This is a deposition of Texas DPS Officer Daniel Terronez taken in the federal civil lawsuit concerning the shooting death of an unarmed man, Albert Gutierrez in 1998. Mr. Gutierrez was traveling north on US Hwy 59 at 74 mph, 4 mph over the posted speed limit. Officer Terronez verified the speed with his radar. Terronez, going south on Hwy 59, crossed the median to begin a high speed chase in order to apprehend his suspect. An accident terminated the chase. Mr. Gutierrez fled the scene on foot and was followed by Terronez. Because Mr. Gutierrez did not stop running, Texas Department of Public Safety Officer Daniel Terronez, shot at him four times in the back, killing him. According to the deposition, Terronez doesn't know if he was the one who killed. A sheriff's deputy was at the scene and may have fired, according to Terronez. Terronez reported that he "did not remember" if the autopsy confirmed whose gun fired the fatal shot.

as a witness me at the instance of the PLAINTIFF, MARIA
GUTIERREZ, BP AL, and duly sworn, was taken in the
above-styled and numbered cause on the 10th day of
DECEMBER, 1999, from 11:00 to 12:25, before MELISSA
PARKHILL, CSR No. $354 in and for the State of Texas,
reported by machine shorthand at the offices of the
Attorney General of the State of Texas, 300 W. 15th
Street, 7th Floor, Austin, Travis County, Texas pursuant
