I have interviewed a lawyer and He admitted in Philippine Bar on
August 2011. He is a Corporate lawyer. The problem areas in Legal Ethics
in which He has encountered was His client will dectate on Him on how to manipulate laws and offered Him a large amount of money and insisting what the client want even if it is not in accordance with the Law. However, this laywer focused on the core principles of interity in legal practice such as independence, confidentiality, avoiding conflicts of interest, and maintaining professional integrity. Generally, some of His client will offer Him a money to do what clients want even if it is illegal. But He insisted on it because a lawyer shall exercise his duty in accordance with the law and not in accordance with the Clients discretion. Another problem in which He encountered was that, His client request Him to set up a legal structure that appears lawful but which is actually used for illegal purposes. On the foregoing problem that He mentioned to me the only solution to address this problem is to go back on Code of Professional Responsibility of a Lawyer and His four fold duties of a lawyer. First, Duties to Society should not violate his responsibility to society, exemplar for righteousness, ready to render legal aid, foster social reforms, guardian of due process, aware of special role in the solution of special problems and be always ready to lend assistance in the study and solution of social problems. Second, Duties to the Legal Profession candor, fairness, courtesy and truthfulness, avoid encroachment in the business of other lawyers, uphold the honor of the profession. Third, Duties to the Court respect or defend against criticisms, uphold authority and dignity, obey order and processes, assist in the administration of justice, Fourth, Duties to the Client entire devotion to clients interest. By that, bein a good lawyer if you have a passion on your heart on how to protect your client in accodrance with the law, conscience and justice.
