REZUMAT:
DEZVOLTAREA PRACTICII CONTRACTELOR DE ADEZIUNE
Printre contractele propuse contractanilor, contractul de adeziune este luat deseori, ca un exemplu cel
mai caracteristic contractului de consum. George Ripert, scria c n unele contracte poziia prilor este
urmtoarea: unul din contractani este obligat s execute condiiile care i sunt propuse i impuse de cealalt
parte. Aceste contracte au fost numite contracte de adeziune.
Aceast categorie de contracte, pus n discuie n doctrin abia la nceputul sec .XX, a constituit obiectul
numeroaselor studii. Trebuie s menionm c n doctrin, actualmente, existena contractului de adeziune nu
mai este contestat, astfel nct autorii J. Calais-Auloy, F. Steinmetz constat, n general, c contractele de
adeziune constituie o realitate social, cu toate c aceast categorie contractual de excepie, de fapt, a fost
impus de necesitile producerii i distribuirii n mas a produselor i serviciilor oferite consumatorilor.
Contractele de adeziune, o consecin a fenomenului vnzrii n mas, aa cum le definete Directiva nr.
93/13/CEE, sunt imaginea lipsei de negociere direct a stipulaiilor contractuale.
n doctrina francez, s-a susinut ideea conform creia contractul de adeziune reprezint materializarea
abuzului de putere economic a profesionistului, astfel instituindu-se o prezumie de abuz n ceea ce privete
contractele de adeziune, prezumie ce poate fi rsturnat prin proba existenei negocierii. n practic, s-a pus
problema de a ti n ce msur un contract de administrare, de exemplu, poate fi considerat un contract de
adeziune, ntruct unele clauze ale acestui contract pot face obiectul unei negocieri prealabile. Rspunsul este
dat de art. 3, alin. (2), pct. 2 al Directivei nr.93/13/CEE privind clauzele abuzive n contractele ncheiate cu
consumatorii, care prevede c, n pofida faptului c unele clauze au fost supuse unei negocieri prealabile, nu se
exclude posibilitatea existenei unui contract reformulat, dac aceasta rezult din evaluarea contractului n
ntregul su. Lipsa negocierii, n asemenea cazuri, se sprijin pe faptul c nu ntotdeauna consumatorul are la
ndemn mijloace reale de negociere, ceea ce face ca un astfel de contract s rmn subscris sferei
contractelor de adeziune.

DEVELOPMENT PRACTICE OF ADHESION CONTRACTS
Through the all contracts offered to the consumers, the contract of adhesion is the most used example of
the consumer contract. George Rippert has mentioned that: in some agreements the position of the parties is as
it follows: one of the parties should obligate himself to execute the stipulations which were imposed or drawn up
by one of the parties. These agreements were named the contract of adhesion.

This category of the contracts, which was mentioned in the doctrine only at the beginning of the XXth
century, has been considered the main subject of many studies in the field. Also it has to be mentioned that,
presently, the existence of the contract of adhesion is not anymore so much debated, as though the authors
J.Calais-Auloy, F.-Steinmets could state that, generally, the contract of adhesion constitute a reality of our
society, even though that this exceptional category was imposed by the necessities of the production and
distribution of the products and services offered to our consumers.
The agreements of adhesion, a consequence of the sale phenomena in large proportions, as it is defined in
the Directive no. 93/CEE, represents the picture of a lack of the direct negotiation concerning contract
provisions.
In French doctrine, it was supported the idea according to which the contract of adhesion represents the
materialization of the economic power used excessively by the professionals, as that it has been established a
presumption of the abuse in regarding of the contracts of adhesion, a presumption that could be rein versed by
the proof that confirms the presence of the negotiations. In practice, it was raised up the issue to know in what
extent a contract of administration, for example, could be considered a contract of adhesion, as some clauses of
this contract could represents the object of a negotiation that had been carried over. The answer of that issue is
provided by the art. 3, al. (2), p. 2 of the Directive no. 93/13/CEE regarding the abusive clauses in a consumer
contract, which provides that even though some clauses were submitted to a negotiation that had been carried
over, it could not be excluded the possibility of a preformed contract, if this results from the evaluation of the
content of its whole contract. The lack of the negotiations, in these cases, is based on the fact that that the
consumer does not have always at his hand all the real tools to hold a negotiation, which means that this type of
contract should be left to be subscribed to the domain of the contract of adhesion.

