Last May 9, approximately 43 million Filipinos 1
trooped to their respective polling centers to cast their
vote. Some arrived in air conditioned cars.
Others were not as fortunate.

Rich or poor, Filipinos were united in casting their
vote and believing in the electoral process.




11 days have passed since May 9 and we find ourselves at a standstill: are we to believe
the numerous reports of massive electoral fraud2 or are we better off ignoring the cheating
that supposedly transpired? Should we go back to our daily routine or should we probe
deeper into how and why our votes werent counted?

Before you decide which path to take, the information below might be helpful in making up
your mind

During one of the LP rallies, an emcee was caught offering money for the crowd to
clap louder and the video immediately went viral :

All throughout the campaign period, netizens had a field day sharing photos of supposed
LP supporters wearing identical yellow collared shirts from no less than Collezione
(please note that the retail value of each shirt is Php 900.- which is way above the
PhP 4819 minimum daily wage of an average worker)10. The hakot crowd were
provided with brown boxes containing a yellow shirt, 3 baller bands and a fan11 for them
to use.

Not content with this extravagant display of


yellow-ness, the administration party would
insist on using government vehicles and holding
their rallies in public halls, gyms and other
government-owned buildings all at the expense
of taxpayers money.12

Despite all this, Mar Roxas -- the administration


partys choice for President -- remained at the
bottom of the surveys. He could not identify
with the masses. His Matuwid Na Daan slogan
was a joke and everyone knew that. And
although people were upset at this
administrations trapo antics, they let it slide.
Why? Because they believed that Comelec
would do their job and put an end to all of
this nonsense!

Despite all the money that kept pouring


in, Rody Duterte won the election by a
huge margin. No one in their right mind
will believe that Mar Roxas

who remained at the bottom of the
surveys for 3 whole years, got the second
highest number of votes on election day.
Who you kidding? Again, although people
were upset at this administrations vote
buying antics, they let it slide. Why?
Because they believed that Comelec
would do their job and let the will of
the people prevail.

After an election, you can :

pay off the BEI chairman + members and ask them to use the extra (unused) ballots
to increase your votes in a particular precinct.
o How is this done? Simple : all the BEI chairman + members have to do is to
fill up the unused ballots and insert them in the Vote Counting Machines
(VCMs) and thereafter affix the voters signature beside his name in
Computerized Voters List (EDCVL). Remember, precincts rarely have a
100% voter turnout; therefore, there will always be available extra ballots at
the end of the voting hours.20

o Note that Voting Center Machines (VCMs) are prone to technical
malfunctions due to heat, dust etc. Voters are usually asked to wait in the
precinct center while the machine is being fixed. Often times, the voter gets
tired of waiting and so he just goes home and leaves his ballot with the BEI
members. The BEI members either insert the ballot to the VCMs or disregard
it, depending on which candidate depending on which candidate paid them.

that favor your opponent; these are kept in an official COMELEC envelope.

# 2 : Technical fraud : use of pre-programmed SD cards, compromised servers

It was during the 2008 ARMM elections when the country first heard of what is now
commonly referred to as the PCOS (Precinct-Count Optical Scanners) machine.22

In 2010, Filipino voters were introduced to the Automated Election System (AES) through
Smartmatic Inc., a foreign company specializing in technology solutions. 24

During the 2010 elections, several IT groups expressed their concern about surrendering the
fate of our electorate to a foreign company. They were worried that Mark Malloch Brown25
the owner & CEO of Smartmatic would do some smart magic in favor of then Senator
Noynoy Aquino, who had thrown his hat in the Presidential race. Everyone knew that Mark
Malloch Brown served as Cory Aquinos political advisor during the 1986 snap elections so
obviously, a conflict of interest would arise somewhere down the road.26

When Noynoy Aquino won as President, there were many allegations as to how Smartmatic
tampered with the election results (check out https://www.youtube.com/watch?v=g6N2z T
69o) especially in the provinces of Cebu and Bulacan.27

Among those implicated in the 2010 smart magic operations were Pacquito Ochoa
(now Executive Secretary), Mario Montejo (now DOST head), Jun Tolentino
(Comelec Executive Director) and Senator Francis Escudero (of the Noy-Bi fame).
None of the accusations were proven.

