Clemson University 3 4 Purpose: To prevent the gathering of private citizens state information by private 5 corporations with the intent of selling said information to customers. 6 7 Whereas; It is the governments duty to protect citizens privacy interests by penalizing the 8 publication of information on citizens; and, 9 10 Whereas; Citizens have the right to determine what information is gathered about them and 11 how that information is then used; and, 12 13 Whereas; The Restatement of Second Torts recognizes four types of invasions of privacy, 14 one of which is unreasonable publicity or unauthorized commercial use of a 15 citizens information. 16 17 Therefore, Be it enacted by the South Carolina Student Legislatures in regular session 18 assembled by the following: 19 20 Section I: The gathering of private citizens personal demographic, behavioral, lifestyle, or 21 transactional information by private corporations shall be strictly prohibited. 22 23 Section II: Any information previously gathered on citizens shall not be allowed to be sold to 24 any customer of the private corporations. 25 26 Section III: The sale or purchase of any private citizens personal information by any private 27 corporation or individual within the state is prohibited. 28 29 Section IV: A violation of this prohibition shall result in a fine of up to $1,000,000 based on 30 level of information sold or gathered. 31 32 Section V: This act shall take effect upon passage by the General Assembly and signature of 33 the Governor. 34