ABSTRACT:
WESTERN POST-SOVIET BORDERLAND: CONCEPTUAL DEFINITIONS,
TRAJECTORIES OF INTEGRATION AND POLES OF ATTRACTION
The trends of globalization significantly impact on the sovereignty of modern states, increase influence of
the foreign policy on societies. This thesis is particularly relevant to the Western Post-Soviet countries such as
Ukraine, Belarus and Moldova which were traditionally considered as a civilizational border between Europe
and Eurasia and which has not yet been unambiguously defined their geopolitical strategy. As to author position
they could be considered not as a common region, but as a space, influenced by a homogeneous international
system - the European Union, which attracts them to social standards, freedom of movement and work places, the
rule of law and democracy. Russia and its partners (heterogeneous international system) are attractive by natural
resources, shared values, religion, and a stable regime can ensure energy security in exchange for loyalty and
submission.
These states are involved in the Eastern Partnership EU Program, but domestic elites do not make crucial
steps to integrate into one or another international system. Citizens of countries, which public opinion is analysed
in this article, cannot be stable with their geo-political preferences they depend on the conditions of domestic
politics and internal conditions in Russia and the European Union circumstances. Thus author comes to
conclusion that these states will balance between the attractive social guarantees and transparency of the
democratic regimes of the European Union, and resource and cultural heritage of Eurasia. Therefore, the author
considers this region as unstable and unable to join any of the poles of a heterogeneous international system over
the next decades.

FRONTIERELE OCCIDENTALE POST-SOVIETICE: DEFINIII CONCEPTUALE,
TRAIECTORIILE DE INTEGRARE I POLURILE DE ATRACIE
Tendinele de globalizare reflect un impact semnificativ asupra suveranitii statelor moderne, duc la
creterea influena politicii externe asupra societilor. Aceast tez este relevant n special n rile occidentale
postsovietice, precum Ucraina, Belarus i Moldova care au fost n mod tradiional considerat ca o bordur
civilizatoare ntre Europa i Eurasia i n care nu a fost nc clar definit strategia lor geopolitice. Din punctual de
vedere al autorului ele ar putea fi considerate nu ca o regiune comun, ci ca un spaiu, influenat de un sistem
internaional omogen - Uniunea European, care le atrage la standardele sociale, libertatea de circulaie i de

locuri de munc, a statului de drept i a democraiei. Rusia i partenerii si (sistemul internaional eterogen) sunt
atractive prin resurse naturale, valorile comune, religie, regim stabil, care pot asigura securitatea energetic n
schimbul loialitii i transparenei.
Aceste state sunt implicate n Programul UE de Parteneriat Estic, dar elitele interne nu fac pai eseniali
pentru a se integra n un sistem internaional sau altul. Cetenii din rile n care este analizat opinia public n
acest articol, nu pot fi stabili cu preferinele lor geopolitice ei depind att de condiiile politicii interne din
statele sale, ct i de condiiile interne din Rusia i circumstanele Uniunii Europene. Astfel autorul
concluzioneaz c aceste state balanseaz ntre garaniile sociale atractive i transparena regimurilor
democratice ale Uniunii Europene i resursele i patrimoniul cultural din Eurasia. Prin urmare, autorul
consider aceast regiune ca instabil i capabil s se altureze la oricare dintre polurile unui sistem
internaional eterogen n urmtoarele decenii.

asuprii.6Dei Hugo Grotius nu a redat o
articulare
explicit
a
principiului
neamestecului n treburile interne ale altor
state, modul n care acesta a conceput aceste
probleme a avut o influen profund asupra
tradiiei de dup el cu privire la formularea
principiului.7
Consideraiile
asupra
principiul
neamestecului n treburile interne ale altor
state continu n anul 1648, prin tratatele de la
Westpahalia. Semnate la Osnabruck i
Munster, tratatele de la Westphalia puneau
capt ,,rzboiului de treizeci de ani i creau
sistemul de naiuni suverane.8n viziunea
tratatelor
de
la
Westphalia,
teoria
neamestecului era bazat pe suveranitatea de

