above have submitted the recommendations of AFRC to Government for notification of fee in various Professional Institutions for the year 2012-13. It is noticed that (7) Institutions included in Annexure I C of AFRC have again submitted their undertakings to the Government for fixing a common fee of Rs.35,000/- only and hence these institutions are deleted from that list. Likewise (105) Engineering Institutions have submitted their undertakings to the Government for a common fee of Rs.35,000/- upto 24-08-2012. Therefore Government have decided to include all (105) Institutions in the list of Institutions at Annexure I B submitted by AFRC for a common fee of Rs.35,000/- per year. Similarly in case of B-Pharmacy Institutions out of (6) Institutions included in Annexure II A of AFRC, one Institution has submitted undertaking for a common fee of Rs.35,000/- per year to the Government and hence deleted from that list. One Institution out of (67) Institutions included in Annexure II B is found to be an Engineering Institution and hence deleted. Out of (136) Institutions included in Annexure II C of AFRCs recommendations, one institution has given undertaking to AFRC for Rs.31,000/- and (5) institutions included in the said list are found to be other than Pharmacy Institutions and hence deleted. It is decided to include all the (40) Pharmacy Institutions that have submitted their undertakings to the Government up to 24-08-2012 for Rs.31,000/- and Rs.35,000/- per year in the relevant Annexure-II B & II C as the case may be. In respect of Pharm-D Institutions (3) Institutions have given their undertaking to the Government for fixing a common fee of Rs.68,000/- per year and hence it is decided to include these institutions in Annexure III A. As directed by the Honble AP High Court (APHC) on 24-08-2012 in W.P.No. 26418 of 2012, it is decided to refer the matter to AFRC to reexamine and to re-determine the fee pertaining to the Institutions included in

Annexure I C of the recommendations of the AFRC submitted to Government vide reference 6th read above so that further action can be taken after receiving the revised recommendations from AFRC. Government after careful examination of the entire matter has decided to issue the following notification which shall be published in the Andhra Pradesh extra-ordinary Gazette on 26-08-2012.

Notification:

In exercise of the powers conferred under rule 8 and 9 of the Andhra Pradesh Un-aided Minority / Non-Minority Professional Institutions (Regulation of Admissions into Under-Graduate and Pharm-D (Doctor of Pharmacy) Professional Courses through Common Entrance Test) Rules, 2011 issued in the G.Os 2nd to 4th read above, read with sub rule (v) of Rule 4 of the Andhra Pradesh Admission and Fee Regulatory Committee (For Professional courses offered in Private Un-aided Professional Institutions) Rules, 2006 issued in the G.O 5th read above and in pursuance of the resolution of the Committee(AFRC) in their meeting held on dt.18-08-2012 the Governor of Andhra Pradesh hereby notify the following fee and special fee structure for Under-Graduate Engineering courses including Pharmacy, Planning and Architecture and Pharm D courses in Private Un-aided Institutes in the State of A.P. for the academic year, 2012-13:-

For Under-Graduate Engineering courses including Pharmacy, Planning and Architecture Courses and Pharm-D course: I. The Tuition fee fixed for Institutions imparting Under-Graduate courses in Engineering, Institution wise is appended as AnnexureI A, I B. The Tuition fee fixed for Institutions imparting B-Pharmacy courses, Institution wise is appended as Annexure-II A, II B, II C & I I D. The Tuition fee fixed for Institutions imparting Pharm-D courses, Institution wise is appended as Annexure-III A & III B. The Tuition fee fixed for Institutions imparting Planning & Architecture (B-Arch) courses, Institution wise is appended as Annexure-IV A & IV B. A fee upto 5000 US Dollars per Annum per each NRI student admitted under NRI quota as per the provisions of G.O.Ms.No.47 dt: 19-07-2012 and G.O.Ms.No.48 dt: 19-07-2012 is fixed in respect of UG Course in Engineering, B.Pharmacy and Planning & Architecture (B.Arch). A fee upto 6000 US Dollars per annum per each NRI student under NRI quota as per the provisions of G.O.Ms.No.47 dt: 1907-2012 and G.O.Ms.No.48, dt: 19-07-2012 is fixed in respect of Pharm-D Course.

An extra amount of Rs.3000/- (Rupees three thousands only) per annum is allowed to be collected from each student towards tuition fee for A & B category seats, over and above the tuition fee fixed for such A & B category seats mentioned in Clause (1) above, for such of the courses which

are given Accreditation by the National Board of Accreditation in any Institution as long as such accreditation subsists for such courses in that Institution relating to Under-graduate Engineering including Pharmacy and Architecture and Pharm.D courses. The Committee has also resolved to fix the amounts under various heads towards Special Fee for Under-graduate Engineering Courses including Pharmacy, Planning and Architecture and Pharm.D Courses for the academic year 2012-13 as specified below x The Private Un-aided Engineering including Pharmacy, Planning and Architecture Institutions and Pharm.D Institutions are permitted to collect: Rs.2,000/- as one time payment per student at the time of admission towards Admission / Registration / Recognition fees and out of the said amount of Rs.2000/-, an amount of Rs.500/- shall be remitted by the Institutions to the concerned University and the remaining amount of Rs.1,500/- shall be retained by the Institution. Rs.1,500/- per annum per student during the course towards the common services rendered by the University to all the Institutions as mentioned below and such amount collected by the Institutions shall be remitted to the concerned University:Sl. Rs.500/- towards Library deposit and an amount of Rs.500/- towards Laboratory deposit (total Rs.1000/-) by way of refundable caution deposits at the time of admission only as one time payment.

The following directions are also given to the concerned Private UnderGraduate Engineering including Pharmacy, Planning and Architecture and Pharm.D Institutions:-

(i)

The institutions shall collect the Annual Tuition fee every year in advance only for that particular year either in a lumpsum or in installments, if it so opts.

(ii)

The Institutions shall not charge any capitation fee or any amount unauthorisedly or illegally under any other head or guise (e.g., donation etc.), either directly or indirectly, other than the fee fixed by the Committee, as collection of any such unauthorized amounts would amount to charging of Capitation Fee, and that the surplus (profit) that is generated from the collection of the Fee must be for the benefit of the Institution, and can not be diverted for other purposes or for personal gain.

(iii)

The Institutions are informed that fixation of the Fee Structure by the Committee will not by itself enable or permit the managements to run the relevant courses in their institutions, if they are otherwise not duly recognized and permitted by the Government or AICTE / FCI / Concerned University at any relevant time.

(iv)

The enhanced fee as recommended by AFRC for the year 2012-13 in respect of institutions whose proposals have been evaluated based on the details / figures furnished by them to AFRC is subject to further physical verification with regard to implementation of revised pay scales (Sixth Pay of AICTE (2006) for teaching staff and IX PRC of the State Government for non-teaching staff) and any other relevant details furnished by the said institutions by the task forces constituted in G.O.Ms.No.54, Higher Education (EC-2) Department, dt: 11-08-2012. If it is found that the data given by the institution is not correct, the Fee shall be revised by making necessary deductions of the fee determined to be excess for the block period 2013-2016 and this fact shall be informed to the University concerned and AICTE for taking necessary action in accordance with Law.

(v)

As directed by the Honble Supreme Court in SLP No.2405034080/2011, the impact on financial burden of each institution pursuance to implementation of revised pay scales be shared by the fresh students taking admissions in the institutions for the academic year 2012-13 and fee rise for the academic year 2012-13 shall be subject to adjustment on fee structure being revised for the academic years 2013-14, 2014-15 and 2015-16.