During the 2013 Senatorial elections, Smartmatic was at it again. LP candidates won 9 of
the 12 seats that were up for grabs. The losing Senatorial bets cried foul and asked
Comelec to investigate the 60-30-10 pattern that emerged for both winning & losing
candidates.28

Then Comelec Chairman Sixto Brillantes was quoted as saying, the supposed pattern could
be a coincidence and it could not have happened everywhere. Im willing to make a bet that
99 percent of the ballots and the PCOS (precinct count optical scan machines) would have the
same results. To prove his point, he even suggested that the ballot boxes be opened and
that the votes be manually counted. Needless to say, this never happened.29

Now we come to the 2016 elections



2 weeks before the May 2016 elections, a series of articles were written by
Atty. Al Vitangcol, one of the few certified forensic experts in the Philippines, warning the
public about the dark side of automated elections:

For those not in the know, Atty. Vitangcol headed the Joint Forensic Team that investigated
the 60 PCOS machines found in a house in Antipolo City during the 2010 elections.
Yes --the very same election that catapulted Noynoy Aquino as President and yes --
the very same election which was handed to him on a silver platter by Smartmatic Inc.
The companys President & CEO, Mark Malloch Brown, must have been grinning from ear
to ear. He helped Cory Aquino get in to power and now he succeeded again in getting her
son elected.

As explained by Atty. Vitangcol:

The most common question asked by the voting public is whether or not the election
results can be tampered with. The answer is possibly YES.

The configuration files and subsequent voting data generated during election day will be
stored in a separate memory card the Secure Digital (SD) card. The SD card is an ultra
small flash memory card designed to provide high-capacity memory in a small size. The SD
card belongs to the family of popular flash memory cards used for storage in portable
electronic devices.

This brings to mind the CompactFlash (CF) cards that were bundled with the PCOS machine
during the 2010 and 2013 elections. We can still remember that on or about the first week of
May 2010, Smartmatic-TIM/Comelec recalled all the CF cards due to the fact that the PCOS
machines were not counting the votes correctly. They reasoned out that the spacing of the
ballots caused the machines not to count the votes correctly.

The Joint IT Forensic Team then conducted its forensic analysis on 33 units of PCOS machines
on June 4-5, 2010 at the Senate premises and on June 7, 2010 at the Smartmatic warehouse in
Cabuyao, Laguna. The remaining 27 units of the Antipolo PCOS machines were never
subjected to forensic analysis due to the dissolution of the Joint IT Forensic Team on
June 8, 2010 xxx by Sen. Juan Miguel Zubiri.

To this authors mind, the SD card will function in essentially the same way as the CF card.
The SD card is to the VCM as the CF card is to the PCOS. Therefore, an individual having
access to the SD card can alter or modify the configuration files.

These configuration data can be altered in different ways. First, the coordinates can be
deliberately changed so that votes for that particular oval will be disregarded. Second, the
coordinates of the ovals can be interchanged resulting in the swapping of votes of two
candidates. Third, the configuration files can be corrupted or deleted, resulting in the
rejection of all ballots cast.

In the May 10, 2010 elections, some 38 million votes were cast for the Presidential election.
Out of the 38 million votes, approximately 5.2 percent, or around 2 million votes,
were considered invalid. Again, in a hotly contested election, 2 million votes matter a lot!
Having the SD cards separate and distinct from the VCM unit itself opens up the opportunities
for damage, tampering, data alteration, and even card switching.

