The United States v Pablo No.

11676 10/17/1916 Justice Torres Facts of the Case: Policeman Andres Pablo was instructed by hi chief to raid a Jueteng game in the barrio of Tuyo at about noon of Oct. 21, 1915. The Policeman Andres Pablo arrived at the scene but the 2 Cabecillas, Maximo Malicsi and Antonio Rodrigo already left, possibly alerted by a spy that a policeman was coming. He arrested the only person left there, Francisco Dato. The Chief of Police subsequently filed a case against the 3 suspects. Policeman Andres Pablo reported that he saw Malicsi and Rodrigo run away. But during the trial he testified otherwise. Policeman Andres Pablo was charged with Perjury and convicted under Act 1697 which repealed articles 318 and 324 of the Penal Code. Policeman Andres Pablo received a 15.00 bribe further aggravating the crime. Issue: Whether or not Andres Pablo can be punished? Held: Policeman Andres Pablo is charged with perjury and sentenced to 2 years 4 months and 1 day of prision correccional and to pay 1,000 pesatas. He shall pay the costs of both instances. Ratio: False testimony cannot go unpunished otherwise nothing would deter people from perverting the truth under oath.
