These are some of the raft of proposals Muslim leaders put forward in their memorandum on the Harmonised Draft
Constitution.
The leaders from the National Muslim Leaders Forum (NAMLEF) and Supreme Council of Kenya Muslims (SUPKEM) also
said the constitution should come out clear and illegalize abortion and homosexual relations.
The propositions made in the harmonised draft constitution
regarding the executive have attempted reasonably well to ensure adequate checks and balances of executive authority,
the recommendations stated.
They said this would remove executive authority from one centre of power and make it possible for the sharing of power
between the President, the Prime Minister, the National As-

Prominent Nairobi lawyer Ahmednasir Abdullahi further said

sembly, the Senate, as well as the devolved governments. The Muslim


community welcomes this effort and registers its support for the hybrid
system proposed in the harmonised draft constitution, said the memorandum which was presented to the Committee of Experts chairman
Nzamba Kitonga by leaders led by NAMLEF chairman Abdullahi Abdi
and SUPKEM director general Abdullatif Shaban.
The draft proposal will create safeguard against concentration of executive power in one party or coalition of parties and will avoid the effects of
the winner takes all syndrome, the leaders further said.
To avoid future complications, they proposed that there was a need to
address the conflict which could arise in the event whereby both the
President and Prime Minister could come from the same political party
or coalition of parties.
On the Kadhis courts, the leaders from the two Umbrella Muslim organisations were unequivocal that the Kadhis courts should be retained and
further recommended the creation of the post of Deputy Chief Kadhi.
They further proposed that the Judicial Service Commission which is the
appointing authority for Judicial officers consults with Muslim scholars
during the the Chief Kadhi and other Kadhis.
To ensure that no legal impediments stand in the way of the Kadhis
courts, the proposal suggested that the clause which states that no part
of the former protectorate shall be outside the jurisdiction of the Kadhis
courts be deleted.

EDITORIAL

A right for Muslims to chart their destiny if Kadhis' courts not retained
After the conclusion of the 30-day public debate on the Harmonised Constitution Draft which elapsed yesterday, attention
is now focussed on the Committee of Experts (CoE) who were
given the mandate to provide Kenyans with a new constitution.
But as they sit down to prepare and formulate the final document, going by comments from some Christian churches it is
appearing that the issue of Kadhis' courts may prove to be a
decisive factor in the realisation of the dreams of harboured by
many Kenyans to have a new constitution.
Of recent, sentiments from some Church leaders have been vocal against the courts and they have gone ahead to make their
submissions to the CoE to have them thrown out of the constitution. The argument piu forward is that the
inclusion of the courts will be a contradiction of
the principles of State and religion.
Muslim leaders in their submissions to the
Committee of Experts have already stated
their unequivocal stand that the courts should
be included in the document to safeguard the
rights of the more than ten million Muslims.
It is noteworthy to mention that while the Kadhis' courts have been ingrained in the constitution for the last 46 years, the present hullabaloo was never a factor in many of these
years.
Those who have turned up
against the Kadhis' courts
appear to have an illusionary
view that they are the only
ones who are able to chart
the destiny of Kenya. Muslims too play a significant role
in the affairs of this country
and it should be recognised
that they too have an equal a
stake in the countrys destiny.
The history of the Kadhis'
courts has a historical record
predating other formal judicial systems by hundreds of
years. The courts existed
long before the colonization
of East Africa and were part
of the judicial process of the
City States which straddled
along the East African coastline right from Somalia to present
day Mozambique.
At the end of the 19th century, the Sultan of Zanzibar who administered the Coastal strip agreed to hand over the administration of the area to Britain and this was conditional that the
religious rights of Muslims would be safeguarded through the
Kadhis' courts and other institutions.
During the pre-Independence negotiations, differences arose
with regard to the future of the coastal strip as it was still under
the sovereignty of the Sultan of Zanzibar. Suggestions put forward included autonomy, merger with Zanzibar or annexation
to Kenya. In this discussions, the role of the Kadhis' courts and
other Muslim institutions featured prominently.
The Sultan of Zanzibar together with Britain and the Kenyan
Government came to an agreement agreed that the ten-mile
strip will become part of Kenya ON CONDITION that the rights
of Muslims as well as the Kadhis' courts will be preserved AT
ALL TIMES.
This agreement was honoured by the founding father Jomo Kenyatta who ensured that the Kadhis courts were enacted in the
independence constitution. This agreement was recognised by
the United Nations as a pact between two sovereign states and
embedded under the pacts of international treaty.
In October, Chief Justice Evans Gicheru made it clear that any
attempts to expunge the courts from the constitution will be a

breach of international law.


