(On May 254, 2015 Affiant was dispatched to a shooting at 900 Pinetree Road
SE. Upon arriving to the scene Affiant was advised by Sergeant Brian Rees that
Officer G. Benner was shot by an unknown suspect who had fled the area. Sergeant
Rees stated an unknown female was with the suspect and was also shot. The
unknown female was transported to the University of New Mexico Hospital located
at 2211 Lomas Bivd NE in Albuquerque, New Mexico 87106. Sergeant Rees sent
Detective Park to speak with the injured female to conduct an interview.
Detective Parks arrived at the hospital at 2127 hours and was advised the
femate was inthe emergency room and wat awaiting X-Rays, Detective Park waited
until she returned from X-R th the female in her emergency room,

Andrew Romero, approximately one month ago. INN described Mr. Romero
2 skinny, short hair and a prominent neck tatoo sated her
Felationship with Mr. Romero was very violent and he oft ttre) her with 2
blak Bereta firearm. On the date ofthe incident Mr. Romero was forcing her fo
drive her vehicle with him inside around Albuquerquc. INN stated they
began driving inthe city of Rio Rancho because Mr. Romero wanted fo lok for
places to commit burglaries. IIMB also stated she smoked a bow! and a half of
‘ethamaphetamines the morning ofthe incident.

station near the area of 36 Place SE and Southern Boulevard SE.”
stated she went inside the gas station on 36" Place SE and purchased a package of
cigarettes, a bag of Cheetos, and five dotiars in gas. After paying for the items she
‘went back to the vehicle, which was a 1999 Dodge Durango, and Mr. Romero was
standing outside of the vehicle. When approached him she stated Mr.
Romero said he saw a police officer driving on Southern Boulevard and was acting
“paranoid.” I stated Mr. Romero was trying to hide needles he uses to
inject herota info himself. Mr. Romero told MIM to drive the vehicle, since he
observed a police vehicle on Southern Boulevard. ot into the vehicle
and began to drive westbound on Southern Boulevard: stated they drove
past Unser Boulevard and made a U-Turn near “some businesses.”
stated they began driving eastbound on Southera Boulevard when she notieed
police SUV driving behind them stated she was scared for her life and
swerved to get the officer's attention, The officer, Officer G. Benner, did perform a
{alle stop on the vehicle, this was confirmed with the Sandoval County Regional
Communications Center (police, fire and EMS dispatch). Dispatch informed
Detective Park that Officer G. Beaner called a traffic stop out over the radio at 2004
hours in the location of 3301 Southern Blvd SE.
MBI 21-1 cor Beaner approached her and stated he conducted a
traffic stop because the vehicle's registration plate was not receiving a return when
hhe ran it. Officer Benner asked| Jor her information and also for her
passenger's information. stated Mr. Romero stated his name was Albert
and gave false information, MM stated the Offer left and came back asking
her for her passenger's informatio stated she was scared because Mr.
Romero was holding a firearm against her side and didnot want to provide Mr.
Romero's real identity due tothe fear of being shot. Officer Benner explained to
Mr. Romero his information fe not heing found and ached for bis Dats of Birth and
Social Security Number. MIN stated Orticer Benner went back to his patrol
Vehicle and returned again. Dispatch confirmed that Officer Benner provided the
following information in regards to the vehicle: it was n 1999 Dodge Durango

the vehicle's engine off. During this time she stated Officer Benner went around to

Early morning ofthe 26% of May, Mr. Romero was located and arrested by
fhe New Merico State Police department. Mr. Romero was subsequently
transported to the District 5 New Mexico State Police station located at 2501
Carlisle Boulevard NE in Albuquerque, NM. Mr. Romero was driving a Silver in
color 2002 Chevrolet four door” sedan, bearing NM. S8SNFK, VIN
GEES 00, cer Benner was transported to University of New
ico Hospital where he was later pronounced dead at 20:52 hours.

interviewed by New Mesio State Police. During daatinterrtew, Cryst advised the
location of the Dodge Durango Sports Utliy Vehicle (SUV) used during. the
shooting of Officer Benner. The SUV was subsequently located inthe area of 10628
Cavanaugh Drive NW, in Albuquerque.
During the interview with Mr. Romero which was conducted at the New
Mexico State Police District Five Office in Albuquerque, Mr. Romero explained he
was with ind they were in Rio Rancho on May 25, 2015. Mr.
Romero satd he was pulled over by Rio Rancho Police and he was being questioned
by the officer. Mr. Romero said he became anxious by the officers questions.
Mr. Romero said they drove away and the officer gave chase. Mr. Romero
said he was scared as the officer followed and scared by the wa was
driving. Mr. Romero said he pushed MMIII out of the driver seat and the
vehicle came fo a rolling stop. Mr. Romero said as the officer walked up to the
Yehicle he was afraid. Mr. Romero said he pulled out a gua and fired shots at the
officer as he approached the vehicle. Mr, Romero said he was unsure ifthe round.

around.
‘Mr. Romero said he drove away to the intersection of MeMahon and Unser.
He “ditched” the vehicle and called his sister to pick him up. Mr. Romero said he
‘did not know how many shots he fired atthe officer.
