1.Observaii generale 1. General remarks


Afacerea Roia Montan a nceput la 4 septembrie 1995.

Ea a fost cuplat pe existena, nc din 1970, a unei mine mici (400.000 tone minereu anual), exploatat de ctre compania de stat Minvest, n carier deschis n masivul Cetate. *
Roia Montan affair started on september 4, 1995. It was coupled on the existance, since 1970, of a small mine (400.000 t ore annual), exploited by the state company Minvest, in open pit at Cetate mountain.

n 28 mai 1996, sunt create companiile gemene: - Gabriel Resources Ltd. (Canada), Gabriel pe scurt, cotat la bursa din Toronto i - Gabriel Resources Limited (UK), Gabriel Jersey pe scurt, care devine subsidiara lui Gabriel n 1997.

n 1997, este creat compania mixt pe aciuni RMGC, ntre - Minvest (statul romn) (acum 19,31 %) i - Gabriel Jersey (acum 80,69 %).
RMGC este de fapt un mariaj n trei, terul interesat fiind Gabriel. * On May 28, 1996 are created the twin companies: - Gabriel Resources Ltd. (Canada), Gabriel for short, listed on Toronto Stock Exchange and - Gabriel Resources Limited (UK), Gabriel Jersey for short, which becomes Gabriels subsidiary in 1997. In 1997, the join venture RMGC is created, between - Minvest (Romanian state) (now 19,31 %) and - Gabriel Jersey (now 80,69 %).

RMGC is in fact a marriage in three, the interested third being Gabriel.

n 1998 apare Legea minelor nr. 61: licena de explorare este valabil maximum 5+3=8 ani, cea de exploatare este valabil minimum 20 de ani; licenele sunt exclusive; perimetrul nu poate fi modificat, etc.
n dispreul legii minelor, Guvernul elibereaz o singur licen, licena de exploatare nr. 47/1999, - lui Minvest ca titular, s exploateze la mina veche, - lui RMGC ca afiliat, s exploreze pentru proiectul su. n 2000, statul (ANRM) transfer licena de la Minvest la RMGC: - RMGC devine titularul licenei de exploatare, s exploreze, - Minvest rmne afiliat, s exploateze mina veche. * In 1998, appears the Mining Law no. 61: the exploration licence is valid maximum 5+3=8 years, the exploitation licence is valid minimum 20 years; licences are exclusive; the perimeter can not be modified, etc. By infringement of the mining law, the Government releases a single licence, the exploitation licence no. 47/1999, - to Minvest as titleholder, to exploit the old mine, - to RMGC as affiliated company, to explore for its project. In 2000, the state (NAMR) transfers the licence from Minvest to RMGC: - RMGC becomes the titleholder of the exploitation licence, to explore, - Minvest remains as affiliated company, to exploit the old mine.

Observaii. 1). n dispreul legii minelor, RMGC face explorri la Roia Montan de 14 ani ! 2). RMGC, Gabriel i oficiali ai statului afirm peste tot c licena 47 este pentru proiect, ceea ce este fals (ea este pentru mina veche) ! RMGC nu are licena de exploatare pentru proiectul su gigantic, distructiv ! Tot n dispreul legii minelor, statul (ANRM) a modificat perimetrul licenei 47, dup cum a dorit Gabriel: * Remarks. 1). By infringement of the mining law, RMGC made explorations at Rosia Montana for 14 years ! 2). RMGC, Gabriel and state officials declare everywhere that the licence 47 is for the project, which is false (it is for the old mine)! RMGC does not hold as titleholder an exploitation licence for its gigantic, distructive project ! Also by infringement of the mining law, the state (NAMR) has modified the perimeter of licence 47, following the wishes of Gabriel:

S-a ajuns astfel la situaia absurd i ilegal - c perimetrul licenei nu mai conine, din 2004 pn n 2006 (cnd exploatarea veche a statului a fost nchis), uzina de prelucrare din Gura Roiei, folosit de Minvest n exploatare. * Thus, it was arrived at the absurd and illegal - situation that the perimeter of the licence does not contain anymore, from 2004 until 2006 (when the old state exploitation was closed), the processing plant at Gura Roiei, used by Minvest in exploitation.

