SAN FERNANDO CITY CORPORATION

PUBLIC ADVISORY

By Town & Country Planning Division Notice dated 1
st
May, 2014, the Offender in the matter of the
Excavation at Corner of Pointe-a-Pierre Road and Circular Road, San Fernando, bordering the San
Fernando Hill and related to stock piling, was advised that they were in violation of Condition #4 of the
grant of planning permission which stated inter alia:-

Condition: That during site preparation any material to be removed from the site be
stockpiled on the parcel of land located at Williamsville, which is described in deed No.
20226 of 1998, and such stockpiling be constantly maintained so that no nuisance is
created to the adjoining properties or any user of any nearby roads.

Reason: To ensure the protection of the environment

Additionally, the Offender was advised that they are to discuss this matter with Town & Country
Planning Division within one (1) week from the date of receipt of the Notice. The Offender was further
advised that failure to do so will render them liable to Enforcement Proceedings being initiated against
them, under provision of the Town & Country Planning Act, Chapter 35:01.

Furthermore, please be advised that on 15
th
July, 2014 the San Fernando City Corporation wrote to
Town & Country Planning Division on this matter. However, to date, no response has been received
from said Town & Country Planning Division. Moreover, the excavated material remains stockpiled at
an unauthorized location along Southern Main Road, Marabella.

While the San Fernando City Corporation has been in receipt of numerous complaints from members of
the public regarding the illegal stockpiling to date, we are in no position under law to compel the
Offender to remove same.

In these premises, the San Fernando City Corporation is hereby calling upon the Ministry of Planning
and Sustainable Development to have this matter addressed with the utmost urgency.