stat,
prin
mpiedicarea
amestecului
conductorilor n treburile interne ale
vecinilor. Mai concis, suveranitatea unui stat
izvort din prevederile tratatelor Westphalice
nseamn ,,dreptul de a exercita control absolut
asupra propriului teritoriului i propriilor
ceteni iar ,,n numele suveranitii orice stat
era liber s aleag s guverneze teritoriul
propriu aa cum dorete.9ntr-o lume a
statelor suverane, unde nu exist nici o unitate
guvernamental global, nimeni nu are dreptul
de a se amesteca n activitile de stat, cu
excepia cazului n care intervenia a fost
autorizat n mod explicit de ctre stat. Cu alte
cuvinte, n virtutea suveranitii sale, fiecare
stat, indiferent de ct de mic sau de lipsit de
putere este, sau ct de mare i de puternic este,
are dreptul legal de a fi liber de intervenia
pricinuit de ctre alte state.
Tratatele de la Westphalia subliniau c
suveranitatea implic independen i autodeterminare, reprezentnd n fapt dreptul
propriei organizri avnd propriile aspecte
externe i interne. Aspectul extern reprezint
dreptul internaional de a utiliza toate
drepturile proprii, inclusiv dreptul la propria
organizare, fr interferen extern. Aspectul
intern se traducerea prin capacitatea unei
entiti politice statale de a fi puterea suprem
n cadrul teritoriului propriu, i ca atare nici un
stat din afara teritoriului nu putea interveni,
militar sau n orice altfel.10Caracterul suveran
al statelor a devenit chiar imaginea n oglind
a principiului neamestecului n treburile
interne ale altor state.

numai au stabilit baza relaiilor ntre state dar
au devenit principiile de baz ale dreptului
internaional clasic deoarece ele nu doar
stabileau poziia unui stat fa de un alt stat,
dar de asemenea stabileau poziia statelor n
comunitatea
internaional.11Principiul

separat de responsabilitatea de a face bun uz
de aceasta.52 Preedintele american considera
c n cazuri extreme aciunea poate fi
justificabil i dreapt, iar forma pe care
aciunea trebuie s o i-a depinde de
circumstanele
cazului
care
este
n
conformitate cu gradul atrocitii i puterii de a
o remedia. Cazurile interveniilor prin fora
armelor fiind considerate ns foarte puine.
Epoca modern marcheaz accepiunea
modern a interveniei dar i profunda evoluie
i dezvoltarea principiului neamestecului n
treburile interne ale altor state. Plecnd de la
interveniile umanitare, continund mai apoi
cu implicaiile datoriilor pecuniare, principiul
i-a consolidat treptat sfera legal de
intervenie, devenind la nceputul secolului
XX unul dintre principiile de baz ale relaiilor
interstatale.
Conchiznd, principiul neamestecului n
treburile interne ale altor state a nceput s se
contureze treptat n dreptul internaional
public, iniial n forme mai puin tranante,
ajungnd astzi s devin un principiu
fundamental al dreptului internaional, o
obligaie central a subiectelor de drept
internaional, care are rolul de a apra
suveranitatea, independena i libertatea
fiecrui stat.

Consideraii privind mediul internaional
de securitate n secolul XX
La nceputul secolului XX aparatul conceptual
al securitii era nc subdezvoltat i ideologizat.1
Subiect al interpretrilor i nelegerilor diverse,2

The next Russian-Turkish war which has begun in 1806 was due not only to the aggravation of RussianTurkish contradictions, but also due to the tensions between Russia and France. Napoleon showed his interest to
the Ottoman Empire still during unsuccessful for it personally and for the French army of the Egyptian expedition
of 1798-1801. Despite this failure the political activity of France within the Ottoman Empire continues to amplify,
causing some concern in Russia.
At the beginning of the century Turkey didn't represent any significant threat for Russia. But she was a
threat to her own provinces, conquered by her personally in time. Two main lines can be traced in RussianTurkish relations at the turn of the century. One of them was the cooperation between the two states, it is observed
during the Russian-Turkish alliance in 1799, in the agreement on the status of Moldavia and Wallachia in 1802,
in the treaty of 1805. The other line was a reflection of constantly amplifying contradictions, largely due to the
fact that the Port was trying to mend relations with Napoleonic France.
The Turkish-French relations of that time weren't accurate and certain. On the one hand, Port was afraid
of Napoleon, remembering both his Egyptian expedition, and coquetting with representatives of the provinces
subdued by Ottomans. On the other hand, Turkish tops, understanding escalating force of Napoleonic France and
wishing to protect itself from its blows, were trying to find a common language with representatives of French
diplomacy and, in general, with leading circles of France.
A Treatise on Peace between Russia and Turkey, signed in Bucharest on 16 (28) May 1812, consisted of 16
articles. Let's remind that some of them were devoted to issues related to the establishment of a new border down
the Prut River and position of the Danube principalities. Article IV was the most important article. It defined the
boundary of the Prut River, and contained the following provision: This is the first article of the preliminary
points, which beforehand have been already signed, it decides that the Prut River from its entrance to Moldova
before its connection with Danube, and the left coast of Danube from this connection to the Kiliysky mouth and to
the sea, will make the border of both empires for which this mouth will be the common.
During the Congress of Vienna that was held from September of 1814 to June of 1815 the Turkish side
tried to persuade the European powers to review the Bucharest peace and to return the adjoin lands to Russia
according to this peace treaty. But great powers didn't support these Port's requirements and by that recognized
the legitimacy of accession of Bessarabia to Russia.

