Narrative: While within the boundaries of Lewis County on 4/11/2014 at about 0108 hours I, Deputy M. Mohr, was dispatched to a suicide threat in the Town of Pe Ell. Dispatch had advised the Town of Pe Ell Marshal, Anthony K. Corder, had been making phone calls to his ex-girlfriend talking about suicide. I contacted Mr. Corder's ex-girlfriend, Ebonnie E. Meyer, and she told me Mr. Corder was highly intoxicated and gets like this when he is drinking. Ms. Meyer stated Mr. Corder told her he was going to shoot himself and he would burn her house down. Ms. Meyer advised me she did not have Mr. Corder's phone number because he was calling from a restricted number. Ms. Meyer told me she did not

know where Mr. Corder was but last time he called her while intoxicated he was in his city office where he subsequently passed out. Deputy J.S. Humphrey and I headed towards Pe Ell. Deputy Humphrey arrived in Pe Ell a few minutes before I and located what appeared to be Mr. Corder driving his Town of Pe Ell patrol vehicle. The vehicle was traveling down Main Street with its head lights off. I heard Deputy Humphrey attempt radio contact with Mr. Corder on the Lewis County primary frequency with no success. Vehicle In Motion See Deputy Humphrey's supplemental narrative for details. Personal Contact I observed a Town of Pe Ell patrol vehicle parked at a residence to the north of the Texaco gas station I had met Deputy Humphrey at. I could see the driver's side door was fully ajar and nobody appeared to be occupying it. I observed a male subject approach the driver's side of the patrol vehicle, closed the door, and walk back to the residence. Deputy Humphrey called Mr. Corder's cell phone and got no answer. Within less than a minute Deputy Humphrey's phone rang and it was Mr. Corder on the opposite end. Mr. Corder agreed to come out and meet us at the Texaco station. I observed Mr. Corder walk out from the residence and past his patrol car. Mr. Corder paused for a moment and turned his back to us. Mr. Corder then turned in our direction and slowly walked over to the gas station. Mr. Corder stumbled and walked very slowly appearing to think about each step. Mr. Corder arrived at our location and began to speak with Deputy Humphrey. I could smell a strong odor of intoxicants coming from Mr. Corder when he spoke. I could see Mr. Corder's eyes were watery and bloodshot. Mr. Corder was slurring his speech and repeating himself. Mr. Corder could not believe that his ex-girlfriend had called us and told us he was suicidal. Mr. Corder referred to Ms. Meyer as a "Bitch" and a "Cunt". Mr. Corder told Deputy Humphrey that it was wrong of him to be driving his patrol vehicle after drinking but didn't seem to be too concerned about it. I asked Mr. Corder if he would submit to voluntary field sobriety tests and he told me yes. Pre Arrest Screening The tests were conducted in the parking lot of the Texaco gas station. The surface was paved and level, the concrete was dry. The parking lot was lighted by the overhead fluorescent lights from the gas pump awning and provided very good lighting comparable to daytime conditions. Prior to each test I verbally instructed and demonstrated each test to Mr. Corder. At the conclusion of each instructional/demonstrational phase I asked Mr. Corder if he understood and he told me yes. Horizontal Gaze Nystagmus I held up my pen with the black/grey button end up and asked Mr. Corder if he

could tell me what color it was. Mr. Corder stated it was red or blue. I checked Mr. Corder's eyes for equal pupil size and resting nystagmus, Mr. Corder had equal pupils and no resting nystagmus. I checked both Mr. Corder's right and left eyes and he displayed lack of smooth pursuit in both eyes. There was distinct and sustained nystagmus at maximum deviation in both eyes. Mr. Corder had onset of nystagmus prior to 45 degrees in both eyes. There was no vertical nystagmus in either eye. Mr. Corder displayed poor balance and was swaying from left to right throughout this test. Walk and Turn I instructed Mr. Corder to the starting position and he stated he would fail the test. I advised Mr. Corder to attempt the test and he placed his left foot on a line in the pavement. Mr. Corder proceeded to place his right foot in front of his left foot but could not keep his balance. When Mr. Corder established both feet on the line he started to walk down the line without me instructing him to do so. I instructed Mr. Corder back to the starting position. Mr. Corder struggled with standing in the starting position and again started too soon. I re-instructed