eCerauseone ul 12 13 14 Is 16 17 18 19 20 21 2 23 24 25 26 27 28 29 30 31 32) 33 34 35 36 37 38 39 40 aL 42 43 44 45 46 47 48 49 50 51 52 53 34 55 56 Republic of the Philippines Province of Ilocos Norte Laoag City 2900 OFFICE OF THE SANGGUNIANG PANLALAWIGAN ~ Draft Provincial Ordinance No. J00%~ | - [20 Sponsored by BM Kristian R, Ablan AN ORDINANCE REGULATING THE USE OF ROAD BARRICADES IN FRONT OF ALL SCHOOLS IN THE PROVINCE OF ILOCOS NORTE WHEREAS, most schools, if not all, place barricades in front of the school gates in order to slow down traffic to protect pedestrian-students; WHEREAS, though the practice is sensible and reasonable in preventing car accidents affecting school children, some motorists complain about the manner these traffic control devices are placed on the road such that the barricades themselves create an imminent risk of injury or death to motorists; WHEREAS, there is a need to regulate the use of road/street barricades in front of schools in order to protect both school children and motorists; NOW, THEREFORE, Be it Ordained that: SECTION 1. DEFINITION OF TERMS. “Barricade Plan” means a plan showing the details of the traffic control devices that will be used to restrict a right-of-way; “Road Barricade” is any kind of traffic control device that is used to warn, channel, divert or guide traffic; “School” means a place of learning for children, public or private, including but not limited to day care centers, pre-schools, elementary schools, high schools, colleges and universities. SECTION 2. SCOPE. This Ordinance shall apply to all road barricades placed in front of schools in the Province of Ilocos Norte to control the flow of traffic. SECTION 3. REQUIREMENTS FOR ROAD BARRICADES. All road barricades placed in front of schools must comply with the following requirements. ‘A. COLOR: A traffic barricade shall be painted with bright and reflective colors, preferably yellow and black, to ensure maximum visibility. B. LENGTH: A traffic barricade shall have a maximum length of ten feet (10 fl). C. HEIGHT: A traffic barricade shall have a maximum height of fifty inches (50"). D. DISTANCE: The minimum distance between two (2) barricades on a road is sixty feet (60 ft.). E. HOURS OF OPERATION: A traffic barricade placed in front of a school shall be removed no later than six o’clock in the evening (6:00 pm). SECTION 4. APPROVED BARRICADE PLAN. Barricades shall be placed in front of schools according to a barricade plan approved by the Barangay Council of the barangay where the school is located. ‘Suggested barricade plans are attached as Figures 4.1, 4.2 and 4.3. SECTION 5. PENALTIES. Any person found guilty of any of the following violations shall be punished with a fine of Two Thousand Five Hundred Pesos (P2,500.00) per day, each day a violation continues represents a separate violation: a) Not following the minimum requirements set forth by Section 3. b) Placing a road barricade in such a way that it creates an imminent risk of injury or death to the public; ©) Placing a road barricade on the road without an approved barricade plan from the concerned Barangay Council; d) Not following the conditions of the approved barricade plan, including the hours of operation; ) Leaving road barricades for more than 3 hours after the end of regular hours of classes; In addition to the fine, the road barricade/s subject of the violation shall be confiscated in favor of the local government unit concerned. SECTION 6. SEPARABILITY CLAUSE. If any provision or part hereof, is held invalid or unconstitutional, the remainder of the Ordinance or the provision not otherwise affected shall remain valid and subsisting. SECTION 7. REPEALING CLAUSE. - Any Ordinance, executive order, tule or regulation contrary to or inconsistent with the provision of this Ordinance is hereby repealed, modified or amended accordingly. SECTION 8. EFFECTIVITY CLAUSE. - This Ordinance shall take effect fifteen days after its publication
