Facts:
PlaintiffsAppellantsF.H.,representedbyhisnextfriendandmotherSandraFayHall,
andSandraFayHallindividually,filedsuitagainstDefendantAppelleeMemphisCitySchools
(MCS)allegingAppelleeallowedfortheabuseandneglectofF.H.whileenrolledinits
schools,andallegeAppelleebreachedaSettlementAgreement.F.H.hascerebralpalsy
syndrome,isboundtoawheelchairandhaslimiteduseofhishands.Heneedsassistance

andverbalabuse.TheIDEAguaranteeschildren,likeF.H.aFreeAppropriatePublic
Education(FAPE)inconformitywiththeirIEP.AnagreementwasreachedataResolution
Sessionandwasenforceableinstateorfederalcourt.Appellantsalsomadeclaimsof
retaliationundertheAmericanswithDisabilitiesAct(ADA)andSection504,aswellasbreach
oftheSettlementAgreement.
Issue:
WastheIndividualswithDisabilitiesEducationActviolatedbyMemphisCitySchools
whentheindividualwasabusedphysically,sexuallyandverbally?
Ruling:
Theallegationsofphysical,sexualandverbalabusehavenoavailableremedyunder
theIDEA.Theallegationsarenoneducationalinjuries.Thesesclaimswerenotreleasedby
thesettlementagreementandadministrationexhaustionwasunnecessary.Thesettlement
agreementwasenforceableinthecourts.
Rationale:
Asthelocaleducationagency,theIDEArequiresthatMCScreatean
IndividualizedEducationPlan(IEP)forF.H.andotherdisabledstudents.Thesettlement
agreementwasreachedataresolutionsessionandwasenforceableinstateorfederal
court.IntheAmendedComplaint,AppellantsallegedthatDefendantsviolated42U.S.C.
1983undertheFourteenthAmendmentoftheUnitedStatesConstitution,theRehabilitation
Act(Section504),andtheAmericanswithDisabilitiesAct(ADA).Acomplaintmustinclude
factualcontentthatallowsthecourttodrawthereasonableinferencethatthedefendantis
liableforthemisconductalleged.IntheAmendedComplaint,AppellantsclaimthatAppellee
MCSengagedinapolicyorcustomoffailingadequatelytotrainorsuperviseF.H.saidesand
otheremployeesandthatMCSknewoforshouldhaveknownoftheabusivebehavior
towardsF.H.,includingnumerousactsofverbalandphysicalabuse.Appellantsfactual
allegationsclearlypointtophysical,nondisciplinary,andnoneducationalinjuries,which
cannotberedressedbyanyremedyavailableundertheIDEA.
Conclusion:
Thisisacaseofsevereabuse.Allstudentsdeserverespectnomattertheir
disability.Nostudentshouldbephysically,sexuallyorverballyabused.Thefactthatthis
abusewentonforsomanyyearsunderdifferentaidesreflectspoorlyonthedistrict.How
couldtheynotknowwhatwasgoingon?Didtheyandtheychosetoignoretheabuse.Asa
schooladministratoryouhavetoknowyourstaff,knowyourstudentsandknowwhatisgoing
oninyourschoolbuilding.Behaviorlikethisisunacceptable.AsaschooladministratorIwill
