ORDER ON MOTION FOR PROTECTIVE ORDER Before the Court is the Debtors Motion for Entry of Protective Order in Regard to Motion to Appoint a Chapter11 Trustee [Docket #235] and Debtors Objection Thereto [Docket #343] (Motion). Debtor seeks a protective order with respect to the discovery request served upon it by the Movants, Cheryl M. Foley, Thomas Wilner, Jane Wilner, Charles Jackson, Mary Jackson, and Kevin B. Allen (Movants). Movants served Debtor with a one question request for production of documents. Movants seek the production of any and all documents which Debtor has already produced to any party in the Class Action Lawsuit brought by Movants in Colorado state court (Class Action). Debtor asserts that production of all the documents previously produced is oppressive and burdensome. Debtor asserts that those documents contain confidential, non-public, personal information about third parties. Debtor has already reviewed the documents to protect the privacy of those third parties in connection with production of the documents in the Class Action. Given the shortened time for production, Debtor asserts it should not be required to undertake to re-review and sort the documents which have been previously provided to Movants. This Court agrees. Accordingly, it is ORDERED that Debtors Motion is GRANTED in so far as Debtor need not produce the documents in response to Movants discovery request for it to produce all the documents previously produced in the Class Action case.