SD card switching can be done with some technical know-how, with or without a little help
from the BEI, and some sleight of hand. An SD card containing spurious election results is
prepared ahead of the actual elections (called a pre-loaded card). After the closing of
polls, and prior to transmission, the pre-loaded card is switched with the actual SD
card. Thus, it will be the contents of the pre-loaded card that will be transmitted to the
Consolidation and Canvassing System (CCS). If the card switching cannot be done right away
prior to transmission, a fraud operator can simply jam the transmission. This can easily be
done by employing portable jammers.

Atty. Vitangcol was giving us ample warning of the upcoming electoral fraud.

Among the persons responsible for the 2016 smart magic operations were
Pacquito Ochoa (now Executive Secretary), Thady Palma (a known Bicol & Mindanao
operative), Jun Tolentino (Comelec Executive Director), Marlon Garcia (the Venezuelan
Technology Manager of Smartmatic who admitted introducing a new script to the
Transparency Server during the transmission of votes on election day) and a host of others.
It will be interesting to see what happens next.

What this administration forgot to take into account, however, is that -- unlike the 2010 & 2013
elections, the voters today are tech savvy. They can immediately post photos, videos and

We all know that this administration


cheated in the 2016 May elections.
President Aquino himself publicly
stated that he would do everything in
his powers not to let Duterte or
Marcos win. 33


What can we do about it? We should let our voices be heard and demand a manual
RECOUNT of the BALLOTS that are inside the ballot box. To merely rely on
discrepancies between the Election Returns (ERs), Statement of Votes (SOVs) and
Certificate of Canvass (COCs) will get us nowhere since the vote was rigged from the very
start! Since our vote was compromised from the very beginning, everything being
transmitted is equally compromised. Its the proverbial fruit from the poisonous tree
theory.

The way to prove or disprove fraud in the 2016 elections is simple and it will take less
than four days.

How to do it? Easy.

Comelec should tell them to set up 10,000 clean VCMs with clean SD cards in an air
conditioned warehouse. The servers will be local and connected by LAN instead of
through the telcos.
Take all the ballots, divide them into batches for input into the 10,000 machines and
run the ballots through. This will take about 80 hours, or about 4 days if the run
is non-stop 24/7.
Once done, have the VCMs transmit. Since the servers are already local, there won't
be transmission issues or delays.
Process the counting and canvassing.

The media, as well as a representative from each camp, should be allowed to WITNESS the
recount at each and every stage!

This second, confirmatory run is far more effective and far more cost-efficient than a
random manual audit. What it also does is provide a clear nationwide result for ALL
positions -- not just national, but also local positions in hotly contested areas.
Furthermore, since the basis of the run will be on the actual ballots, the will of the people
will be clearly demonstrated.

Who should demand for a recount? We ALL should!

We ALL have a vested interest in clean and credible elections.

Since the law says that such a recount must be paid for by a candidate or candidates, you
should push your candidates -- ALL OF THEM -- to support and pay for a 100% re-feed of
the ballots.

Another option would be to force Smartmatic to shoulder the expenses for the
4 day recount. This is PEANUTS compared to the BILLIONS of pesos in taxpayers money
that it received during the 2010, 2013 and 2016 elections. If Smartmatic still refuses,
Comelec can always opt to use the performance bond that it has with them.

The government already spent Php 11 billion in 2010, Php 8 billion in 2013 and
Php 9 billion for this years polls.34 This is nothing compared to the Php 100 million
(NOT billion) price tag it would cost to RECOUNT the votes.

If Smartmatic wants to clear its Smart-magic 35reputation, all it has to do is to say YES.

What about those who oppose the re-feed? Well do they have something to hide?!!

The above surveys did not include the endorsements from Iglesia Ni Cristo 38and
El Shaddai.39 which counts for at least 3 million votes.
On election day, the exit polls clearly showed a pattern as to who the winners would be:
Rody Duterte (for President) and Bongbong Marcos (for Vice-President).40

When the polls closed at 7:00pm and the public eagerly watched the results of the PPCRV
quick count, the trend was clear: it was Rody Duterte (for President) and Bongbong Marcos
(for Vice-President).

