The Enforcement of Human Rights of the Economically Disadvantage People in India and West Africa, (December 7-12, 1987), University of Jos (Plateau State) NIGERIA- a Paper Presented to PAN-African Consultation on the Protection of Human Rights. This paper starts with a brief history from Magna Carta, Deals critically with social policy and legal Aid, and its philosophy and available forums and implementation in India and some West African countries including Nigeria and East African countries of Tanzania, Kenya, and Uganda. It makes contribution by suggesting a modelscheme and structure for giving legal Aid to Poors. It carries the thesis that Leal Aid and legal Advice is a Constitutional right and is covered by out very clear and practical ways of enforcement of human Rights in Africa.This paper has, in addition to being published in proceedings, been also published in Jos University Law Journal (1988). 73. The Rehabilitation, Human Rights and Transcendental Jurisprudence, A paper presented in Multi- Disciplinary Workshop held at CALABAR University of Cross river State. Nigeria from 10-13, 1987. The theme of this paper is to analyze the practical way outs for tacking the evil of recidivism. Two kinds of solutions are submitted, legal,Extending the scope of the fundamental Right to life AND Spiritual, making use of the techniques of meditation. The paper advocates that human legal order is in crisis today and there is a clear and present need for developing a new concept to life, hence new concept of Law. The philosophy of such a law has been termed Transcendental Jurisprudence. This is New Approach to the Jurisprudence that has been advocated. The paper is based on the experience obtained during the research that resulted into a book on Transcendental Jurisprudence. 74. Liberty Not to Live: A paper presented in World Congress on Law and Medicine (1986), New Delhi, India. The abstract of the paper was published in the proceeding s and the fullpaper examines Jurisprudential aspects of Euthanasia, Suicide and individuals right to die. All the three above have been explained to mean three different concepts. Euthanasia has been recommended subject to Medico-legal controls; suicide has not been advocate to be permitted but right to die has been claimed to be included in the right to live. Right to donate the vital parts of the human body likekidney, eyes and even heart and the interactions of Law and Medicine have been discussed in light ofthe Indian history and Ancient Indian Jurisprudence. 75. Policy, Principles and Practice of Scheduled Tribe Welfare Legislations in State of M.P. A paper presented in University Grants Commission sponsored. All India Seminar organized by Cochin University (Kerala) India in 1983. In schedule tribes are included the Economically, socially and Educationally backward people. The paper examines the policies of various such legislations and their provisions, implementations and their judicial interpretations, in the State of M.P. which is the largest state in India. The paper includes inter alia, problems of Education, and Literacy, indebtedness and money lending, protection of their interests in land and proper working and effective co-ordination of the Welfare Agencies.The conclusion of the paper is Little done vast undone. The paper examines the commitment of the Indian Constitution for the upliftement of the down trodden masses and to use the Law for the Welfare of the poorest of the poors. Legal Aid and Legal Advice Scheme and the Law have been critically examined. The methodology adopted is empirical field study combined with the analysis of the works available. 77. Eco-System, Pollution and the Man-Some insights into the thrust areas of research in Environmental Law and Jurisprudence.This paper was presented in All India U.G.C. sponsored Seminar on the Environmental Law organized by the University of Cochin (Kerala) India, in 1983. The paper examines the pollution, evaluation and resource management elements of pollution, an evaluation of the pollution problem in India. It ends with a strong plea of re-reading of Easements Act, and inclusion of environmental law as a subject in LL.B. and higher classes and need for a more integrated inter-disciplinary approach in the area. 78. Centre-State relation: Evaluation of the Financial relations aspect. A paper presented at the Ali India Seminar on Centre-State relations organized by Gauhati University (Assam), INDIA (1983). Centre-State relations became very controversial specially after 1980 General Elections in India, when various regional parties were returned in power in states. This paper examines the most significant aspect of Financial relations, i.e. sharing of the revenue. The collection of revenue, the Grants-in Aid to the States, the working of the Finance Commission, Planning Commission and the role of the States in the National planning. The paper concludes that the problem owes its origin to crisis of confidence and psychology of the State Leaderships. It ends with a plea to give Financial Security to grass root agencies. 79. Circular of the Law Minister and the Independence of the Judiciary.This paper was presented in the Seminar organized by Gorakhpur University (U.P) India in 1981. In 1979, Law Minister of the Centre wrote a letter to all Chief Justices of State High Courts concerning transfer of the High court Judges from one High court to another. The present paper examines the constitutionality of the letter in light of specific provisions guaranteeing judicial independence and concludes that it was unfair and illegal. It was volatile of the independence of the independence of the Judiciary. 80. The Credit Financing and Rural Development. This paper was presented in All India Seminar organized by Gorakhpur University (U.P.) India in 1979. The paper examines the problem of rural indebtedness in general and of the unorganized labour in particular The Working of local money lending agencies and of Regional Rural Bankshas been evaluated. The study involves field survey, questionnaire and evaluation of available data and records. 81. Delays in Administration of civil Justice. This paper was presented in All India Seminar organized by Allahabad University (U.P.) India in 1970. The paper examines the operation in actual life of the Maxims like Justice Delayed is Justice Denied and Justice hurried is Justice buried. The paper ends with some recommendations for wiping out delays arising out of procedural defects and operational defects. 82. Non-resident shareholders and Investments. This paper examines the problem and legality of the investments and takesover bids by Non-resident shareholders in Indian Companies and Corporations.