Observaii. 1). Mina veche a fost nchis i dezafectat n 2006, ca s se fac presiune, prin muncitorii disponibilizai, pentru aprobarea proiectului. 2). Dei mina veche de la Roia Montan a fost nchis, licena 47 este meninut activ, n interesul lui Gabriel. 3). n exploatarea veche a statului de la Roia Montan, aurul era extras prin cianurare, nu la Roia Montan, ci la Baia de Arie. * Remarks. 1). The old mine was closed and disaffected in 2006, in order to put pressure, by dismissed workers, for project aprovement. 2). Although the old mine at Roia Montan was closed, the licence 47 is still active, in the interest of Gabriel. 3). In old state exploitation at Roia Montan, the gold was obtained by cyanide procedure, not at Roia Montan, but at Baia de Arie.

Astfel, operaiile de explorare i cercetarea arheologic, descrcrile de sarcin arheologic, studiul EIM, certificatul de urbanism etc. se bazeaz pe un perimetru teoretic ilegal.
n dispreul legii minelor, documentaia pentru obinerea acordului de mediu (studiul EIM, certificatul de urbanism etc.) se bazeaz pe o licen de exploatare care nu este pentru proiect ! * Thus, all the operations of exploration and the archeological research, the archeological discharges certificates, the EIA, the urbanism certificate etc. are based on a perimeter theoretically illegal.

By infringement of the mining law, the documentation for obtaining the environment accord (the EIA study, the urbanism certificate etc.) are based on an exploitation licence which is not for the project !

Proiectul va afecta: - 4 muni: Cetate, Crnic, Orlea i Jig-Vidoaia, - 4 sate din cele 16 cte are comuna Roia Montan, - 960 familii din cele 1362 familii (pn n prezent au fost cumprate de ctre RMGC 77% din proprietile care cad n zona proiectului), - importante ecosisteme terestre i acvatice.

Vor fi detonate circa 150.000 t de explozibil, similar ca putere degajat cu apte bombe atomice de tipul Hiroshima !
* The project will affect: - 4 mountains: Cetate, Crnic, Orlea i Jig-Vidoaia, - 4 villages from the 16 that comuna Roia Montan has, - 960 families from the 1362 families (until now, RMGC has bought 77% of the properties which fall in the project area), - important terrestrial and aquatic echosystems.

About 150.000 tones of explosive will be detonated, similarly as released power with seven atomic bombs of Hiroshima type !

2. Observaii legate de procedura pentru obinerea acordului de mediu 2. Remarks on the procedure for obtaining environment accord
- RMGC a depus prima dat documentaia pentru obinerea acordului de mediu n sept. 2002. Descrierea proiectului avea 54 pagini. n urma criticilor societii civile, n 2003 a retras-o.
- RMGC a depus o nou documentaie n dec. 2004. Descrierea proiectului are acum 204 pagini. Studiul de Evaluare a Impactului asupra Mediului (EIM), depus n 2006, are 33 volume. Au urmat mii de observaii negative la adresa proiectului, fcute de diveri specialiti, ONG-uri etc. * - RMGC put for the first time the documentation for obtaining the environment accord in sept. 2002. Project description had 54 pages. Following the critics of the civil society, in 2003 it was retired. - RMGC put a new documentation in dec. 2004. Project description has now 204 pages. The study of Environment Impact Assesement (EIA), put in 2006, has 33 volums. Thousands of negative remarks on the project followed, made by different specialists, NGOs etc.

n loc ca proiectul s fie respins, ca fiind slab, Ministerul Mediului a cerut RMGC s-i mbunteasc proiectul, innd cont de observaiile fcute de public. Acum Ministerul analizeaz mbuntirele la proiect aduse de RMGC. Unde s-a mai pomenit (la proiecte naionale sau internaionale) c dac nu ai fcut bine proiectul, s i se permit s tot vii cu mbuntiri ? Considerm procedura adoptat de Ministerul Mediului ca inaccepatibil i neconform cu uzanele, prtinitoare cu RMGC. * Insted of rejecting the project, as being a weak one, the Minister of Environment asked RMGC to improve its project, by taking account of the remarks made by the public. Now the Minister analyses the improvements brought to the project by RMGC. Where may happen (on national or international projects) that in the case of a weak project, to be allowed to improve it again and again ? We consider the procedure adopted by the Minister of Environment as inacceptable and nonconform with the usances, favouring RMGC.