Rzboiul ruso-turc, care a nceput n 1806, s-a datorat nu numai faptului c au crescut contradiciile
Rusia-Turcia, dar i n baza conturrii unor tensiuni pronunate dintre Rusia i Frana. Napoleon i-a promovat
interesul fa de Imperiul Otoman nc n timpul expediiei egiptene, n 1798-1801, nereuit pentru el personal si

La nceputul secolului, Turcia nu prezenta pentru Rusia o ameninare serioas. Dar ea reprezenta o
ameninare pentru propriile sale provincii, cucerite de ea n perioade respective. n relaiile ruso-turce la
confluena celor dou secole existau dou direcii principale. Una din ele consta n cooperarea dintre cele dou
state, i poate fi confirmat prin Aliana ruso-turc din 1799, Acordul privind statutul Moldovei i Valahiei din
1802, Tratatul din 1805. Alt direcie a relaiilor ruso-turce se reliefa prin reflexia controverselor tot mai
accentuate, n mare parte datorit faptului c Poarta ncerca s-i redreseze relaiile sale cu Frana
napoleonian.
Relaiile turco-franceze la acel moment nu erau clare i sufereau de lips de ambiguitate. Pe de o parte,
Poarta se temea de Napoleon, bazndu-se att pe practica expediiei egiptene ct i innd cont de jocul
francezilor cu reprezentanii provinciilor cucerite de ctre otomani. Pe de alt parte, recunoscnd fora
crescnd a Franei napoleoniene i dorind s se apere de posibilele atacuri din partea ei, turcii ncearc de a
gsi o limb comun cu reprezentanii diplomaiei franceze i, n general, cu conducerea Franei.
Tratatul de pace dintre Rusia i Turcia, semnat la Bucureti pe 16 (28) mai 1812, a constat din 16
articolele, dintre care cteva au fost dedicate problemei instalrii noii frontiere pe rul Prut i statutul
Principatelor Dunrene. Articolul cel mai important, care determina frontiera pe rul Prut a fost articolul IV,
unde a fost scris: textul din prezentul articol, bazat pe punctele preliminare de perspectiv, deja semnate,
determin c rul Prut, de la intrarea sa n Moldova i pn la revrsarea sa n Dunre, i malul stng al
Dunrii n acest sens pn la Gura Chiliei i pn la Mare, va fi frontiera a dou imperii, iar delta va fi partajat
de ambele pri.
n timpul Congresului de la Viena din 1814-1815 partea turc a ncercat s conving puterile europene de
a revizui Pacea de la Bucureti i a rentoarce teritoriile alipite la Rusia prin acest tratat. Dar marilor puteri nu o
accept aceste cerine ale Porii i astfel au recunoscut legitim aliirea Basarabiei la Rusia.

EASTERN BORDERS OF INTERWAW ROMANIA (1918 1940):
ASPECTS OF INTERNATIONAL LAW
The given article examines the historical background and facts of the territorial expansion of the
Romanian Kingdom to the East that were realized by Bucharest at the end of World War I. Moreover the article
analyzes a compliance of foreign policy activity of Romania of that time the existing norms of international law.
Modern international law provides for the possibility of rejection of the territory of the aggressor as the
sanction of the State of the winner (the most famous example of this kind is the Potsdam Agreement of 1945
across Eastern Prussia). The acquisition of the territory of the defeated enemy in the so-called old international
law was a legitimate way to increase the national territory. By the way, irrespectively, it was dealt with the
aggressor or with victim of aggression. But also in this case it was required a conclusion of the post-war peace
treaty: an increment of the occupied territory by the one-sided legal act of a State winner (the occupier) wasnt
allowed.
De lege lata, in terms of operating International Law in 1918-1940 a Romanian occupation of Bessarabia
could not be legitimized neither by Sfatul Tarii initiative nor by the decisions of the Versailles conference on
transfer of the region to Romania.
Nemo ad alterum plus iuris transfere potest quam ipse habet (lat.) - No one can transfer to another any
greater right than he himself has. Russia wasn't presented at Versailles and wasn't considered as a defeated state,
whose territory the winner state would have the right to hack. And vice versa the Romanian title to Bukovina,
including its northern part, was quite legitimate, its acquisition answered norms of ius cogens of old international
law of that time, though stayed in a contradiction with the right of the nations to self-determination (ius cogens
norm of already so-called new international law).

