    Emeterio C. Ocaya filed a complaint against Diosdado Marapao and Camilo E. Tamin for serious physical injuries. On March 29, 2016, while walking along Legarda Road in Baguio City, Ocaya was approached and attacked by Marapao and Tamin without provocation. Due to the assault, Ocaya suffered multiple injuries including a swollen and cracked left eye, cracked ribs, a dislocated shoulder, crushed kneecaps requiring surgery, and a crushed left pinky finger requiring amputation. Ocaya is pursuing legal action against Marapao and Tamin under Article 263 of the Revised Penal Code for serious physical injuries.

    BaguioCityafterhavingbeensworntoinaccordancewithlaw,doherebydeposeand
    state:
    1. ThatIam filingacomplaintagainst DIOSDADOMARAPAO
    andCAMILOE.TAMIN(Respondents),forSeriousPhysical
    Injuries,punishableunderArt.263oftheRevisedPenalCodewho
    arebothresidentsofNo.85EngineersHill,BaguioCity;
    2. Thatatabout11:00o'clockintheeveningofMarch29,2016,whileIwas
    walking along Legarda rd., Baguio City, I was approached by the
    Respondents and asked if my name is Emeterio, I answered in the
    affirmativeandaskedinreturnwhotheywere.
    3. Suddenly,theyalllookedateachotherandlaughedboisterously
    and then came rushing and started beating me. I never had a
    chancetodefendmyselfbecauseitwasfightoffour(4)against
    one(1).
    4. Duetothesaidincident,Isufferedmanyinjuriesandthefollowing
    are:
    a. Swollen left eye and cracked left eye socket. Requires
    confinementandtreatmentfor45days.
    b. Crackedribs,requiresconfinementfor30days.
    c. Dislocated shoulder ball joint, requires treatment for 20
    days.
    d. Crushed Kneecaps,requiressurgeryandreplacement,and
    restfor60days.
    e. Lefthandpinkiecrushedbeyondrepairrequiresamputation.
    5. IamexecutingthiscomplaintaffidavitinordertofileacaseofSerious
    PhysicalInjuriesagainst DIOSDADOMARAPAOandCAMILO
    E.TAMIN