Mr. Corder back to the starting position and finished the instructions. I told Mr. Corder he could begin and he took one step off line raising his arms for balance. Mr. Corder stopped taking steps and told me he could not finish. One Leg Stand Mr. Corder began in the starting position and displayed poor balance. Mr. Corder swayed to the left and right and also front to back. Mr. Corder began the test and raised his left foot for about 2 seconds before placing back on the ground. I instructed Mr. Corder to continue and he raised his left foot again. Mr. Corder would not look at his foot when instructed to do so. Mr. Corder again lowered his foot to the ground after about 3 seconds. I instructed Mr. Corder again to continue with the test and once again he raised his left foot for about 2 seconds before placing it back on the ground. Mr. Corder used his arms to balance and swayed from right to left throughout the test. Preliminary Breath Test Mr. Corder was asked to submit to a preliminary breath test which he agreed. The PBT was administered with a result of .235 at about 0214 hours. Arrest of the Defendant At about 0219 hours I told Mr. Corder he was under arrest for driving under the influence of intoxicants. I placed Mr. Corder in wrist restraints gauging them for tightness and double locking them. I searched Mr. Corder's person incident to arrest and placed him in the back of my patrol car. At 0241 hours I read Mr. Corder his Miranda Rights. Mr. Corder's mood changed from cooperative to argumentative and he kept repeating questions I had already answered for him. Mr. Corder stated he was going to get fired from his job as the Town of Pe Ell Marshal. Mr. Corder's patrol car was released to the Town of Pe Ell Mayor Spencer Nichols. Mr. Corder's duty weapon was retrieved from the patrol vehicle and

booked into evidence by Deputy Spahn for safekeeping. I cleared the gas station en-route to the Lewis County Jail for the Breath Alcohol Concentration test at about 0306 hours. I arrived at the jail at about 0329 hours. Administrative Process I asked Mr. Corder if he would like to contact his attorney and he told me yes. I showed Mr. Corder the list of attorneys and he stated he wanted to use the Town of Pe Ell's attorney. Mr. Corder told me he did not know his attorneys name or phone number and he would have to look in his cell phone to retrieve it. I allowed Mr. Corder to look in his cell phone but he could not find the number. Mr. Corder wanted to call his family and the mayor but I directed him back to the attorneys on the wall. Mr. Corder became upset and stated he did not want to use any of the attorneys on the wall. I checked Mr. Corder's mouth for foreign objects and started the observation period for the BAC test at 0347 hours. Mr. Corder decided to choose the first attorney on the list and contacted David Arcuri. I called Mr. Arcuri and informed him who I was and that I had Mr. Corder in custody for DUI. I stepped out of the BAC room allowing Mr. Corder his privacy but continued to watch him through the window. After concluding his telephone call I re-entered the BAC room and checked Mr. Corder's mouth and started the second observation period at 0355 hours. At 0403 hours I read Mr. Corder the Constitutional Rights from the DUI Arrest Report which he stated he understood but refused to sign on the DUI Arrest Report. At 0408 hours, I again informed Mr. Corder he was under arrest for DUI and read him the Implied Consent Warning for Breath. Mr. Corder stated he understood and signed the consent form. Mr. Corder then agreed without question to give two breath samples and initialed the consent form. Mr. Corder told me he would not answer any interview questions in the DUI Arrest Report but he would submit breath samples. Additional Information I explained and demonstrated to Mr. Corder the manner in which he needed to blow in order to provide 2 valid breath samples. Mr. Corder told me he understood how to give 2 breath samples. Mr. Corder did not have anything to eat, drink, or smoke during the observation period. The BAC thermometer was within the required range of 34 degrees Celsius +/- .2 degrees Celsius. The RFI antenna was present and the breath tube was warm/hot to the touch. The external standard was within the required range of .072 to .088. After the observation period was satisfied, Mr. Corder provided 2 breath samples that were accepted by the BAC DataMaster with results of 0.184 and 0.186. (See attached Breath Test Analysis Sheet) Mr. Corder was then issued criminal citation # 4Z0430782 and booked into the Lewis County Jail.

