COMPLAINTAFFIDAVIT
That I, AMANDAT.MONTEJO,oflegalage,married,Filipino
andaresidentofNo.442nd Road,QuezonHill,BaguioCity,afterhaving
beendulysworntoinaccordingtolawherebydeposeandsay:
1 ThatIamtheLoanManagerofUnionBank,SessionBranchBaguio
City.IamexecutingthisaffidavitinbehalfofUnionBank,beingthe
complainanttherein;
2 InbehalfofthesaidBank,IamfilingaformalcomplaintforEstafa
through Falsification of Public Document and/or through Forgery
against respondent ROSAMIA U. GUANZON [hereinafter
Respondent],aresidentof#125WestQuirinoHill,BaguioCity;
3 On September 3, 2013, Respondent using the name of, and
misrepresenting herself to be NATHALIE KAE FORTALEJO
NAVARRO,submittedaloanapplication,purportedlysignedbythe
Spouses, by forging their signatures with Union Bank, Session
BranchBaguioCity,amountingtoPhp5,000,000.00;
4 Assecurityforthepaymentofthesaidloan,Respondentsubmittedas
collateralthereofaparceloflanddescribedinTCTNo.T127891,
andexecutedaRealEstateMortgageoverthesaidlandinfavorof
UnionBank;
5 On November 11, 2018, the loan application amounting to Five
MillionPesos(Php5,000,000.00)wasapprovedbyUnionBankand
the proceeds thereof were delivered to the Respondent, receipt of
which is evidenced by a managers check issued by the bank and
withdrawn by the Respondent, a copy of the said check is hereto
attachedasAnnexAhereof;
6 On December 11, 2018, Summit Bank found out that respondent
falsifiedand/orforgedtheabovementioneddocuments,italsofound
out that respondent misrepresented herself to be Nathalie Kae
FortalejoNavarrowhenintruthandinfacttheformer,asfoundby
the bank is Rosamia U. Guanzon. Respondents real identity was
discoveredbythebankwhenoneofitsemployeesidentifiedherasan
acquaintance as they live in the same barangay and is personally
knowntoher;

7 Respondentsunlawfulactswerediscoveredbythebankwhenthe
lattertriedtocollectfromtheSpousesNavarrowhorefusedtopayon
thegroundthattheydidnotapplyforaloan,muchlessmortgagethe
landcoveredbysubjectlandtitleinfavorofUnionBank;
8 The unlawful acts by Respondent caused damage and prejudice to
UnionBankintheamountofPhp5,000,000.00,theamountreleasedto
respondent as proceeds of the loan, including interest of twelve
percent(12%)perannum;
9 Union Bank spent Php30,000.00 for attorneys fees for filing the
complaintaffidavit;
10 ThatIamexecutingthisaffidavitforandinbehalfoftheUnionBank
SessionBranchBaguioCity,beingtheLoanManagerthereof,tofile
a formal complaint of Estafa through Falsification of Public
Documentand/orthroughForgeryagainstRosamiaU.Guanzon.
