    ORDER OF DISMISSAL

    Counsel for respondent has advised that the parties have settled their dispute. Accordingly,
    the appeal has become moot and is dismissed. If the parties hereafter execute a formal agreement
    of settlement a copy thereof may be filed and will be received as part of the record herein. If the
    settlement reached by the parties should not be carried out for any reason either party may filed at
    any time a motion to reopen this proceeding.
