The United States of America moves this Court to enforce the plea agreement offered by
the United States of America through the U.S. Attorneys office and accepted by the Defendant.
Merely now because the Plaintiff is dissatisfied with the plea and sentence does not
provide him the right to withdraw his acceptance. The plea agreement clearly described the
charge to which the defendant pled guilty, the factual basis underlying the charge, and the
maximum penalty.
The moving party should be granted relief because the defendant knowingly, voluntarily,
and intelligently waived his right to trial and entered into a plea agreement with the State. The
Defendant engaged in a meaningful colloquy with the trial court based on N.J. Ct. R. 7:6-2 (a)(1)
and stated on the record that he understood his rights and that he chose to waive those rights and
enter into a plea.
The Plea agreements should be interpreted as a pledged in character. U.S. v. DeWitt, 366
F.3d 667,669 (8th Cir. 2004). The parties knew the benefits they were securing and the rights
they were foregoing and the consequences of breaching the agreement. In this case, the only
reasonable remedy for the parties in specific performance of the agreement.

THIS MATTER having been brought to the Court by Anthony E. Smith, Esq., attorney for
the Defendant, and it appearing that no discovery has been supplied, and the Court having
determined that based upon good cause shown;
IT IS ORDERED AND ADJUDGED on this 17th day of February, 2015 as follows:
1. The Plea Agreement agreed upon which the defendant plead guilty is accepted.
2. The motion to withdraw the plea agreement is denied.
3. This Court will meet again in one months time to determine sentencing.