While the churches are at arms against the inclusion of the Kadhis
courts over what they see as a breach of the separation of State
from religion, they are not telling Kenyans the truth about the same
principles they appear to be advocating for. The current constitution
and even the Harmonised Draft itself is largely based on the British
canon laws which borrows heavily from Judeo-Christianity laws and
traditions. Christian law is the also basis for the practice of family law
in Kenya and even the conduct of state is Christian in nature.
A majority of the calendar holidays observed during the year including
New Years Day, Easter holidays, Christmas, Boxing Day are Christian religious holidays. More to this Saturday and Sunday are days
specifically set aside to allow Christians to have a
hassle free worship period.
While claims are being made that Kenyans
are being taxed to fund the religious courts, it
should be made aware that the more than ten million Kenyan Muslims are also tax payers whose
money also go to support institutions like the Liquor Licensing Courts whose activities are in total
contraventions with their faith.
Some quarters have put forward the notion that
the courts be expunged from the constitution
and moved to the Acts of Parliament. There is
no sincerity in this idea as it is a
cunning attempt to obliterate them
altogether from the laws of this
country. Expunging a law from
the Acts of Parliament requires a
simple majority and in the current
set up, 16 Members of Parliament
can veto a law. With the hostility
being shown by some Christian
leaders, the Kadhis' courts would
hardly survive for a month if they
are enacted as an Act of Parliament.
The clamour for a new constitution has been prevalent for the
last two decades and this push for
reforms was being pushed by bad
governance and impunity. Kadhis'
courts did and were never part of
the reason why Kenyans agitated
for a new constitution.
More so, the Committee of Experts never classified the courts among
the contentious issues in the harmonised draft and saw no reason to
keep them outside the constitution.
In the prevailing hostile political situation, it even becomes more prudent that the Kadhis' courts be entrenched the Constitution to safeguard their existence. Having them in the supreme laws of the land
does not mean that Muslims are being given any preferencial treatment but rather it is their fundamental right.
It is our belief that those opposed to the courts are driven by hatred
of Islam and as well as an agenda to derail the constitution review
process.
Perhaps they need to understand that if they suceed in derailing the
process and shooting down the draft constitution, we will go back to
the present constitution which has safeguards for the Kadhis' courts.
We rest our case by saying that Committee of Experts should not allow to be swayed in anyway to interfere with the place of the Kadhis
courts as this will be a gross infringement on the rights of Muslims.
Any attempt to remove the Kadhis' courts would be interpreted to
mean that Kenya has reneged on its international obligation pertaining to the 10-mile coastal strip and has ceded its authority over the
area. This will be a clear indication that Muslims from the Coast province and by extension North Eastern Province will have a choice to
determine their destiny and this include being out of the fold of the
Republic of Kenya-where their fundamental rights to freedom of worship will be respected.