Then something strange happened

At around 7:30 in the evening on election day, Bongbong Marcos was leading the VP race
with over a million votes. Then all of a sudden -- the votes stopped coming in.
Viewers couldnt understand why the votes for Senators would appear and yet there was
no movement when it came to the votes for VP. When counting resumed an hour later,
the fix was in!

Statisticians and IT experts have joined forces to publicly condemn what transpired.

According to quantitative analysis professor Antonio Contreras:

It was statistically impossible for Robredo to overtake Marcos in the race with 80 percent of
the returns already counted. Marcos was leading the count on the night of May 9 but his
numbers and those for his closest rival Robredo were reversed in the early hours of May 10.

THE cascade of votes for Rep. Leni Robredo that allowed her to obliterate the almost one
million lead of Sen. Ferdinand Bongbong Marcos Jr. on May 10 looked strange and the
movement of the votes appeared to have been manipulated.

Since then, the increase and decrease of votes between Robredo and Marcos was constant
and the graph showed a straight line. This trend was true also with the other vice
presidential bets against that of Robredo,

Even if we factor in the bailiwicks, it should have been a zigzag line which is a natural
pattern in elections.42

Statistician David Yap of the Ateneo de Manila University not only agreed with
Professor Contreras findings but went even a step further by saying that based on the
linear pattern of transmitted votes, it was obvious that for every 1k votes of Marcos,
45k went to Robredo:

The script

A hash code is considered the fingerprint of any software.
On Monday evening, Smartmatics Marlon Garcia changed a hash code of a data package
containing election results received by a Comelec server.
According to Garcia, he tweaked this so that the letter "" would appear as appear as ""
and not as a question mark. Hence, it was only a cosmetic change.
Garcia should be made to explain the following :

who authorized him to make the change? Under the law, only duly authorized
personnel from Comelec (and not Smartmatic) are allowed to make changes in our
system

why the sudden concern for Roy Seneres? No amount of cosmetic changes could
affect Roy Seneres votes because he passed away last February 8, 2016

why is it that right after Garcia changed the hash code, the votes for Marcos
decreased while the votes of Robredo increased in a highly suspicious linear
manner.

Based on the whistleblowers disclosures, the Comelec Transparency Server used
2 different programs: one before 8 pm on May 9 and another after that. The IT expert
explained the extent of the Venezuelan technicians breach of security by saying,
The Smartmatic technicians job was only to receive, decrypt and distribute the files.
Instead, he introduced a new script, a new computer program and commands that could
alter everything and supersede the existing program.





If truth be told, this is not the first time Marlon Garcia got caught with his finger in the
cookie jar.
Last year, a case of electoral sabotage was filed against him and other Smartmatic
personnel for allegedly altering the source code of the Precinct Count Optical Scan (PCOS)
machines during the May 2013 elections.48
The changing of the source code also happened at the Command Center of the Parish
Pastoral Council for Responsible Voting (PPCRV) about two hours after the polling places
had closed. The complainants likewise alleged that the alteration was done without the
required notification from Comelec and the other political parties.49 This happened after
around 10 million votes for the Senatorial candidates had been received in the PPCRV
transparency server.

PPCRV findings
According to PPCRV, they saw no significant discrepancies so they believe that the script
that was introduced by Smartmatic did not affect the votes. They have no basis for
saying this.

PPCRV has volunteers in over 90 thousand precinct sites and it is the job of their volunteers
to get the physical print out of the ERs (Election Returns) and send the same to the PPCRV
headquarters at Pope Pius where the results are encoded. The physical data is compared
to the transmitted data to ensure that what was printed in the polling center is the same
as what was transmitted. This process is called bashing or comparing.