Acest articol se la analiza contextului istoric i circumstanelor concrete ale expansiunii teritoriale a
Regatului Romniei la Est, efectuat de Bucureti spre sfritul primului rzboi mondial, precum i activitatea
politic extern a Romniei conform prevederilor normelor dreptului internaional de la acel timp.
Dreptul internaional contemporan prevede posibilitatea excluderii unei pri a teritoriului statului
agresor ca o sanciune a statului ctigtor (cel mai faimos exemplu de acest fel este Acordul de la Potsdam din
1945 privitor la Prusia Oriental). Aa-numitul drept internaional vechi prevedea achiziia unei pri din
teritoriul unui duman nfrnt, ceia ce se considera ca modalitate destul de legitim de a crete teritoriul statului,
indiferent, dac era vorba despre agresor sau victima de agresiune. ns, i n acest caz era necesar s se ncheie

Tratatul de pace postbelic, iar incrementarea unilateral a teritoriul ocupat printr-un act juridic intern doar a
ctigtorului (ocupaia) nu era permis.
De lege lata din punct de vedere al dreptului internaional care aciona n perioada 1918-1940 ocupaia
romn a Basarabiei nu putea fi legitimizat, fie din iniiativa Sfatului rii, fie prin deciziile Conferinei de la
Versailles privitor la transferarea Basarabiei Romniei.
Nemo ad alterum plus iuris transfere potest quam ipse habet (LAT.) nimeni nu poate transmite mai
multe drepturi dect le are el nsui. Rusia nu era reprezentat la Versailles i nu era considerat ca un stat
nvins, teritoriul cruia ctigtorii ar fi avut dreptul s-l mpart. i, dimpotriv, titlul de dobndire a Bucovinei
de ctre Romnia, inclusiv i partea ei de Nord, a fost destul de legitim, deoarece ntrunete normele jus cogens
conform prevederilor dreptului internaional vechi de atunci, dei era n contradicie cu dreptul naiunilor la
autodeterminare (norma de jus cogens deja conform prevederilor noului drept internaional).

FRENCH DIPLOMATS AND THE BESSARABIAN QUESTION
DURING THE DICTATORSHIP OF KING CAROL II (1938-1940)
The Bessarabian question was a part of the territorial system, created by the treaties signed in 1919 and
1920. France considered itself as a guarantor of the territorial system. For her, the accession of Bessarabia to
Romania was the fact, in the legitimacy of which there were no doubts. Even France is the main guarantor of the
treaty of 1920, according to which Bessarabia became a part of Romania.
The Bessarabian question for French diplomacy was not some unimportant subject of local importance,
but a significant part of the French-Romanian relations. It is therefore important to examine opinions of
representation of France about Romanian policy during the royal dictatorship.
France, being up to 1939 ally of Romania, noted that public opinion in Bessarabia about its accession to
Romania wasnt unanimous.

DIPLOMAII FRANCEZI I PROBLEMA BASARABEAN
N TIMPUL DICTATURII REGELUI CAROL AL II-LEA (1938-1940)
Problema Basarabiei a fost parte integrant din sistemul teritorial creat de tratatele semnate n 1919 i
1920. Frana se considera garant al acestui sistem teritorial. Pentru Frana unirea Basarabiei cu Romnia era un
fapt, legitimitatea cruia nu se punea la ndoial. Mai mult ca att, Frana este garantul principal al Tratatului
din 1920, n conformitate cu care Basarabia a devenit parte a Romniei.
Problema Basarabean reprezenta pentru diplomaia francez nu ca o chestiune neimportant, de plan
local, ci ca o parte important a relaiilor franco-romne. Prin urmare, este important s se examineze viziunile
reprezentanilor Franei privitor la politica Romniei n timpul dictaturii regale.
Frana, fiind pn n 1939 un aliat al Romniei, sublinia c opinia public din Basarabia privitor la
problema aderrii sale la Romnia substanial nu este unanim.

