We have had continuous running battles with the HOA since 2007 over their failure to act in a
proper fiduciary manner and act transparently. There are also some critical issues over City
water pipelines crossing a very large wash in the subdivision and other flood related issues.
We initially won a case against them at the OAH in 2007 over their failure to give up a Violation
Notice issued against the then Board President. Our win was then challenged in Superior
Court by Ekmark & Ekmark who ran up almost 18 months of annual dues (~$50,000) before
the insurer caved and the matter was settled
They are now on their 3rd Management Company after a period of self-management.
We then won a case in 2012 over their carry over of absentee Ballots when the first attempt
failed to attract sufficient votes.
The current case before the OAH was initially dismissed by the ALJ but then reinstated and we
are proceeding with briefs to the ALJ. A response from Carpenter Hazelwood is due May 20,
2016 and an imminent ruling on how to proceed shortly after that
Another petition is pending over their complete changing of the Board without holding any
Meetings to effect that publicly.