If the SD cards were already compromised at the precinct level then logic dictates that the
data from the physical print out of the Election Returns as well as the transmitted data
were likewise compromised.

















If it is true that the SD cards were kept under lock and key as mandated by law, why were
there several news reports of Comelec officials frantically looking for SD cards in dumpsites
in Negros Occidental and other areas?51

According to Atty Al Vitangcol, SD card switching can be done with some technical
know-how and with or without a little help from the BEI. All one has to do is to prepare
spurious election results ahead of the actual elections (called a pre-loaded card) and
after the closing of polls, and prior to transmission, the pre-loaded card is switched
with the actual SD card. Thus, it will be the contents of the pre-loaded card that will be
transmitted to the Consolidation and Canvassing System (CCS).52
There are several places where these unscrupulous operators get extra votes for a
preferred candidate:

from the dagdag bawas program they insert in the machine itself53

from the old voting machines that were not turned over to Comelec
(the old machines are usually brought to Mindanao since its common knowledge
that elections are conducted the night before and all one has to do is to bribe the
datu in a particular area)
o recall that in the May 2010 elections, 60 PCOS machines were found in a
house in Antipolo54

from the voters who changed their polling place
o for instance, if Juan dela Cruz was a registered voter in Quezon City during
the 2010 elections and then for the 2016 elections, he decided to be a
registered voter in Bicol, that would mean he had his biometrics done in
2 places : Quezon City and Bicol. Under the law, Comelec should immediately
expunge the records of Juan dela Cruz in Quezon City. What if they
intentionally forgot to do this? That would mean that in the May 2016
elections, the real Juan dela Cruz will cast his vote in Bicol while the fake
Juan dela Cruz will also cast his vote in Quezon City. These double
biometric entries amount to 3.8 million votes!!
o This is precisely why 23 year student Paul Biteng hacked the Comelec
website in April 2016. He purposely uploaded the hacked data of registered
voters on line because he wanted voters to know that the double biometric
entries were all over the place! Instead of resolving the problem, Chairman
Andy Bautista decided to have him jailed!55

NAMFREL findings

The task of the election watchdog NAMFREL, on the other hand, is to conduct Random
Manual Audits (RMA) on at least 713 Voting Center Machines (VCMs). When conducting a
RMA, the voting machine is opened and each ballot will be appreciated manually through
stick counting. After this, the stick count results are compared with the Election Returns
that was printed from the voting machine. The task of NAMFREL is to ensure that the
ballots were counted properly at the precinct level.

Although NAMFREL is supposed to be Comelecs partner in safeguarding the votes, they


complained that they were not allowed access in several places, particularly in Manila,
Quezon City, Paranaque and Lanao. In the other areas where they were supposed to
conduct random audits, they were told by Comelec officials that the same had already
been done.56

As of May 20, 2016, NAMFREL discovered that 600 of the 713 ballot
boxes they manually audited contained highly suspicious results.
The 600 ballot boxes have been sent to Manila and are now in the
custody of the Comelec central office. Comelec is supposed to conduct a
root cause analysis (to find out why the numbers dont add up). Before the Comelec
mafia starts fudging the results again, the media should be allowed to observe the
proceedings.

The undervote disadvantage

Perhaps the most shocking evidence of fraud in the May 2016 elections was through under
voting.

An undervote occurs when the number of choices selected by a voter in an election is
less than the maximum number allowed for that contest. An undervote also occurs when
no vote is cast for a single choice contest. For instance, a voter may decide to cast his vote
for Rody Duterte (for President) but leave the choice for Vice President blank. This is
called an undervote.

According to Atty. Al Vitanggol, when Noynoy Aquino ran for President in 2010,
some 38 million votes were cast for the Presidential election. Out of the 38 million votes,
approximately 5.2 percent, or around 2 million votes, were considered invalid. Again,
in a hotly contested election, 2 million votes matter a lot! Having the SD cards separate and
distinct from the VCM unit itself opens up the opportunities for damage, tampering, data
alteration, and even card switching.57

It would appear that the perpetrators of the undervote scheme perfected their
operations because in the May 2016 elections, there were 2.8 million undervote or
missing votes! This is a lot higher than the figure of the missing votes in the 2010
elections.

