Departamentul Tehnologii Informaionale, Bncii Naionale a Moldovei, Inspectoratului Fiscal Principal de Stat
i Serviciului de Stat pentru Supravegherea Asigurrilor al Ministerului Finanelor al Republicii Moldova.
Datele privind micul business se prezint n baza drilor de seam financiare prezentate de agenii economici cu dreptul de persoan juridic, care au desfurat activitate economic i au prezentat bilanul contabil la
01.01.2003.

Data source
National Interadministrative Register of the Republic of Moldova (RENIM), established according
Government Decision 432 from 23.06.1995, based on the data of the State Register of the State Registration Chamber nearby the Department of Informational Technologies, National Bank of Moldova, State
Fiscal Authority and the State Service for the Supervision of Insurance nearby the Ministry of Finance of
the Republic of Moldova.
Data on small business are presented based on the financial reports presented by the economic units
with the status of legal person, which were economically active and presented the accounting balance at
01.01.2003.
Precizri metodologice
Subiect al dreptului de proprietate poate fi
orice persoan fizic, juridic, statul, precum i organele de administrare public local (primriile
oraelor, preturile, primriile satelor (comunelor)).
Proprietatea Republicii Moldova se prezint
n urmtoarele forme:
proprietatea public (proprietatea de stat, proprietatea municipal);
proprietatea privat (proprietatea privat, proprietatea colectiv, proprietatea organizaiilor i
micrilor obteti, proprietatea organizaiilor religioase);
proprietatea mixt (public i privat), fr
participare strin;
proprietatea ntreprinderilor mixte.
Proprietatea public se subdivide n proprietate de stat i proprietate municipal.
Din proprietatea de stat fac parte bunurile ce
aparin Republicii Moldova ca stat, cu drept de posesie, de folosin i de administrare.
Proprietatea municipal o constituie averea
organelor puterii i administrrii formaiunii admi-

nistrativ-teritoriale, mijloacele bugetului local, fondul locativ, ncperile cu alt destinaie dect cea de
locuit din casele fondului locativ, obiectivele infrastructurii inginereti i alte obiective ce realizeaz
nemijlocit servicii comunale ctre consumatori.
Proprietatea privat se subdivide n proprietatea privat nemijlocit a persoanelor fizice i proprietatea persoanelor juridice (cu forma de proprietate
colectiv, proprietate a organizaiilor obteti, proprietate a organizaiilor religioase).
Din proprietatea colectiv (subiect al proprietii private) face parte proprietatea ntreprinderilor
de arend i colective, a societilor pe aciuni, uniunilor economice (asociaiilor, concernelor, consoriilor), care au rscumprat n ntregime aceste ntreprinderi n urma privatizrii sau pe alt cale ce nu
contravine legislaiei Republicii Moldova, precum i
proprietatea colhozurilor, cooperativelor, societilor
n nume colectiv, societilor n comandit etc.
Proprietatea mixt (public i privat), fr
participare strin este bazat pe comasarea (unirea,
contopirea) bunurilor proprietate privat, de stat i
municipal.

Este admis proprietatea cetenilor i a persoanelor juridice ale altor state, a organizaiilor internaionale i a persoanelor fr cetenie (cu excepia
proprietii asupra pmntului). Posedarea, folosirea
i administrarea acestei proprieti se exercit conform actelor legislative ale Republicii Moldova i
tratatelor interstatale.
Conform Legii Republicii Moldova nr. 619-XV
din 08.11.2001 Pentru modificarea i completarea

Legii Republicii Moldova nr.112-XIII din

20.05.1994 cu privire la susinerea i protecia micului business, ntreprinderea, a crei numr mediu
anual de salariai nu depete 9 persoane, iar suma
anual a vnzrilor nete este de pn la 3 milioane lei,
se consider microntreprindere, iar ntreprindere
mic se consider ntreprinderea, a crei numr mediu anual de salariai este cuprins ntre 10 i 50 de
persoane inclusiv, iar suma anual a vnzrilor nete
este de pn la 10 milioane lei.

Methodological notes
Subject of ownership right could be any natural, legal person, the state, the bodies of local public
administration (Mayoral city administration, district
councils, mayoral administration of villages (communes)).
The ownership of the Republic of Moldova
takes the following forms:
public ownership (state, municipal);
private ownership (private ownership, collective ownership, ownership of social organizations
and movements, ownership of religious organizations);
mixed ownership (public and private), without
foreign participation;
ownership of joint ventures.
Public ownership is broken down in state and
municipal ownership.
State ownership includes all the goods which
belong to the Republic of Moldova as state, with the
right to possess, use and administrate them.
Municipal ownership constitutes the ownership
of bodies and formations of local administration, local
budget means, dwelling stock, premises with other
purposes than living, from the houses of dwelling
stock, premises of engineering infrastructure and other
premises that supply communal services to consumers.
Private ownership is subdivided in private ownership of natural persons and ownership of legal persons (collective ownership, ownership of social, religious organizations).

Collective ownership (subject of private ownership) refers to the ownership of collective and leasing enterprises, holdings, economic unions (associations, concerns, consortiums), which bought back totally these enterprises as a result of privatization or
by other means, which do not violate the legislation
of the Republic of Moldova, and also the ownership
of kolkhozes, cooperatives, collective societies etc.
Mixed ownership (public and private) without
foreign participation is based on the unification of
goods private, state and municipal ownership.
It is admitted the ownership (except the land
ownership) of citizens and legal persons of other
states, international organizations and persons without citizenship. Possession, use and administration
of this ownership is regulated by the legislative
framework of the Republic of Moldova and
interstatal treaties.
According the Law of the Republic of Moldova
619-XV from 08.11.2001 For the amendment
and addition of the Law of the Republic of Moldova
112-XIII from 20.05.1994 concerning the support
and protection of small business, the enterprise
whose annual average number of employees does not
exceed 9 persons and the annual turnover is under 3
million lei is considered a micro-enterprise; the enterprise with the annual average number of employees consisting of 10 to 50 persons (inclusive) and the
annual turnover under 10 million lei is considered a
small enterprise.
