    whenyoucomparethenumberofpeoplewhoeitherusecigarettesorecigarettes,thesmokers
    aregoodatvaryingtheamountofnicotinetheytakein.Forexample,asmokercouldtakea
    longerinhaleonacigaretteandtakeinmorenicotineandthesamethinggoesforecigarettes.

    askedaboutwheretheauthorityforregulationcomesfrom,andSargentsaiditisacongressional

    AsfarasheknowsnobusinessinVermonthasaskedforavaporban.Hedoesntknowwhy
    afterecigaretteshavebeeninVTforsolongthatthishasnowstartedbeingperceivedasa
    problem.Hesaidthatmostpeoplewhouseecigarettesareusingthemtoquitsmoking.Hehada
    studyreferencedinhistestimonythatshowedthat20%ofpeopleinastudywhohadno
    intentionofquittingsmokingdidquitoncetheyweregivenanecigarettes.
    Tredwellalsosaidthatifthisbillispasseditwillsendthemessagetoteensthatifyouban
    ecigarettesthanitsendsthemessagethatsmokingisbetterthanecigarettesandtheymightas
    wellsmoke.Hesaidstudiesshowthatyoutharelikelytoexperimentwithecigarettes.Buthe
    saidtherewasastudyreferencedinhistestimonythatshowedaverysmallnumberofthosewho
    experimentedwiththemwhobecameregularusers.

    AndrewMacLean,Lobbyist,MMR:Hesaidunlikethetraditionaltobaccomarket,itisnotas
    dominatedbylargecompanies.Hesaidthislegislationhastobeviewedfromtheindustrys
    perspective,inregardstotaxationontheproduction.
    Hesaidtheideaoftheproductoftheforadultsisawaytoregulatenicotineinalessharmful
    waythansmoking.
    HesaidEnglandproducedastudyfromtheCancerResearchofEnglandanditsaid39%of
    peoplewhoweretryingtoquitsmokingusedecigarettes.Hesaidinthisstudyitstatedinthe
    numberofpeoplewhodontsmokecigarettes,veryfewpeopleuseecigarettes.
    HeshowedthesurveyfromVermontVapethattheyconducted,andithad88adultecigarette
    users,andoutofthosepeopleonly3haddualuse.Heclaimsitisalargesurvey,butitseemsthe
    committeedidntagree.HesaidfromR.J.Reynoldsperspectivetheysupportthetryingtokeep
    themawayfromteens,buttheydonotsupportthepublicban.

    SenatorCollamoresproposedamendment:line12oftheamendmentstatestheproductsbe
    providedinalockedcontaineronthesalescontainerorinthecustomerareaofthestore.

    RebeccaRyan,AmericanLungAssociation:Shesaidshedoesntthinkthisamendmentchanges
    currentstatute.Shesaidthepointistogettheproductsoutofsightofchildren.Fromwhatshes
    seenthelockedcontainersarenotverybig,andcouldeasilyfitbehindacounter.Shedoesnt
    supportthisamendment.SenatorLyonswouldsupporttheproposal.

    CommitteeDiscussion:Thecommitteedecidedtoincludetheamendment.SenatorCollamore
    opposestheentirebill.Thereasonisthatheopposestheworkplacerestrictions.SenatorLyons
    andPollinaareinsupportofthebill.SenatorPollinasaidhebelievesthatecigarettesdohelp
    peoplequitsmoking,buthebelievestherestrictionsinthebillallowpeopletodosoandthatthe
    publicusenormalizesthebehavior,whichtheydontwant.SenatorLyonssaidthereisno
    regulationinthedevelopmentofwhatisinthevapor.Shesupportstheworkplacepieceofthe
    bill.SenatorAyersuggestedthattheygoovertestimonyandvoteonthebilltomorrow.
