SCHOLARSHIP AGREEMENT

(Graduate Program Local)


KNOW ALL MEN BY THESE PRESENTS:
This Scholarship Agreement (Agreement) is made and entered into this enter month &
day, 201Y in Quezon City, Philippines by and among:
The COMMISSION ON HIGHER EDUCATION (CHED), a government regulatory agency of the
Republic of the Philippines established under Republic Act No. 7722, with principal office
address at the Higher Education Development Center (HEDC), C.P. Garcia Ave., UP Campus,
Diliman, Quezon City, represented herein by, Dr. PATRICIA B. LICUANAN, in her capacity as
Chairperson, hereinafter referred to as the CHED;
The name of Sending Higher Education Institution, a higher education institution with principal
office at address of Sending Higher Education Institution represented herein by, name of
representative, in his/her capacity as position, hereinafter referred to as Sending Higher
Education Institution or SHEI;
- and Name of faculty or staff scholar of legal age, Filipino and with residence at address of
faculty or staff scholar hereinafter called the GRANTEE.
WITNESSETH
WHEREAS, Republic Act (RA) No. 7722 provides that it is the responsibility of the State to (1)
protect, foster and promote the right of all citizens to affordable quality education at all levels,
and (2) take appropriate steps to ensure that education shall be accessible to all. Republic Act
(RA) No. 7722 further mandates CHED to (1) formulate and recommend development plans,
policies, priorities and programs on higher education and research, and (2) identify, support and
develop potential centers of excellence in program areas needed for the development of worldclass scholarship, nation building and national development;
WHEREAS, pursuant to this mandate, CHED seeks to upgrade the academic qualifications of
higher education faculty during the period of transition to the K to 12 system;
WHEREAS, CHED approved CHED Memorandum Order No. 03, s. 2016 entitled Guidelines
on Graduate Education Scholarships for Faculty and Staff Development in the K to 12 Transition
Period. which sets forth the procedures, priorities, and regulation of scholarships awarded to
Grantees beginning in the K to 12 Transition Period;
WHEREAS, the SHEI is in need of improving the qualifications of its faculty teaching in the
identified priority fields, and hence, has allowed the GRANTEE to undertake full/part time
graduate degree study (local) in any of the identified delivering higher education institutions
(DHEIs);
WHEREAS, the GRANTEE is ready, willing and able to undertake full/part time graduate degree
study (local) in any of the identified DHEIs and by acceptance of this scholarship/grant,
GRANTEE agrees to comply with relevant laws, rules, regulations, policies and procedures of
CHED, SHEI, and DHEI.
NOW, THEREFORE, for and in consideration of the foregoing premises, the parties involved
agree, as they do hereby agree, to fulfill the following terms and conditions of the
aforementioned scholarship program.

A. Scholarship Grant
CHED hereby awards to the GRANTEE a full scholarship or thesis/dissertation grant to
complete his/her enter text course at the name of DHEI on full or part time basis commencing
on enter dd month yyyy and within a total period not exceeding no. of years year/s and no. of
months month/s except for causes beyond his/her control, effective from the start of the
semester that he/she is enrolled in the said course.
Under the scholarship package, the GRANTEE* is entitled to the following:

*with the exception of the thesis/dissertation grantees who are entitled to receive the

Notwithstanding the foregoing, CHED shall set the scholarship amount annually, benchmarking
with other scholarship-granting bodies and adjusting for inflation.
The GRANTEE shall also be entitled to other incentives and grants from CHED, inclusive of but
not limited to the following, as available:
1. Access to Online Journals. Grantee shall be provided access to online journals, when
available;
2. Early Completion Incentive. Should GRANTEE obtain his/her respective degrees at least one
regular term (semester, trimester or quarter) ahead of the approved plan of study, he/she shall
be entitled to a cash incentive equivalent to the total remaining living allowance for the
scholarship period;
3. Dissemination Grant. GRANTEE may apply for a grant to participate in paper presentations or
conferences in the Philippines or abroad, subject to the evaluation and approval of CHED, and
available funds. The grant amount shall be set on a yearly basis and benchmarked with other
grants of the same nature; and
4. Research Grant. GRANTEE may apply for a grant to fund a research project provided he/she
submits a project proposal and budget breakdown endorsed by the adviser, subject to the
evaluation and approval of CHED, and availability of funds. The grant amount shall be set on a
yearly basis and benchmarked with other grants of the same nature.
5. Disbursement of Funds. CHEDs disbursement of funds to the Scholar for the
thesis/dissertation allowance shall be undertaken as follows:

B. GRANTEEs Representations and Warranties


1. GRANTEE is a Filipino citizen not more than 52 years old for the masters degree program, or
not more than 50 years old for the doctoral degree program; or not more than 60 years old for
Dissertation Grants, Professional Advancement Grants, and Post-Doctoral Fellowships, unless
otherwise allowed by CHED on a case-to-case basis;
2. GRANTEE shall pursue graduate studies in a CHED-recognized DHEI, in a discipline aligned
with his/her teaching specialization. GRANTEE for thesis/dissertation grants may pursue
graduate studies in a non-CHED recognized DHEI; GRANTEE is in good health and of good
moral character;
3. GRANTEE demonstrates strong academic record;
4. GRANTEE has no pending criminal charges, and shall not have been convicted for violation of
any Philippine Law; and
5. GRANTEE shall fulfill all the Terms and Conditions of the scholarship, including a re-entry plan
and return service obligation as agreed with his/her respective SHEI, consistent with the
guidelines set by CHED.
C. GRANTEEs Obligations and Responsibilities
1. GRANTEE for masters or doctoral degrees shall enroll based on the approved plan of study or
at least nine (9) units study load per term except during the last term.
2. GRANTEE shall enroll in the program of study and field of specialization and shall not change
the program of study or specialization without first securing the written permission from both the
SHEI and CHED.
3. GRANTEE shall finish the degree within two (2) years for masters and three (3) years for
doctoral degree. The time limit for the doctoral degree may be extended to four (4) years
provided that the extension shall be to undertake further research for the doctoral dissertation.
The time limit shall be adjusted accordingly for GRANTEE who avails of the grant for ongoing
masters or doctoral degrees according to the units of coursework and/or amount of research
still to be undertaken.
4. GRANTEE shall avail of the tuition privilege of a particular subject only once. CHED shall not
shoulder any subjects being retaken or re-enrolled.
5. GRANTEE shall seek written clearance from CHED two (2) weeks before leaving the country
while the scholarship Agreement is in force.
6. GRANTEE shall make the following submissions to CHED for the duration of the scholarship,
through the DHEI or the CHED Online Portal, when available:

1. The SHEI and GRANTEE shall agree on a re-entry plan for the GRANTEE upon completion of
his/her degree, according to the standards set by the CHED.
2. GRANTEE shall render return service on the semester immediately following completion of
his/her degree, as approved upon submission of nomination. Return service shall be in the form

of teaching, research or extension, based on mutually agreed-upon terms between the


GRANTEE and the SHEI, and shall be compensated according to the policies of the SHEI.
The GRANTEE shall be obliged to render return service according to agreement with the SHEI,
provided that it follows at least a 1:1 ratio, i.e., one year of service for every year of the
scholarship. Faculty awarded scholarship for ongoing graduate studies shall render return
service proportional to the length of period of his/her graduate studies covered by the
scholarship. Faculty awarded thesis or dissertation grants, on the other hand, shall render one
year of return service.
GRANTEE agrees that he/she may be required to teach in the SHEI during the period of his/her
scholarship. [May insert here provisions on compensation for teaching workload of Grantee in

for the purpose of research work, or any such activity related to or in furtherance of the
completion of his/her thesis or dissertation.
GRANTEE shall be allowed to defer his/her availment of the scholarship provided that the
deferment is due to acceptable reasons and GRANTEE shall only be allowed to defer for a
maximum of one semester. Such deferment shall be contingent on the approval of CHED.

