Thecasedealswithagroupofoilandnaturalgasdevelopersthatleasedpropertyfrom
landownersontheedgeoftheMarcellusShaleformation,whichextendsthroughmuch
ofPennsylvaniaandintowesternNewYork.Thecompaniessignedleaseagreementsin
theearly2000s,intendingtodevelopgasdepositstherethroughthetechniqueknownas
fracking.
Theleasesstipulatedafiveyearinitialterm,andincludedaprovisionthatallowedthat
termtobeextended,afterdevelopmenthadbegun,foraslongasthepropertiescontinued
tobeproductive.Thecompaniesplansundertheinitialagreementwerefoiledin2010,
whenthestatelegislaturevotedtoinstituteathreeyearmoratoriumonfrackinginNew
YorkState.
Themoratoriumwaspromptedoverenvironmentalfearsaboutrelativelynew
technology,whichinvolvesinjectingwaterandchemicalsathighpressureintobedrock,
fracturingthestoneandreleasinggasthatcanthenbeextracted.