(Vol. 1: Note explicative, Aducerea la zi a Raportului EIM) pag. 27: Costurile de nchidere i monitorizare postnchidere se opresc n anul 27 de la nceperea exploatrii, dar - controlul exfiltraiilor prin corpul barajului iazului de decantare va trebui asigurat pentru 50 100 de ani (EIM, vol. 28, pag. 39). - gestiunea apelor acide va trebui asigurat pe termen infinit (EIM, vol.8, pag.136-137).

3. Observaii la noile documente 3. Remarks on new documents

* pag. 27: The closure and postclosure monitoring costs stop in the year 27 from the beginning of the exploitation, but - the control of exfiltrations through the body of the tailing dam should be assured for 50 100 years (EIA, vol. 28, pag. 39). - the management of acid waters should be assured on infinit term (EIM, vol.8, pag.136-137).

Necesarul de personal dup nchiderea minelor este apreciat la 60 (Paul Bran-coordonator: Dimensiunea economic a impactului de mediustudiu de caz Roia Montan, Editura ASE, Buc. 2004, pag.135) . Activitile i necesarul de personal postnchidere au nevoie de o entitate organizatoric i de un buget anual. Cine va asigura, anual, sumele necesare gestionrii platformei pe termen ndelungat, tiind c obligaiile investitorului se opresc n anul 27 de la nceperea exploatrii ? * The necessary staff after the closure of mines is appreciated at 60 (Paul Bran-coordonator: Dimensiunea economic a impactului de mediu- studiu de caz Roia Montan, Editura ASE, Buc. 2004, pag.135) .

The postclosure activities and necessary staff need an organizatoric entity and an annual budget.
Who will assure, anually, the necessary funds for the management of the platform on long term, knewing that the investors obligations stop in the year 27 from the beginning of exploitation ?

4. Concluzii 4. Conclusions

Romnia cedeaz:

Romnia primete:

- resurse minerale: - Aur 313 t (circa 10 mil. uncii) - Argint 1.483 t - metale rare - patrimoniu arheologic vechi de 2000 de ani - dezvoltare durabil *

- substane periculoase 1.581.760 t (din care cianur de sodiu 192.000 t) - dezastru durabil

Romnia gives:

- mineral resources: - Gold 313 t (circa 10 mil. onces) - Silver 1.483 t - rare metals - 2000 years old archeological patrimony - sustainable development

Romania receives:

- dangerous chemicals 1.581.760 t (from which sodium cyanide 192.000 t ) - sustainable disaster

Dezastrul cuprinde: - schimbarea peisajului natural (aspect selenar adus zonei), - deeuri depozitate pe termen nelimitat n toat zona, - un iaz de decantare imens, cu o zestre uria de material toxic. Multe generaii umane vor sta sub ameninarea iazului de decantare i a haldelor de steril de la Roia Montan. n opinia noastr, pericolul ce-l prezint coninutul iazului de decantare pentru mediul nconjurtor depete efectul cumulat al exploziilor mai multor bombe. * The disaster comprises: - the change of natural landscape (moon-like aspect of the area), - waste to be deposited on unlimited term in all area, - a big tailing, with a huge dowry of toxic material.

Many human generations will live under the threatening of the tailing and of the waste dumps from Roia Montan.
In our opinion, the danger of tailing content for the surrounding environment overtakes the cumulated effect of the explosions of more bombs.

Autoritile statului ncalc legile rii pentru a favoriza RMGC n detrimentul interesului naional! Singura explicaie pe care o gsim este corupia ! * The state authorities infringe the Romanian laws to favour RMGC against the national interest! The single explanation we find for is the corruption !

Cerem: - toleran zero fa de nclcrile legii, - declasificarea Licenei 47, - stoparea acestui proiect ! * We ask for: - zero tolerance towards law infringements, - the declassification of the Licence 47, - stoping this project !

Aprobarea proiectului Roia Montan atrage dup sine aprobarea proiectelor n ateptare Bucium i Certej, cu aceleai probleme.

Lupta este inegal !

Avem nevoie de sprijinul UE !
