1. My legal responsibilities as a mandated reporter is to immediately report to child
protective services or a local police department when I suspect a chlid has been abused or neglected or is likely to be abused or neglected. It is their responsibility to continue on with an investigation.
2. The six types of abuse and their definitions are: Physical Abuse- when there is physical injury infliced on a child by anything other than accidential means. Physical Neglect - the failure, refusal, or inability on the part of a caregiver, for reasons other than poverty to provide necessary care so as to seriously endanger the physical health of a child. Sexual Abuse- When any person commits any of the following acts, unless specified a child is anyone under the age of 18: Sexual intercourse or sexual contact -With a child 15 years or under(consent is not a consideration) -With a child 16 or 17 years of age when he or she does not consent -With a child by the child's foster paren (consent is not a consideration) -with a child placed in substitute care, by a person who works at, or volunteers at, or has responsibility to manage the facility where the child is placed. (consent is not a consideration) -With a child who receives direct care or treatment services from certain organizations or facilities, by an employee, licensee, or non client resident of the organization or facility. (Consent is not a consideration) Sexual exploitation of a child Permitting or encouraging a child to engage in sexual prostitiution Intentionally causing a child to view or listen to sexually explicit conduct for the purpose of sexually gratifying oneself or sexually humiliating the child Emotional abuse - emotional damage for which the child's parent, guardian, or legal custodian has neglected, refused, or has been unable for reasons other than poverty to obtain the necessary treatment or to take steps to ameliorate the symptoms. Methamphetamine manufacture is considered child abuse when a child is present, it is manufactured in a child's home, on the premises of a child's home, or in a motor vehicle on the premises of a child's home Threatened abuse or neglect - There is no definition, so you need to use common sense when it comes to threatened abuse or neglect.
3. If a child is acting out, also you can ask the child some questions. It is important not to pressure the child if he or she does not want to talk about things.
4. To make a report, I can either call, or go to the local child protective services or the local police department. I will need to let them know exactly what I saw that has me considered. If it is not an emergency, it is best to call child protective services. If it is an emergency and someone is in immediate danger, call the local police department or in some cases 911. 5. After I make a report, the CPS agency will determine how to proceed with the report. They need to decide if it is child abuse/neglect, and how they are going to move forward. In some cases, I can find out what the report was, and what if anything was done to rectify the situation.
6. If I call CPS, my name stays anonymous, unless I the case goes to court, and I am asked to bring information forward. I cannot be discharged from my place of employment for making a report that is in good fatih. I have immunity from criminal and civil liability if I made the report in good faith. If I suspect child maltreatment, I can be fined or imprisoned for not making a report.
