NGO Joint Statement - Item 8 General Debate


Joint statement by the International Lesbian and Gay Association, Allied Rainbow Communities International,
Amnesty International, Article 19-International Centre Against Censorship, Association for Social Solidarity and

Thank you Mr. President.
I am honored to make this statement on behalf of the International Lesbian and Gay Association2 and 13 co-sponsoring
NGOs. It is endorsed by 417 NGOs from more than 105 countries.
Last September, this Council adopted its second resolution on sexual orientation, gender identity and human rights.
Around the world however, members of our communities still face violence and discrimination from State and non-State
actors because of our sexual orientation, gender identity and expression, or intersex status.
For many, these issues are inextricably linked to struggles for gender equality, autonomy over our bodies and lives, denial
of sexual and reproductive health and rights, and the effects of multiple and intersecting forms of discrimination on the
basis of factors such as class, poverty, occupation as sex workers, age, ethnicity, religion, race, HIV status and disability.
In too many countries, LGBTI persons face severe human rights violations - we are criminalized, we face the death
penalty, we are murdered, we are subjected to so-called conversion therapies; we are subjected to rape and forced
marriage; we face genetic de-selection, infanticide, and involuntary so-called reparative therapies; we are demeaned and
beaten, subjected to pathologisation and sterilization, our identities often unrecognized by States.
These violations also extend to the family sphere, where rejection and discriminatory treatment of and violence against
LGBT and intersex family members can have serious, negative consequences for the enjoyment of human rights. In many
countries, our work as human rights defenders is opposed, obstructed or banned, for example through the use of so called
anti-propaganda laws. Our rights to peaceful assembly are often denied, while attempts are made to silence our voices.
There are also positive steady successes and developments in all regions of the world, including the recent adoption by the
African Commission on Human and Peoples Rights of a resolution on the Protection Against Violence and other Human
Rights Violations Against Persons on the Basis of their Real or Imputed Sexual Orientation or Gender Identity, and the
recent creation of a Rapporteurship on the Rights of Lesbian, Gay, Bisexual, Trans and Intersex Persons within the InterAmerican Commission on Human Rights.
In June of last year, we asked the Council to adopt a resolution that ensures regular reporting, constructive dialogue and
sustained, systematic attention to the breadth of human rights violations on the basis of sexual orientation, gender identity
and intersex status. While we welcome the resolution passed in September, and the recent report of the OHCHR, as
additional positive steps forward, we must reiterate that these violations are systemic, and require systemic responses from
the Human Rights Council.

This statement is endorsed by 417 NGOs, see list attached.

En septembre dernier, ce Conseil a adopt sa deuxime rsolution sur lorientation sexuelle, lidentit de genre et les
droits humains. Nanmoins, autour du monde, des membres de nos communauts continuent faire face la violence et la
discrimination de la part dacteurs tatiques et non tatiques en raison de nos orientations sexuelles, identits et
expressions de genre, ou statut de personne intersexe.
Pour beaucoup dentre nous, ces questions sont inextricablement lis la lutte pour lgalit des genres, lautonomie sur
nos corps et de nos vies, la ngation des droits sexuels et reproductifs, et leffet de formes de discrimination multiples et
croises, fondes sur des facteurs comme la classe, la pauvret, la profession de travailleurs/travailleuses du sexe, lge,
lethnicit, la religion, la race, le statut VIH et le handicap.
Dans trop de pays, les personnes LGBTI font face des violations graves des droits humains nous sommes criminaliss,
nous risquons la peine de mort, nous sommes assassins, nous sommes soumis des soi-disant thrapies de
conversion , nous sommes soumis des viols et des mariages forcs, nous sommes confronts la dslection
gntique, linfanticide et des soi-disant thrapies rparatrices , nous sommes rabaisss et battus, nous faisons
lobjet de pathologisation et de strilisation, nos identits sont frquemment nies par les Etats.
Ces violations stendent la sphre familiale, dans laquelle le rejet, les traitements discriminatoires et la violence contre
les membres LGBT et intersexes de la famille peuvent avoir des consquences srieuses et ngatives sur la jouissance des
droits humains. Dans beaucoup de pays, notre travaille comme dfenseurs des droits humains fait lobjet dopposition, est
obstru ou interdit, par exemple travers lutilisation des lois dites propagande de lhomosexualit . Notre droit au
rassemblement pacifique est souvent ni, en mme temps que lon tente dtouffer nos voix.
Il existe dj des succs et des dveloppements positifs et rguliers dans toutes les rgions du monde, y compris
ladoption rcente par la Commission africaine des Droits de lHomme et des Peuples dune rsolution sur la Protection
contre la violence et d'autres violations des droits humains de personnes sur la base de leur identit ou orientation sexuelle
relle ou suppose , et la cration rcente du poste de rapporteur sur les Droits des Personnes Lesbiennes, Gays,
Bisexuelles, Trans et Intersexes de la Commission Interamricaine des Droits de lHomme.
En juin de lanne dernire, nous avons demand au Conseil dadopter une rsolution prvoyant des rapports rguliers, un
dialogue constructif et soutenu, une attention systmatique sur lampleur des violations des droits humains bases sur
lorientation sexuelle, lidentit de genre et le statut de personne intersexe. Alors que nous accueillons favorablement la
rsolution adopte en septembre, et le rapport rcent du HCDH, qui sont des avances positives, nous devons rpter une
nouvelle fois que ces violations sont de nature systmatiques, et ncessitent une rponse systmatique du Conseil des
Droits de lHomme.