The Significance of the Month of Muharram

uharram is the month with which the


Muslims begin their lunar Hijr Calendar. It is one of the four sanctified months
about which the Holy Qurn says: "The
number of the months according to Allah is
twelve months (mentioned) in the Book of Allh on the day in which He created heavens
and the earth. Among these (twelve months)
there are four sanctified." Amongst these
four months is the month of Muharram.
The month of Muharram has certain other
characteristics peculiar to it which are specified below.
Fasting during the Month
The Holy Prophet Sallallhu alayhi wasallam has said: The best fasts after the fast
of Ramadan are those of the month Muharram.
Although the fasts of the month of Muharram are not obligatory, yet, the one who
fasts out of his own will and choice is entitled to a great reward by Allah Almighty. The
Hadthcited above signifies that the fasts of
the month of Muharram are most rewarding
ones among the Nafl fasts.
The Day of Ashurah
Although the month of Muharram is a sanctified month as a whole, yet, the 10th day of
Muharram is the most sacred among all its
days. The day is named 'Ashurah.'
According to the Holy companion Ibn Abbs
Radiallhu anhu the Holy Prophet Sallallhu
alayhi wasallam, when migrated to Madinah,
found that the Jews of Madinah used to fast
on the 10th day of Muharram. They said that
it was the day on which the Holy Prophet
Msa Alayhis salm (Moses) and his followers crossed the Red Sea miraculously and
the Pharaoh was drowned. On hearing this,
the Holy Prophet Sallallhu alayhi wasallam
said, We are more closely related to Msa
than you and directed the Muslims to fast
the day of 'Ashura. (Ab Dawd)
It is also reported in a number of traditions
that in the beginning, fasting on the day
of'Ashura was obligatory for the Muslims.
It was later that the fasts of Ramadan were
made obligatory and the fast on the day of
'Ashura was made optional.
ayyidah Aisha Radhiallhu anha has
said: When the Holy Prophet Sallallhu alayhi wasallam came to Madinah, he
fasted on the day of Ashura and directed the
people to fast on it. But when the fasts of
Ramadn were made obligatory, the obligation of fasting was confined to Ramadn and
the obligatory nature of the fast of 'Ashura
was abandoned. One can fast on this day
if he so wishes, or can avoid fasting, if he
so wills.
However, the Holy Prophet Sallallhu alayhi
wasallam used to fast on the day of 'Ashuraeven after the fasting in Ramadan was
made obligatory. Abdullh Ibn Masud Radiallhu anhu reports that the Holy Prophet
Sallallhu alayhi wasallam preferred the
fast of'Ashura to the fast of other days and

preferred the fast of Ramadn to the fast


of'Ashura. (Bukhar and Muslim)
According to another hadth, it is more advisable that the fast of Ashura should either
be prefixed or suffixed by another fast. It
means that one should fast two days: the
9th and 10th of Muharram or the 10th and
11th day of sthe month. The reason of this
additional fast as mentioned by the Holy
Prophet Sallallhu alayhi wasallam is that
the Jews used to fast on the day of 'Ashura alone, and the Holy Prophet Sallallhu
alayhi wasallam, wanted to distinguish the
Islamic way of fasting from that of Jews.
Therefore, he advised the Muslims to add
another fast to that of Ashura.
hat is mentioned above is all that is
supported through authentic sources
about Ashura. However, there are some
legends and misconceptions with regard to
Ashura that have managed to find their way
into the minds of the ignorant, but have no
support of authentic Islamic sources, some
very common of them are these:
This is the day in which Adam Alayhis
salm was created.
This is the day in which IbrahimAlayhis
salm was born.
This is the day in which Allh accepted
the repentance of Sayyidina Adam Alayhis
salm.
This is the day on which the Qiymah
[Doomsday] will take place.
Whoever takes bath in the day of Ashura
will never get ill.
All these and other similar whims and fancies are totally baseless and the traditions
referred to in this respect are not worthy of
any credit.
Some people take it as Sunnah to prepare a
particular type of meal in the, day of'Ashura.
This practice, too, has no basis in the authentic Islamic sources.
Some other people attribute the sanctity
of 'Ashura to the martyrdom of Sayyidina
Hussain Radiallhu anhu. No doubt, the
martyrdom of Sayyidina Hussain Radiallhu
anhuis one of the most tragic episodes of
our history. Yet, the sanctity of Ashura cannot be ascribed to this event for the simple
reason that the sanctity of 'Ashura was established during the days of the Holy Prophet Sallallhu alayhi wasallam much earlier
than the birth of Sayyidina Hussain Radhiallhu anhu.
On the contrary, it is one of the merits of
Sayyidina Hussain that his martyrdom took
place on the day of Ashura.
Another misconception about the month
of Muharram is that it is an evil or unlucky
month, for Sayyidina Hussain was killed in it.
It is for this misconception that people avoid
holding marriage ceremonies in the month
of Muharram. This is again a baseless, concept which is contrary to the teachings of
the Holy Qurn and the Sunnah. Such superstitions have been totally negated by the