over and speak with us over at the Texaco, however, told us he was intoxicated and didn't know how that would look. Once Mr. CORDER came over to the Texaco, I watched him walk across the parking lot from the residence where he was and he was staggering and appeared to have trouble balancing. Once Mr. CORDER came over, I asked him what was going on with his ex down in Central Park and he stated she was a crazy ex and she had given the repo company an extra key to his car and his car got repo'd, which made him upset. He said several times he wasn't planning on killing himself and he would never do that and if he wanted to kill himself he would have done it over in Afghanistan. I then asked Mr. CORDER about driving the vehicle and he stated, "Yes I did do that. I made a mistake there." At that time, I had a conference with Deputy MOHR. We then decided for Deputy MOHR to take over the investigation from that point and ask Mr. CORDER if he would be willing to do some voluntary field sobriety tests. See Deputy MOHR's narrative for further information about the field sobriety tests and subsequent arrest. It should also be noted the exempt license plate on the patrol car is 53711D, which returned to a '99 Crown Vic, blue in color, registered to the town of Pe Ell. Probable Cause While within the boundaries of Lewis County on 4/11/2014 at about 0108 hours I, Deputy M. Mohr, along with Deputy J.S. Humphrey, was dispatched to a suicidal subject in the town of Pe Ell. I was advised by dispatch the subject was the town marshal, Anthony K. Corder, and he had been drinking. While en-route to Pe Ell, Deputy Humphrey advised me he had passed the town of Pe Ell police car driving down Main Street with its headlights off. Deputy Humphrey followed the police car to a residence north of the Texaco gas station at 504 Main Street North in Pe Ell. I met Deputy Humphrey at the Texaco station and observed the police vehicle parked at the residence with its drivers door open. I saw a male subject walk up to the police vehicle, close the drivers side door, and walk away back into the house. Deputy Humphrey called Mr. Corders cell phone and got no answer. Deputy Humphreys cell phone rang less than a minute later and it was Mr. Corder on the line. Mr. Corder agreed to come out and speak with us. Mr. Corder came out of the residence and slowly walked over to the gas station. Upon Mr. Corders arrival Deputy Humphrey began to speak with him about the phone calls he had made to his ex -girlfriend. I could smell a strong odor of intoxicating liquor coming from Mr. Corder when he spoke. Mr. Corder was also having trouble speaking clearly and was slurring his speech. Mr. Corder told Deputy Humphrey it was his own mistake for driving his patrol car after drinking alcohol. I asked Mr. Corder if he would submit to voluntary field sobriety tests and he told me yes. Mr. Corder performed poorly in all 3 tests which included Horizontal Gaze Nystagmus, Walk and Turn, and One leg Stand. I asked Mr. Corder if he would submit a voluntary preliminary breath test sample and he told me yes. Mr. Corder gave me a Preliminary Breath Test sample of .235. At about 0219 hours I told Mr. Corder he was under arrest for driving under the influence of intoxicants. I handcuffed Mr. Corder and checked the tightness of the wrist restraints and double locked them. I searched Mr. Corders person incident to arrest and placed him in the backseat of my patrol car. I read Mr. Corder his Miranda Rights at about 0241 hours. I transported Mr. Corder to the Lewis County Jail where he provided two breath samples on the BAC machine. Mr. Corders breath samples were .184 and .186. I issued Mr. Corder a Sector ticket and he was booked into jail.