ABSTRACT:
THE FORMATION OF MODERN MOLDOVAN STATEHOOD
AND RELATIONS WITH NATIONAL MINORITIES
The Republic of Moldova is a young state, and therefore the problems of formation of the statehood are in
many respects natural. Most of the young countries of Europe and of the world, during the first years and decades
of their existence, have passed through many political and economic difficulties. Over time, they were able to
develop that line of development, which enabled them to integrate effectively both into political and economic
environment.
According to the authors opinion, both an integrated accounting and systematic approach to the
peculiarities of the economic, geographic, political, and ethno-demographic situation of the country will enable
Moldova to solve her problems and provide a decent citizen's standard of living.
Geographically, Moldova located in the south of Europe, always was a link between the East and the West.
Though the political border passes only with two countries, Romania and Ukraine, actually the Republic can be a
link between many economic partners of the region. An effective use of its geographical situation will facilitate the
European integration of the country and to become a factor of development of the Moldavian statehood.
Preservation of a neutral statehood will allow to use all pluses of this geopolitical situation.

REZUMAT:
EDIFICAREA STATALITII MOLDOVENETI MODERNE
I RELAIILE CU MINORITILE NAIONALE
Republica Moldova este un stat tnr i, prin urmare, problema edificrii statalitii este n mare msur
evident i absolut necesar. Majoritatea tinerelor ri din Europa i din lume, pe parcursul primilor ani i
decenii de existen au trecut prin multe dificulti politice i economice, aprobnd, n cele din urm, acea
direcie de dezvoltare care a permis s se integreze eficient n mediul politic i economic.
n opinia autorului articolului, o eviden cuprinztoare i o abordare sistematic a caracteristicilor
situaiei economice, geografice, politice i etno-demografice a rii, va ajuta Moldova s soluioneze problemele
sale i s ofere un nivel de trai decent pentru cetenii si.
Din punct de vedere geografic, Moldova, situat n sudul Europei, a fost ntotdeauna o punte de legtur
ntre Est i Vest. Dei frontiere politice exist doar cu dou ri, Romnia i Ucraina, de facto Moldova ar putea
fi de fapt o punte de legtur ntre mai muli parteneri economici din regiune. Utilizarea eficient a prezentei
dispoziii ar putea s contribuie la integrarea european a rii i a ar deveni un factor n dezvoltarea statalitii
moldoveneti. Conservarea i pstrarea statutului de neutralitate a statului va utiliza toate avantajele situaiei
geopolitice.

RESUME:
THE DEVELOPMENT OF EASTERN EUROPE IN THE CONTEXT OF RELATIONSHIP
BETWEEN GERMANY AND RUSSIA
The enlargement of the European Union to the East (1993 - 2007) is a major strategic success. Due to the
expansion, a dangerous geopolitical vacuum created after the collapse of the Warsaw Pact and the Council for
Mutual Economic Assistance was filled. The events in former Yugoslavia have shown what could happen in the
context of that vacuum.
The process of expansion went very slowly, but the membership prospect itself stabilized the development
of the most part of Eastern Europe. Here it is possible to note a settlement of relations between Romania and
Hungary, civilized disintegration of Czechoslovakia. Now the success of expansion doesn't raise doubts. Not in
every country that adhered to the EU successes of development are so unequivocal, but all are sure that the best
decisions couldn't be.
The restoration of traditional economic relations between the West and the East is one of the most
important consequences of enlargement of the Union to the East. Here we have thousands of years of tradition,
which was not completely interrupted, even during the Cold War. (From the geoeconomic point of view it is
possible to consider the cold war as a deviation from logic of geoeconomic development.) The end of the cold war
has restored the thousand-year trade road Novgorod Santiago de Kompostella. Following this, now we are
observing a remarkable growth of trade between Germany, Austria, Italy on the one hand, and between countries
of Central and Eastern Europe, on the other hand. This tendency belongs, first of all, to new member countries of
the Union. The united Germany is in the centre of this development. The country itself represents a real
geographical and economic centre of Europe, which is slowly turning into a political centre of the unification.