Holy Prophet Sallallhu alayhi wasallam. If


the death of an eminent person in a particular day renders that day unlucky for all times
to come, one can hardly find a day, free
from this bad luck, out of 365 days of the
whole year, because each and every day
has a history of the demise of some eminent
person. The Holy Qurn and the Sunnah of
the Holy Prophet Sallallhu alayhi wasallam
have made us free from such superstitious
beliefs, and they should deserve no attention.
Another wrong practice related to this month
is to hold the lamentation and mourning
ceremonies in the memory of martyrdom
of Sayyidina Hussain Radhiallhu anhu.
As mentioned earlier, the event of Karbala
is one of the most tragic events of our history but the Holy Prophet Sallallhu alayhi
wasallam has forbidden holding of mourning
ceremonies. The people of Jahiliyyah [Ignorance] used to mourn over their deceased
relatives or friends through loud lamentations, by, tearing their clothes and by
beating their cheeks and chests. The Holy
Prophet Sallallhu alayhi wasallam stopped
the, Muslims from doing all this and directed
them to observe patience. A number ofauthentic: ahdith are available on the subject.
To quote only one of them: He is not from
our group who slaps his cheeks, tears his
clothes and cries in the manner of the people of Jahiliyyah.
All the authentic jurists are, unanimous, on
the point that the mourning of this type is
absolutely impermissible. Even Sayyidina
Hussain Radhiallhu anhu shortly before
his demise had advised his beloved sister
Sayyidatina Zainab Radhiallhu anha not
to mourn over his death in this manner. He
said: "My dear sister, I swear upon you that
you, in case I die, shall not tear your clothes,
nor scratch your face; nor curse anyone for
me or pray for your death.
It is evident from this advice of Sayyidina
Hussain Radiallhu anhu that this type of
mourning is condemned even by the blessed person for the memory of whom these
mourning ceremonies are held. Every Muslim should avoid this practice and abide by
the teachings of the Holy Prophet Sallallhu
alayhi wasallam and his beloved grand child
Sayyidina Hussain Radhiallhu anhu.

Respect For Our Daughters

A person's need to feel import is something perfectly natural, something instilled in human nature. It may well be that this feeling is
behind many of humanity's greatest inventions, achievements, and
noble acts. This is why Allah mentions to us that Abraham (peace
be upon him) said: And ordain for me a goodly mention among
posterity. [ Srah al-Shu`ar' : 84]
Prophet Muhammad (peace be upon him) said: If a son of Adam
dies, his good works come to an end except for three: charity that
keeps providing benefit, knowledge that people still benefit from,
and a pious child who supplicates for him.
This is an indication that people like to feel that they are important,
and feel that they will be valued and that their works will endure
even after they die. This is why the Prophet (peace be upon him)
guided us to continuous charity, enduring beneficial knowledge,
and a pious son or daughter who prays on our behalf.
Those who belittle and deride others, and who defame their characters, do not profit themselves anything but pain and bitterness. It
makes no difference whether they are officials, educators, parents,
or anyone else.
Our society is in need of programs to teach people this basic truth.
All too many people have inherited from their cultures and this is
a fact for many societies throughout the world of which some are
Islamic societies contempt for women, looking upon the woman
her as if she is a creation of a lesser degree, a second class citizen and in some cases it seems that they treat her more as if the
phrase tenth class would be more appropriate.
Up to today, some of us are prisoners to this base mindset, as if
they had never heard the guidance of the Prophet (peace be upon
him) or benefited from the revelation sent down to us by Allah. Such
people are still toiling under the legacy of the pre-Islamic times of
ignorance, in spite of the fact that in our present age, many banners
are being raised, like those of human rights, women's rights, social
justice, and equality. It is so bad that some of us look upon these
terms and concepts with bewilderment and suspicion.
This is in spite of the fact that the guarantee of human rights that is
at the core of our faith is loftier and nobler than anything set down
in any declaration of human rights anywhere in the world. This is as
true today as it has been in the past.
The problem here with respect to the issue of women and to that
of the young woman in particular is the result of the coming together with the ideas of the new ignorance with those of the days
of ignorance of old.
First of all, people come with all sorts of biases against women, like
the notion that women are inherently treacherous. Then you have
the fact that in some cultures, the birth of a daughter is received
with ignominy and considered a bad omen.
Thirdly, women are still viewed in some circles as not being entitled
to have their own opinions or to make their own decisions. There is
a saying: Consult with them but do not heed what they say. Some
people might even have gotten the notion in their heads that this
blatant lie is a saying of our Prophet (peace be upon him)! Then
there is the idea that a woman's place is in the kitchen. Here we
have another dubious saying: Were a woman to reach Mars, she
would still wind up in the kitchen.
These concepts, though prevalent, are from the pagan Arab culture
of the times of ignorance. These notions are alien to Islam. They are
not from the teachings of our Prophet (peace be upon him). Allah
says: So their Lord accepted their prayer: That I will not waste the
work of a worker among you, whether male or female, the one of
you being from the other. [ Srah l `Imrn : 195]
Allah also says: Lo! men who surrender unto Allah, and women
who surrender, and men who believe and women who believe, and
men who obey and women who obey, and men who speak the truth
and women who speak the truth, and men who persevere (in righteousness) and women who persevere, and men who are humble
and women who are humble, and men who give alms and women
who give alms, and men who fast and women who fast, and men
who guard their modesty and women who guard (their modesty),