Cette dclaration est approuve par 417 ONGs, voire la liste ci-jointe.

Es un honor para mi hacer esta declaracin a nombre de International Lesbian and Gay Association6 y 13 ONGs
copatrocinadoras. Esta declaracin cuenta con el apoyo de 417 ONGs de ms de 105 pases.
En Septiembre pasado, este Consejo adopt su segunda resolucin en materia de orientacin sexual, identidad de gnero y
derechos humanos. Sin embargo, alrededor del mundo, miembros de nuestras comunidades aun siguen sufriendo violencia
y discriminacin por agentes Estatales y no estatales en razn de su orientacin sexual, identidad de genero y expresin, o
estatus intersex.
Para muchos, estas cuestiones estn ntimamente vinculados con la lucha por la igualdad de gnero, autonoma sobre
nuestros cuerpos y vidas, negacin de derechos y salud sexuales y reproductivos; y los efectos de mltiples formas
interrelacionadas de discriminacin por razones de clase, pobreza, ocupacin como trabajadores sexuales, edad, etnia,
religin, raza, VIH y discapacidad.
En muchos pases, las personas LGBTI enfrentan severas violaciones de derechos humanos, estamos criminalizados,
enfrentamos la pena de muerte, somos asesinados, somos objeto de las llamadas terapias de conversin, somos sujetos a
violaciones y matrimonio forzado, enfrentamos de-seleccin gentica, somos degradados y golpeados, objeto de
patologizacin y esterilizacin; nuestras identidades no suelen ser reconocidas por los Estados.
Estas violaciones tambin se extienden a la esfera familiar, donde el rechazo, el trato discriminatorio y violencia de los
miembros de las familias contra las personas LGBTI pueden tener consecuencias serias y negativas en el disfrute de los
derechos humanos. En muchos pases nuestro trabajo como defensores de derechos humanos es obstruido, obstaculizado y
prohibido, por ejemplo, mediante el uso de los llamadas leyes anti-propaganda. Nuestros derechos a la reunin pacifica
son regularmente negados mientras se intenta silenciar nuestras voces.
Tambin hay avances y triunfos positivos en todas las regiones del mundo, incluyendo la reciente adopcin de la
resolucin sobre la Proteccin contra la violencia y otras violaciones de derechos humanos de las personas por razones
de su identidad u orientacin sexual real o percibida de la Comisin Africana de los Derechos Humanos y de los Pueblos.
As como la reciente creacin de la Relatora sobre los derechos de las personas LGBTI en la Comisin Interamericana de
Derechos Humanos.
En Junio del ao pasado, le solicitamos al Consejo que adoptara una resolucin que asegurara la presentacin de reportes
peridicos, que construyera un dilogo y una atencin sostenida y sistemtica de la amplitud de violaciones de derechos
humanos en razn de la orientacin sexual, identidad de gnero e el estatus intersex. Si bien damos la bienvenida a la
resolucin que se adopt en Septiembre, y el reciente reporte del Alto Comisionado como pasos que se han dado hacia
adelante, tenemos que reiterar que estas violaciones son sistemticas, y que requieren de respuestas sistemticas del
Consejo de Derechos Humanos.
