Re: City-County Payments to Vision Flet
Dear President Lewis and Councillors Barth, Gray, and Adamson;
I am writing to you in your respective roles as members of the City-County Council
leadership to inform you of some very concerning information that I recently discovered.
| have observed your inquires and the attention you have brought to the procurement and
contract problems with the City’s Vision Fleet contract to add over 400 electric vehicles to the
City’s vehicle fleet. Consistent with the questions you have raised in the Council, I have also
begun to review payments from claims and warrants relating to Vision Fleet that have gone
through the Marion County Auditor's Office,
As one result of this review, I have discovered that approximately Two-Hundred
Thousand ($200,000) has been paid to Indy-Vision Funding 1, LLC (a.k.a. Vision Flee) from
the Storm Water Managemest Utility Fund . I further discovered that an additional Ninety Three
‘Thousand ($93,000) was withdrawn from this same fund to cover other expenses related to
leased vehicles. We are stil rying to determine the ecipient ofthe $93,000,May 28, 2015

AAs you know, Revised Code Sec. 135-641 (b) bars any such payments from the Storm Water
Management Utility Fund for uses that are not elated tothe storm water utility. Specifically, the
ordinance states as follows:
This [stormwater management] fund shal be a continaing fund, with all balances
remaining therein a the end of each calendar year. No such balances shal lapse
into the eity or county general funds or ever be diverted, diretly or indivecty, in
‘any manner to any uses other than for the purposes of the Marion County
Stormwater Management District, Emphasis added).
[As such, to the extent that this $293,000 paid to Vision Fleet and other vehicle-leasng firms)
does nt exclusively benefit the Stormwater Management District, some or all ofthese payments,
{rom the Stormwater Management Fund are questionable
1am alerting you te these eonceming payments to include them as part of the Coureil's
‘ongoing review of the Vision Fleet contract. n addition, I will continue my review of payments,
to Vision Fleet and consult with independent legal counsel to determine if any further action is
necessary from my office. I hope ths letter has provided you some useful information. If you