and men who remember Allah much and women who remember Allah has prepared for them forgiveness and a vast reward. [ Srah
al-Ahzb : 35]
Many of our daughters feel cheated and resentful on account of the
unequal treatment given to them in comparison with their brothers.
When a girl's brother brings home passing marks from school, everyone gets happy he is congratulated, and rewarded with gifts, even
if his grades were not all that good. When she comes home with her
diploma after having attained the highest academic distinctions, she
is told: That is not importantwhat good is it to you? Things like
this are commonplace.
Because of such things, the climate becomes conducive to the call
of westernization, which is seen by many young women as a source
of salvation from the oppression of the societies in which they live.
I listened to a speech given in Egypt by an activist for women's
liberation. She spoke of such things. Her stance was a reaction to
customs and circumstances that exist in her society which have
nothing to do with Islam, but which were really the legacy of the
former times of ignorance.
A woman, just like a man, needs to have her importance acknowledged, her grievances heard, and her aspirations fulfilled. If these
needs are not met for her with her family and at school, she is going
to find ways to fulfill them elsewhere. The media today is giving her
all sorts of lessons in this area.
Psychology teaches us that, though you are not necessary going
to convince others or change their minds by listening to them, you
are going to endear them to you and make them more sympathetic.
One of the most notable qualities of great and influential people is
their ability to listen to others and to show them proper regard.
The person who speaks to you may feel in his heart that he has
been wronged or that he has been disenfranchised. He may have
a point of view that he is passionate about and that he wishes to
communicate to you. You have to afford him a proper outlet to air his
grievances. If you do not give him a proper hearing, his grievances

Somali Goat Meat
Ingredients
500 gms lbs goat meat
1 large onion
1 teaspoon garlic paste
1 teaspoon ginger paste
1/4 cup fresh cilantro leaves
2 tablespoons ghee or butter
1 tablespoon olive oil

1 green pepper
salt
1/2 teaspoon cumin powder
4 crushed cardamom pods
1/2 teaspoon cinnamon
1/2 lemon
1 banana

Method
Wash and strain goat meat. In large pot boil the goat meat in
water, add about 1 tbs salt for 2 hours or until meat is tender.
Drain meat and save goat stock later for rice if desired. Add
olive oil to skillet once oil is hot add the strained goat meat and
fry 2 minutes.
Add onions and green pepper stir to fry together 3 mins. Dont
let the onions and pepper get mushy they need to stay firm and
still have a vibrant color.
Add cumin, cloves, garlic paste, ginger paste, cinnimon,
cardemom, ghee, and salt and pepper to taste. stir for 1 minute.
Add cilantro and squeeze juice from lemon for flavor -- not too
much lemon mabey like 1 tbs from the 1/2 lemon. Stir.
Serve and enjoy with yellow spiced somali rice and fresh banana..

Zina: The Easy Option?

