A RESOLUTION REQUESTING REPRESENTATIVES
ROQUE R. ABLAN, Jr. AND FERDINAND R. MARCOS, Jr.
TO.JOINTLY SPONSOR A HOUSE BILL AMENDING AND
UPDATING CHAPTER XXI OF PRESIDENTIAL DECREE
NO, 856 ON THE DISPOSAL OF DEAD PERSONS, IN THE
INTEREST OF STRENGHTENING THE CRIMINAL
JUSTICE SYSTEM
WHEREAS, the criminal justice system 's made up of five pillars, namely, law
enforcement, prosecution, the ccurts, the correctional system and the community;
WHEREAS, the government has taken several steps to try to restore public trust
and confidence in the criminal justice system by reforming the Philippine National
Police, increasing the pay of prosecutors and state solicitors, and croating additional
divisions in the Court of Appeals, among others;
WHEREAS, offen glossed over in the overhau! of the criminal justice system, in
between enforcement and prosecution, is the sub-pillar on investigation, where the
successful prosecution of casas is most dependent on;
WHEREAS, Presidential Decree No. 856 (PD 856), also known as the Sanitation
Code of the Philippines, specifically Section 96, Chapter XXI thereof, deals with the
disposal of dead persons, including the autopsy of a body whose cause of death was
due to violence or crime;
WHEREAS, PD 856 is so ouldated that it cripples the investigation and
prosecution of criminal offenses, such that the law makes no distinction betwoon
hospital and forensic autopsies; a general practitioner is allowed to perform an autopsy
even if he is not trained for it, and the law is silent when it comes to the autopsy of an
unidentified body;
WHEREAS, Section 95, Chapter XXI of PD 856 must be amended by Congress
immediately in order to strengthen the investigation and prosecution of criminal offenses
and thereafter solidify the five pillars that make up the ciiminal justice system;
NOW, THEREFORE, be it Resolved, as it is horoby Resolved, to request
Representatives Roque R. Ablan, Jr. and Ferdinand R. Marcos, Jr. to jointly sponsor a
House Bill amending and updating Chapter XXI of Presidential Decree No. 856 on the
disposal of dead persons, in the interest of strengthening the Criminal Justice System;
RESOLVED FURTHER, to transmit a copy of this Resolution to the House
Committee on Justice and Representatives Roque R. Ablan, Jr. and Ferdinand R.
Marcos, Jr., for their information and appropriate action.
