AFFIDAVIT OF CANCELATION OF ADVERSE CLAIM
I, APRIL LEE DIAZ, married to JAMES T. DIAZ, of legal age, Filipino Citizen, with
residence and postal address at Mines View, Baguio City, Philippines, hereby declare
under oath that:
1. I am the legal wife of JAMES T. DIAZ of Bulalacao, Mankayan, Benguet;
2. In the course of our cohabitation, I and my husband acquired a real property
with TCT No. T-57336 located at Palmaville, Puguis, La Trinidad, Benguet;
3. My husband however caused the indication in the Title that he is single so I
caused an adverse claim over the said property which was entered as ENTRY
NO.45556253 as indicated at the back of the title;
4. Recently, we agreed to sell the said property to be able to pay off our debtors
and to settle other obligations;
5. We sold the said parcel of land including its improvements. The Deed of
Absolute Sale was executed and the sale was with my conformity;
6. In view of the settlement of my misunderstanding with my husband I hereby
submit this Affidavit for the cancellation of the adverse claim I executed and
indicated at the back of the Title of the property;
7. I am executing this Affidavit of Cancellation Adverse Claim to serve as notice
to the Register of Deeds of Benguet, that I have withdrawn my adverse claim
and interest in the property covered by TCT No. T-57336 and for all legal
intents and purposes it may serve.
IN WITNESS WHEREOF, I have hereunto set forth my hands this 5 th day of
February 2011, in the City of Baguio, Philippines.