And do not come near to the unlawful sexual intercourse. (AlIsraa' 17:32) The Messenger Muhammad salallahu alayhi wa
sallam said, "When a man commits fornication, faith departs
from him and there is something like a canvas roof over his
head; and when he quits that action, faith returns to him" (Abu
Dawud).
Undoubtedly, all Muslims are aware of the prohibition of adultery and fornication. However, many of us live in non-Muslim society where this crime has become widespread and commonly
accepted. This crime has even crept into some Muslim homes
to the extent that we find some who are proud to see their son
entering the house with a girl accompanying him.
In today's English, unlawful sexual intercourse by a married
person is called adultery; sexual intercourse by an unmarried
person is called fornication. Unlike English, Arabic has only one
word for both cases zina. Throughout the history of religions,
zina always has been prohibited; however, its prohibition is
more emphatic and forceful in Islam. Zina is regarded as one of
the gravest of all the major sins. Over fourteen hundred years
ago, Prophet Muhammad (peace and blessings be upon him)
prophesied that among the signs of the Day of Judgment is the
prevalence of illegal sexual intercourse. "It is from the conditions of the Last Hour that knowledge would be taken away and
ignorance would prevail (upon the world), liquor would be drunk,
and adultery would become rampant" (Muslim).
Prophet Muhammad salallahu alayhi wa sallam viewed zina as
a serious crime. It is reported that Allah's Messenger ordered
that an unmarried man who committed illegal sexual intercourse
be scourged one hundred lashes and sent into exile for one
year (Al-Bukhari).
A person has committed zina if he or she voluntarily and deliberately performs sexual intercourse with other than his or her
spouse. When a boy promises a girl marriage and she believes
him without any further adieu, without involving her family, she
is giving away her honor for the desire to be with that boy. When
the wife or husband get involved in an extra-marital affair for
whatever reason, they are reducing their level of commitment,
their adulthood, their families to emotional instability and the
rights of the animal which have less choice than that of humans.
One might think that the only way a person guilty of zina can
be forgiven is by undergoing the prescribed punishment (hadd),
but scholars have said that a person who commits a sin should
repent to Allah Almighty. The repentance should be sincere, and
the guilty person should perform lots of righteous acts and acts

Furthermore, the person should feel remorse and have no intention of ever committing the sin again. The repentance will
not be accepted if it is done during the throes of death,.There
are many ways that Muslims can protect themselves from zina.
Salah (prayer), both obligatory and supererogatory, is one of the
strongest defenses against zina. Allah Almighty says Surely
prayer keeps (one) away from indecency and evil, and certainly
the remembrance of Allah is the greatest. (Al-`Ankabut 29:45)
Regular fasting is another way of suppressing sexual desires,
as Allah's Messenger prescribed it for young people who could
not afford to get married. Another way to keep away from zina
is by reminding yourself how you would abhor and dislike it for
your mother, daughter, sister, brother, and aunt. This was how
Prophet Muhammad explained it to a man who came seeking
permission to commit zina. The Prophet told him to remember
that Satan watches and waits for you to be distant from your
Muslim brethren, then he makes his attack. And so among the
things that will deter you from zina is to always be in the company of righteous people who will remind you of Allah Almighty.
Remember that saying "no" to someone who invites you to commit zina will secure you a place of shelter under the shade of
Allah's throne on the day when their will be no shelter except
His.
We ask Allah Most High to protect us from the evil of zina, to accept out righteous actions, and to shower us with His bounties
in this life and in the hereafter.