Based on the summary below and after cross-referencing the same with the data obtained
from the transparency server, one cannot help but wonder why the undervote numbers for
VP are unusually high. The total undervotes in 10 regions are between 10 17%. For
instance, out of 736 voters in a precinct in Region 8, 355 are undervotes : with Marcos
only getting 82 votes and Robredo getting 162. This means that in Region 8, which is a
Marcos bailiwick, Robredo got nearly double the votes of Marcos.

The NoyNoy Presidency

It was exactly 6 years ago on May 2010 when we trooped to the polls and exercised
our right to vote under an automated election system. We accepted and respected the
results of the elections because we believed it was clean and honest. We will never know if
Noynoy Aquino won the elections on his own or if he had a little help from his
(smart-magic) friends. Either way, the people had spoken and it was our duty -- as
Filipinos -- to respect that mandate.

What did Noynoy Aquino do with that mandate? He used it to get back at GMA by
incarcerating her at all cost. And he succeeded. He used it to impeach CJ Corona because
of alleged lapses in his SALN. And he succeeded. He used it to send 3 independent
Senators to jail because of the alleged PDAF scandal. And he succeeded.

Good for you, Mister President!

Now that your vindictive ego has been satisfied, perhaps you could explain to your
bosses:

why you were nowhere to be found during the hostage crisis of the Chinese tourists
in August 2010?60 Was your obsession with Play Station more important?

why you never went back to Tacloban after Typhoon Yolanda?61 This was the
hardest hit city in the Visayas and yet you never ever bothered to check on the
thousands of homeless residents there.

During your first SONA, you declared to everyone that you are my bosses and promised
everyone no more wangwang. Yet here we are -- 6 years later and nothing really
changed. Its pretty obvious you never cared about your bosses. And as for the promised
wangwang, that pales in comparison with photos of your sister riding the Presidential
helicopter during the campaign period.

And you wonder why there was a PROTEST vote?

The candidates you handpicked and personally campaigned for day in and day out
never stood a chance. The people were fed up with your lies and empty promises.
No amount of bribery could liven up the crowds.

When all the signs pointed to a Duterte Marcos victory, you immediately shifted gears
and threw everything (including the kitchen sink!) at Duterte. Suddenly, there were all
these reports about bank accounts and properties that Rody Duterte and his family
allegedly owned reminiscent to what you did to CJ Corona. Same script, different actors,
bad ending.

And what about Bongbong Marcos? Well your plan B was never any
secret. Everyone knew that in case Duterte couldnt be stopped,
you would let Robredo win at all costs. Then, as soon as the
honeymoon period was over, you would order your minions to file
impeachment proceedings against Duterte and our nation would be
in turmoil again!


You must be the most DIVISIVE leader this country ever had! Very Richard III minus
the hunchback. Shame on you!!

The people are tired of all your spoiled brat antics. They want to be united.
They want change. They voted for change.

What part of PROTEST vote dont you get, Mister President?!!

There are 41 days left before you have to officially step down as President on June 30.
You still have a chance to do the RIGHT thing by allowing the TRUE voice of the people to
be heard.

Conclusion

This is not about winning or losing. This is about safeguarding the sanctity of our ballot.

The very essence of democracy is the right to vote and therefore the right to choose
your future. Corollary to this is the right to have your vote counted and have your voice
heard.

Again, this is not about winning or losing. Let the chips fall where they may in an honest,
fair and clean election. But let it be FAIR -- and not one where our votes are imposed on us
by a mad, vindictive and paranoid President.

This is ultimately about us and our future.

Let our voices be heard.
