COPPA: What Is It?

An act put in place April 21, 2000 by the


Federal Trade Commission that gives
parents control over what information is
collected about their children online

COPPA: Why Is It In Place?

Children 13 and under must be


protected, and this includes making
sure their personal information is
secure. COPPA ensures that parents
are in control of what personal
information is shared online about
their children.

COPPA Applies To:

Operators of commercial websites and


online services directed toward children
13 and under that collect, use, or give
out personal information.

COPPA: What Information Is Protected?


COPPA was refreshed in order to keep
up with changes in technology, including
mobile devices, effective July 1, 2013.

COPPA: In Order For An Organization To Become or


Stay Compliant, It Must:

Post a comprehensive privacy policy up front


on the website, describing the information
practices with regard to the personal
information of children under the age of 13
Provide direct notice to parents and obtain
verifiable parental consent before collecting
personal information from children

To Be In Compliance An Organization Must Also:


NOT disclose personal information of children to
third-party agencies (or in the case of childrens
app developers- NOT collect personal
information from children through third-party
apps or plug-ins)
Provide parents with access to information
collected, and the ability to delete it or prevent
further collection of personal information.
Keep information only as long as is reasonably
necessary

Putting procedures into


place to follow SOPIPA
SDCOEs Student Information System Manager has the responsibility to manage the data integrity and
reporting components of the student information systems 1 of the county office and the schools it
supports, and to make sure the county office and districts are in compliance with all laws, codes,
regulations and legal requirements related to the data. In addition this manager must ensure vendor
software meets state requirements.2 As the SOPIPA is specific to industry use of student data my
recommendation would be to add the responsibility for supporting districts in monitoring the adherence
to the SOPIPA to the job description of the Student Information System Manager. This manager would
have the responsibility for monitoring the security procedures put in place by online service providers
and vendors.
In order to do this monitoring I would advise the manager to work with school districts to monitor the
procedures of vendors and service providers rather than relying on them to follow the letter of the law. In
addition the manager would be responsible for monitoring the expectations of a related bill that requires
districts' contracts with vendors to include certain privacy-related provisions. 3 I would also advise this
manager to work with the Integrated Technology Services division of SDCOE to prepare information for
the programs and districts it supports to communicate the intent of the SOPIPA, and support those
organizations in disseminating this information to its employees.
