The Franco family had referred the application to the
State Administrative Tribunal
in 2014 but no discussions or
hearings had been held, a
spokesman at the SAT said.
Justice Parry granted the
injunction, freezing action by
Nedlands council.
Council staff said they received notification 10 minutes
before the meeting was due
to start and immediately
began telephoning councillors to tell them it had been
cancelled.
The SAT will consider
the injunction later in the
month.

My point was that single parents may not want the workload

Subiaco council is hoping a twomonth push will help put its CBD
back on track to its former glory
as one of Perths best shopping
and recreational districts.
Subiaco is looking for a consultant to carry out an assessment of
the retail and hospitality sectors in
the area and report back quickly
with a plan of action.
Tender documents for the contract say there has been a downturn
in the amount of money and people
coming into the town centre, which
also has many empty shops.
While the council says it is normal to have low points in the
life cycle of any destination, the
problem has been made worse
because of competition from surrounding suburbs and shopping
centres.
It also cites an increase in online
shopping, high rents and the loss of
the Subiaco Pavilion Markets.

her and Mercury in connection

until the Victorian Supreme
Court had decided whether an
ANZ Bank mortgage over her
82,503,106.5 shares in Burrup
Holding Limited was signed
under duress and was void
because the bank had acted
unconscionably.
Justice Gilmour said Mrs
Oswal contended that her shares
were worth $700million but were
sold at a lower value.
The hearing of the duress proceeding is expected to last three
to six months from August 3.
Justice Gilmour said Mrs
Oswal wanted a temporary
stay because she claimed the
outcome of the duress proceeding may affect the mortgage
proceeding because of overlapping issues.
He said Mrs Oswal contended
that neither the commissioner
nor the ANZ Bank were creditors at the time the mortgage
was granted.
There is no spectre of conflicting judgments, Justice
Gilmour said in his judgment.
Given the conclusions I have
reached as to the irrelevance
of the duress proceeding to
the mortgage proceeding, it is
unnecessary to consider the
other factors relied upon by
Mrs Oswal in support of her
application.
The application will for
these reasons be dismissed
with costs.

Park was officially opened.
Guests included members
of Russells immediate and
extended family and the volunteers who created the play
space.
Mosman Park CEO Kevin
Poynton welcomed more than
100 guests to the park, which he
said was already a big hit with
local families and visitors.
Mayor Ron Norris said the
park would have cost around
$250,000 without the contribution of materials and labour
that brought the price down
to a third of that.

The Claremont on the Park project covers 9.4 hectares around the Claremont Football Oval. When complete the

a nightclub brawl involving

3.45am on Sunday after violence outside the venue.

Dave Stevenson said.
We are looking at CCTV
footage and waiting on information from the club.
One West Perth player was
taken to hospital with a dislocated ankle and a Subiaco
player had a minor head
injury.
At the time those involved
in the brawl said they did not
want to press charges.

ANZAC Day
2015 marks 100 years since the landing of the ANZAC troops
at Gallipoli. The Mosman Park Rotary Club in conjunction with
the Mosman Park Sub-Branch of the Returned and Services
League (RSL) will host a Gunre Breakfast at the Alf Adams
Pavilion, Solomon Street, Mosman Park on Saturday 25 April,
commencing at 7.30am.
The breakfast will be followed by the ANZAC Day Commemoration
Service in Memorial Park, on the corner Bay View Terrace and
Memorial Drive, Mosman Park at 10am. Seating will be provided
and an AUSLAN interpreter will be translating the service. This
years service will include a special performance of an excerpt of
Mineelds and Miniskirts a play that is being performed by the
Harbour Theatre about women in war. For further information on

Gallipoli Dead from

William Herbert Newbury, or
Bertie, as he was known, was
born in South Australia, the
youngest child and only son
of teachers William Newbury
and Fanny Herbert.
William and Fanny, whose
pioneering family had settled
Yankalilla, ran Delameres
Dairy Flat school.
They had four daughters
Minnie, Fanny, Anna (who died
in infancy), and Gladys.
Then, five years later, on
February 21, 1889, when Fanny
was 43 and William was 63,
Bertie was born. He was the
apple of his parents eyes and,
like his sisters, was diligently
educated both at school and
at home.
In 1899, Minnie (22) came to
WA for the birth of her cousins
first baby. While here, she married Charles Ellershaw (42) at St
Lukes Church in Cottesloe.
By then the Newburys were
at Templers, north of Adelaide.
William finally retired in mid1904, aged 78, and he, Fanny,
Gladys (20) and Bertie (15) then
followed Minnie to WA, leaving
Fanny (26) in South Australia
where she married a few months
later.
They arrived before the birth
of Minnies third child, Phyllis,

For the first time, the Garden
Chapel at Karrakatta Cemetery
will be used for a series of

Academy of Performing Arts
(WAAPA) graduates.

Australia has an ideal
climate for drinking the
stuff, but many Aussies
think that pink wine is
only for new-age types,
not for them.
Theres more to it than
that, however. Theres
no doubt that over the
years in Australia, ros
has been a dumping
ground for leftover
white and red wine. If
there was a bin or two
of excess white and
red grapes, they were
thrown together and
fermented to make a
pink wine.
And with Australians
love of big full-flavoured
red wine, many
winemakers ran grape
juice (bleeding) off a red
grape crush to increase
the skin-to-juice ratio
and intensify the colour,
tannins and flavour in
the red wine. The run-off
juice was then fermented
to make ros.
There havent been a
lot of purpose-made
ros wines here, where
winemakers have used
top quality red grapes
and concentrated on
making the best pink
wine possible.

Of the 14 properties scheduled for auction, seven went
under the hammer, five were
passed in and two were sold
after their auctions.
The biggest crowd was at 3
Vaucluse Street, Claremont,
which was knocked down to a
final bid of $1.44million.
About 150 people packed
the auction of the land-value
home near the river, according to agent Simon McGrath,
of Abel McGrath.
Six bidders put up their
hands for the circa 1910 home
on 653sq.m.
Two bidders battled it
out at the end, Mr McGrath
said.
There was a lot of interest in this property because
it was one of the last to be
renovated in the heritage
precinct.
The result shows there are
buyers out there and there is
plenty of life in the market,
despite the doomsayers.

and never had any problems, Mr Hall said. Its

is Adam Lenegan.
13 Swanway Crescent was passed in after a vendor bid of $2.6million. Mr Hunter, of Abel McGrath,

the issues with Labor leader Mark

continue to do so.
Our strong support for local
say is the reason Mr Barnett and
the Liberals caved in on their
amalgamation agenda.
Mr Barnett hasnt presented
his [capital city] legislation to
Parliament yet, but when he does
he wont get automatic support
because we intend to have a careful look at it.
But its ludicrous that UWA is
governed by three different councils. That should not continue.
A UWA spokesman said: The
universitys main Crawley campus is spread over three local
council areas [Perth, Subiaco
and Nedlands] which leads to unnecessary bureaucratic red tape,
inconsistencies with planning and
development, and a lack of a single
local government approach to the
future of the university precinct.
Adopting a more rational system
of local government across the whole
campus would benefit UWAs ongoing development as a world-class
centre of excellence in advanced
learning and research.