N CONTEXTUL RELAIILOR DINTRE GERMANIA I RUSIA
Extinderea Uniunii Europene la Est (1993-2007) este un mare succes strategic. Mulumit extinderii a fost
evitat periculosul haos geopolitic aprut dup dizolvarea Pactului de la Varovia i Consiliul pentru Ajutor
Economic Reciproc. Evenimentele din Iugoslavia au artat ce se putea ntmpla n condiiile haosului.
Procesul de extindere a fost foarte lent, dar nsi perspectiva aderrii a stabilizat procesele de dezvoltare
n Europa de Est. Aici se poate meniona soluionarea relaiilor dintre Romnia i Ungaria, precum i dizolvarea
civilizat a Cehoslovaciei. La etapa actual succesul extinderii nu mai este discutabil. Nu n fiecare ar care a
aderat succesele dezvoltrii sunt vizibile, ns toi sunt de acord cu faptul c soluii mai bune nu existau.
Printre consecinele mai importante ale extinderii spre Est poate fi remarcat restabilirea legturilor
economice tradiionale dintre Vest i Est. Exist o tradiie milenar care nu a fost complet ntrerupt nici chiar i

ABSTRACT:
CURRENT ISSUES OF MOLDOVAN IDENTITY IN UKRAINE
(CASE OF CHERNIVTSI REGION)
The question of assertion of national identity is one of the crucial issues for the new states. Ukraine and
Moldova arent the exception in this context, because today, this problem concerns not only the identification of
common aspects of culture, traditions, values, moral foundations, but also more global issues, such as the choice
of alternatives for international cooperation, the prospects for political development, security, and economic
success.
According to the 2001 census, the ethnic composition of the population of Ukraine is characterized by
significant advantage - namely 77.8% of the titular nation of the population of Ukraine. However, the country is
inhabited by over 100 nations and nationalities. Moldovan nation is one of the largest one, it makes up - 258.6
thousand persons or 0.5% of all population throughout the country, conceding only Russians - 17.3% and
Belarusians - 0.6%.
From the point of view of territorial representation, the Odessa and Chernivtsi regions are regions with the
greatest number of compact accommodation of Moldovans.
After analyzing the characteristics of the Moldovan community in Chernivtsi region, we can conclude that
there are all preconditions for the further strengthening of Moldovan identity formation in Ukraine, but at the
same time, there are several issues that may have a negative impact on the further development of these
processes.

PROBLEME ACTUALE PRIVIND CONSOLIDAREA IDENTITII MOLDOVENETI
N UCRAINA (CAZUL REGIUNII CERNUI)
Chestiunea aprobrii identitii naionale este o problem-cheie pentru noile state. Nu este o excepie n
acest sens i Ucraina i Moldova, pentru c astzi aceast problem se refer nu numai la aspectele comune de
identificare a culturii, tradiiilor, valorilor, moralei, dar i la probleme mai globale, precum ar fi selectarea
alternativelor privitor la cooperarea internaional, perspectivele de dezvoltare politic, de asigurare a
securitii, ct i a succesului economic.
Conform datelor recensmntului din 2001, compoziia etnic a populaiei din Ucraina este caracterizat
de avantajul considerabil al naiunii titulare, i anume 77,8% din populaia Ucrainei. Cu toate acestea, pe
teritoriul rii locuiesc mai mult de 100 naiuni i naionaliti. Printre ele una dintre cele mai mari reprezentri o
au moldovenii, constituind 258.6 mii de persoane, sau 0,5% din populaia ntregii ri, cednd doar ruilor
17,3% i belaruilor 0,6%.
Din punct de vedere al reprezentrii teritoriale, regiunile cu cel mai mare numr de reedin compact a
moldovenilor sunt regiunea Odessa i Cernui.

Today it is a conceptual journal about various fields of international law, which became the centre of attraction of
creative forces and managed to find its readers, forming around a wide group of authors. One of the important advantages of
the publication is that it provides an opportunity for young authors as post-graduate students and masters students, yet not
possessing a wide experience of researching, but willing to assert themselves, express their views on topical issues about
contemporary international relations and international law.
The journal contains articles of known Moldavian and foreign experts, doctors and candidates of sciences advocates
of different views, who actively illuminate the processes occurring in the political, economic and social life. Spectrum of the
issues was as broad as possible. Particular attention is given to coverage of theoretical and practical issues of international law
and international relations.