Ahmadiyya Movement against Islam


As for those who divide their religion and break up into sects, you take no part in them in the least: their affair is with Allah: He
will in the end tell them the truth of all that they did. The Holy Quran, Al-Anaam, 6:159
The "Ahmadiyya Movement in Islam" (or "Qadianism") was established, in 1889, by Mirza Ghulam Qadiani (1835 - 1908) in a
small Punjabi village of India. Mirza Ghulam openly declared his
allegiance to the British imperialism. In fact, the culmination of his
service to foreign power was his declaration that resistance to oppressors Jihad -- as ordained in the Holy Quran by Allah -- had
become unIslamic.
Mirza Ghulam Qadianis life was laden with contradictory and antiIslamic claims. In 1880, he declared himself a Muslim revivalist
(Mujaddid); in 1891, he claimed to be the Promised Mahdi and the
Promised Messiah and in 1901 he pronounced himself a prophet
of God.
Facing an open and strong opposition by Muslim Scholars and religious leaders for this blasphemous declaration and other teachings which belittled Jesus Christ peace be upon him and contradicted the Quranic revelations, he also announced that he was the
second and improved coming of the Prophet Muhammad salallahu
alayhi wa sallam with authority to reinterpret the Holy Quran at his
pleasure.
Not happy with mere prophethood, in 1904, he declared himself
the Krishna (the Hindu Lord). Obviously, like an unethical modernday politician, he was trying to appeal to all uneducated segments
of the public in India.
Fortunately, the Almighty Allah, time and time again, exposed Mirza Ghulam Qadiani's falsehood through his own statements and
so-called prophecies. Even many of his own family members were
aware of his treachery and openly opposed his anti-Islamic teachings.
Since the death of Mirza Ghulam Qadiani, his heirs -- the leaders
of the Ahmadiyya have been extremely busy trying to clean up his
image. Backed by seemingly unlimited support they receive from
their anti-Muslim allies, they have been promoting falsehood and
deception through the media.

The goal of the "Ahmadiyya Mission" is, and has always been, to
confuse uninformed Muslims, divide the Ummah, prevent resistance
to oppressors (Jihad), and provide an alternative to non-Muslims
who find the message of Islam appealing. Quite cunningly, they
do so by using Islamic terminology and teachings, and hiding the
controversial writings of their founders. Even when their leaders
mention the Kalima (I bear witness there is only one God and Muhammad is his messenger), they are referring to their founder who
proclaimed himself to be (God forbid) the so-called second coming
of the prophet Muhammad and not the true Prophetof Allah.
Muslim brethren everywhere should not be confused by Ahmadiyya leadership's superficial use of Islamic concepts to promote their
cult.
In 1974, after an exhaustive examination of all the evidence presented for and against the Ahmadiyyas, the Muslim World League (Rabita Alami Islami) -- which represents all religious scholars from every
Muslim country of the world -- passed an unanimous resolution declaring the Ahmadiyya or Qadiani Movement and its leadership are
out of the fold of Islam. Indeed, "Ahmadiyya Movement in Islam" is a
man-made organization with no divine authority or guidance.
May Allah expose the falsehood of the Ahmadiyyah leadership and
show its unfortunate followers the path to the perfected and completed religion of Allah: Al-Islam.

Listening to others effectively demands mastery of a number of
skills, which we can enumerate as follows:
The first of these skills is to be able to summarize the ideas that
were brought up in the course of the conversation. After hearing
what the other party had to say and speaking your own mind, you
are able to summarize the matter, accurately stating the other person's point of view and discussing its implications as well as your
arguments. This shows the other person that you hold what he
says to be important and that you properly understood what he had
to say. In this way, you assure him, that you are not putting words
into his mouth or misunderstanding his ideas. He knows that you
were paying attention to him.
Too often, we do not give others the chance to speak. When they
do speak, we are either incapable of understanding their point of
view or of convincing them that we have indeed understood them.
The second skill that we need to master is to be able to enter
into the world-view of those to whom we listen and with whom we
speak. When we listen to two people having a discussion, we can
tell whether their relationship is strained or whether there is friendship and cordiality between them. A mother is able to establish
a good relationship with her daughter by placing herself on her
daughter's level and by expressing herself with heart and with her
body language so that the daughter feels safe and trusting. The
mother is able to respond to her daughter's feelings, sensitivities,
and appreciate her circumstances. In this way, it is possible for the
daughter to become confident and overcome her shyness so that
she can speak openly and frankly and divulge her concerns. This,