D. CHEDs Obligations and Responsibilities


1. CHED, upon favorable recommendation of the SHEI, may provide written permission to
GRANTEE should he/she desire to change his/her program of study or specialization, subject to
meritorious justification.
2. CHED may approve GRANTEEs deferment.
3. CHED shall provide written clearance to GRANTEE should the latter wish to depart from the
country while the scholarship contract is in force, subject to meritorious justification.
4. CHED shall endeavor to ensure timely disbursement of allowances and funds
5. CHED shall reimburse bridge funding provided by SHEI in the event of delay in the
disbursement of funds upon presentation by the SHEI of the relevant documents.
6. CHED, together with the SHEI shall be responsible for the collection/deduction of a GRANTEEs
payment obligation, in cases of non-completion or termination of scholarship. The terms for the
payment of obligation shall be evaluated and decided upon by CHED.
7. CHED shall receive the monitoring and evaluation reports on the scholarship implementation
submitted by the DHEI at the end of each term.
8. CHED shall receive the liquidation reports of all scholarship disbursals and expenses submitted
by the DHEI at the end of each academic year.
9. CHED shall provide access to the CHED Online portal, when available.
10. CHED shall receive submissions through the DHEI or the CHED Online Portal, when available.
11. CHED shall receive the monitoring reports issued by the SHEI showing the status of
GRANTEEs return service. Likewise, CHED shall receive the written notice from the SHEI
regarding GRANTEEs completion of his/her return service, after which CHED shall issue a
Certificate of Completion to GRANTEE and relieve him/her of all obligations under the grant.
12. CHED shall set the standards for the re-entry plan of the GRANTEE.
13. For special cases, CHED may impose rules or regulations pertinent to return service by the
GRANTEE under the graduate scholarship, including in the case of failure to complete the
required courses.
14. CHED reserves the right to terminate the scholarship and/or impose the appropriate sanctions
against the GRANTEE in accordance with the provisions of Sections H and I of this Agreement.

E. SHEIs Obligations and Responsibilities


1. SHEI may favorably recommend to CHED GRANTEE application to change his/her program of
study or specialization, subject to meritorious justification.
2. The SHEI shall maintain up-to-date profiles and supply all other information required on the
CHED Online Portal, when available.
3. While CHED deems that all GRANTEEs are on Leave of Absence (LOA) without pay from the
SHEI for the duration of the scholarship, SHEIs are encouraged to provide counterpart funding

or other forms of support to GRANTEE, especially when the regular salary of GRANTEE is
higher than the living allowance amount provided by CHED. SHEI may work out an internal
arrangement with GRANTEE in line with the Collective Bargaining Agreement, when applicable,
and/or in which the faculty is not on LOA, for as long as he/she is able to entirely comply with
the Terms and Conditions of the scholarship.
4. In the event of a delay in disbursement of funds for GRANTEEs, SHEIs shall be requested to
provide bridge funding that shall be reimbursed by CHED upon presentation of relevant
documents.
5. SHEI may endorse GRANTEEs written request for deferment, subject to meritorious
justification.
6. The collection/deduction of a GRANTEEs payment obligation shall be the responsibility of the
SHEI, together with CHED, subject to evaluation and approval by CHED of the terms for the
payment of obligation.
7. The SHEI shall be in charge of monitoring the return service and shall inform CHED of the
status of the same. Upon completion, SHEI shall send CHED a written notice affirming the
GRANTEEs completion of the obligation, after which CHED shall issue a Certificate of
Completion to GRANTEE and relieve him/her of all obligations under the grant.
8. The SHEI shall recommend to the CHED the termination of GRANTEEs scholarship should the
grounds in Section H arise.
9. The SHEI, together with the GRANTEE, shall agree on a reentry plan for the GRANTEE upon
completion of his/her degree, according to the standards set by CHED.
10. The SHEI, together with the GRANTEE, shall agree upon terms for the return service which
shall be in the form of teaching, research or extension and shall be compensated according to
the policies of the SHEI.
11. SHEI shall honor and faithfully comply with the provisions of the return service agreement,
including but not limited to, implementation of GRANTEEs re-entry action plan.
12. SHEI shall extend full cooperation to CHED to ensure smooth implementation and coordination
between both parties, including but not limited to, attending workshops/seminars organized by
CHED;
13. The SHEI undertakes that during the period of the GRANTEEs scholarship award, GRANTEEs
tenureship/years of service will still be continuing and his/her availment of the grant shall not
result to a break in service.

F. Leave of Absence or Deferred Enrollment

GRANTEE shall not be allowed to defer enrollment except for:


Poor health of grantee (if the grant is already ongoing), certified by a government physician;
Maternity Leave of Absence (LOA) of the grantee;
Other meritorious reason acceptable to the SHEI, the DHEI and the Commission.
An approved LOA shall first be obtained by the GRANTEE from the DHEI, then submitted to
CHED along with a written request for deferment and an endorsement from the SHEI. If found
acceptable, CHED shall approve said request in writing.
3. Should GRANTEE receive full privileges during the term, notwithstanding that GRANTEE/or
went on approved LOA from DHEIs and scholarship deferment from CHED during the said term,
the proportionate amount shall be deducted from GRANTEEs entitlements in the succeeding
term.
G. Grounds for Termination of Scholarship
CHED reserves the right to terminate the scholarship, upon recommendation of the SHEI and/or
the DHEI, under any of the following circumstances:

The GRANTEE fails to meet the academic standards set by DHEI;


The GRANTEE fails to complete the degree within the specified time;
The GRANTEE wilfully fails to enroll with the required academic load;
The GRANTEE fails to enroll for a term without the approval of the DHEI and the Commission;
The GRANTEE resigns or transfers from his/her SHEI to another HEI without prior approval
from the SHEI and CHED;

6. The GRANTEE fails to re-enroll one (1) academic year after an approved LOA or from date of
deferment;
7. The GRANTEE fails to obtain the approval of CHED before changing the field of study or
specialization;
8. Any act of immorality, drunkenness, dishonesty, and any other form of misconduct;
9. Conviction of any crime by a court or proper administrative body; and
10. Such other acts as may be considered by CHED as inimical to the interest of the Government of
the Republic of the Philippines and those that adversely affect the integrity of the Graduate
Scholarship Program.
The grant/scholarship shall also be terminated on the following grounds:
11. Non-availability or exhaustion of funds;
12. Other justifiable grounds which prove the inability of the GRANTEE to complete his/her degree
(e.g. poor health of GRANTEE as certified by a government physician, etc.);

H. Other Sanctions
Other than the foregoing termination, GRANTEE shall also be subject to the following sanctions
should the corresponding circumstances occur, thus:
1. All financial support extended to GRANTEE shall be repaid to CHED, without need of demand,
except when the program is terminated due to lack of funds, other justifiable grounds which
prove the inability of the GRANTEE to complete his/her degree, or due to death of the
GRANTEE.
2. When GRANTEE fails to fulfill his/her service obligation, either due to unauthorized transfer to
another school/institution or resignation from his/her SHEI, or other analogous circumstances,
he/she is required to pay back to the concerned institution/s, without need of demand, all the
privileges enjoyed and the money value of the service obligation based on his/her salary
equivalent at the time of transfer or resignation, unless there is a showing that GRANTEEs
failure is not due to his fault or negligence. The refund of the GRANTEEs monetary privileges,
which were received while on leave from the program, may be waived due to serious health
reasons, provided a medical certificate duly endorsed by the SHEI is submitted to the DHEI and
CHED.
3. Failure to fulfill the obligations herein stated shall result in administrative or criminal action, and
shall disqualify the GRANTEE from any other further CHED grant.

Waiver of Accountabilities
Upon successful completion of the program, including completion of return service and
submission of all required documents, the GRANTEE shall be relieved of all accountabilities
under the scholarship Agreement and the program.

J. Administration of the Program


CHED shall administer the scholarship program in accordance with CHEDs rules and
regulations; and such other related issuances/revisions/amendments of the same for proper and
effective implementation of the scholarship program.
The GRANTEE hereby understands that this agreement is subject to the rules and regulation,
orders and memoranda issued and to be issued by the CHED for the proper and effective
implementation of the scholarship grant, and that he/she shall abide by any or all rules of
CHED.
K. Non-Waiver

The failure of CHED to insist upon the strict performance of any terms, conditions and
covenants hereof shall not be deemed a relinquishment of waiver of any subsequent breach or
default of such terms and conditions and covenants.
L. Attorneys Fees
In the event of any suit against CHED for the enforcement of any stipulation of this Agreement
or right under this Agreement, the suing party shall pay CHED attorneys fees which shall not be
less than P 30,000.00 for services before the Metropolitan Trial Court; and not less than P
50,000.00 for services before the Regional Trial Court, in addition to the other damages,
expenses, costs of the suit.
M. Litigation and Venue
In the event judicial relief against any party is filed by CHED before the regular courts, for the
enforcement of the terms and conditions in the Agreement, the guilty party in addition to any
other damages and attorneys fees that may be awarded by the court, agrees to pay ten percent
(10%) of the amount claimed but in no case less than Ten Thousand Pesos as liquidated
damage, aside from the costs of litigation and other expenses which the law entitles the
aggrieved party to recover. The parties agree that the venue of court action shall be exclusively
in the proper courts of Quezon City.
N. Execution in Counterparts
This Agreement may be executed in any number of counterparts, each of which shall be an
original, but all of which together shall constitute one instrument.
O. Effectivity
This Agreement shall take effect upon its execution and shall be in full force and effect until the
completion of GRANTEES enter text degree course until sooner terminated for causes provided
for in this Agreement and CHED Guidelines.