however, will only be if she sees that what she has to say is taken
seriously.
Many people do not seek a solution to their problems as much as
they are seeking a sympathetic heart that feels their pain and in
which they can find solace.
If we are to place ourselves in the world-view of our daughters, this
means that we must be able to abide in our young girl's spirit, her
heart, her feelings, and her sensitivities. It means for her to know
that we are with her, not against her.
The third good listening skill that we need to master is to be able to
guide the conversation in the direction that we want it to go. A girl
may not be able to speak openly about everything that concerns her,
or she may not know how to express herself about some things. She
may become confused or say something by mistake. We must not
hold her to her mistake or judge her on account of it. Instead, we
must help her to communicate to us what she is trying to say. We
need to make her feel that the atmosphere is relaxed and normal.
A mother might find it advantageous to talk about her own experiences when she was young and how she went through a lot of the
same things.
The girl might need to speak about something that is troubling her
but not be able to bring herself to say everything. For this reason, a
mother might take the matter too lightly or accuse the girl of not being able to speak, or call her stupid or simple. I have heard girls say
things like: No one ever understands what I say.
She might mean that there is no one in her family who agrees with
what she wants. In this, her family could well be in the right. However, she might also mean that no one pays any serious attention to
what she has to say, and this is a serious problem.

Govt finally owns up to Gitmo detainee
After constant denials, the government has now apparently acknowledged that the Kenyan Guantanamo detainee Abdulmalik
Muhammad is a Kenyan citizen.
This came out after Justice and Constitutional Affairs Minister Mutula Kilonzo called for his release and subsequent return to Kenya
from the notorious Guantanamo Bay concentration camp in Cuba
where he has been detained for more than two years.
Mutula said they was no reason for the continued detention of Abdulmalik saying his rights were being violated.
The minister made the comments last week in Mombasa during celebrations to mark the 61st anniversary of the Universal Declaration
of Human Rights. He took a swipe at the United States which he
said while it was at the forefront in advocating for human rights
principles, at the same time it failed to live to such principles and
continued to keep in custody the likes of Abdulmalik who have been
detained for a long period without legal recourse.
The coordinator of Muslim for Human Rights (MUHURI) Hussein
Khalid said Abdulmaliks rendition was a classic example of how individual rights were sold by the government to foreigners. He called
on the government to prevail on the US administration to return the
37-year-old father of three back to Kenya who was handed over to
US authorities soon after his arrest in Mombasa in February 2007.
The government was buoyed by the arrests when it claimed that
the suspect played a role in the attempt to down an Israeli airline
in Mombasa. His lawyers and human rights groups have however
maintained that his case stems from a coerced confession. Cori
Crider from Reprieve, a London-based human rights group said that
Abdulmalik, while in Kenyan custody, was beaten and threatened
with castration and rape and "was forced to confess to all sorts of
crimes the Americans were looking for at the time."
Last year, a Reprieve investigator Clara Gutteridge said the US had
considered releasing Abdulmalik due to lack of evidence to incriminate him, however, the Kenyan government was reluctant to take
him back claiming the he was not a Kenyan national.
Abdulmaliks family has sued the government demanding for Sh2
billion as compensation for his wrongful detainment and torture.
His family maintains he was held in Kenyan custody without charge
contrary to Kenyan law and was tortured while in detention. The
lawsuit was filed on Nov. 18 and the first hearing on the case case
was postponed until January next year.

about Arabs, Europeans, Kikuyu, Asians or the Akamba buying

Ahmednassir was emphatic that the law did not grant the PS authority to ethnically profile property owners in Nairobi and challenged
the government to come clear on the matter which he said bore

a policy to profile Somali property owners, he said in the paper.

owners of the properties, they were legal avenues which could be
employed which include sourcing data from the last concluded
population census exercise, the lawyer said.
More detailed information which included the property owner, purchase price, stamp duty and location of property information could
also be gathered from the Lands office where the records are meticulously kept, he added.
With ethnic polarisation on the rise, Abdullah advised the PS to desist from the move as it could have negative ramifications. Dont

NEP ID suspension lifted


Following protests from Muslim and community leaders, the government lifted the suspension on the issuance of identity cards to
residents of in North Eastern Province.
The Provincial Commissioner James ole Serian announced the lifting of the ban on Jamhuri day bring to an end a period of anxiety
among residents of the region. The ban was put in place by the PC
late October after claims that the documents were being issued to
foreigners.
The directive to suspend the issuance of IDs ignited the ire of Muslim leaders who have described the move as an abuse of basic
fundamental rights for the area residents. The Supreme Council
of Kenya Muslims (SUPKEM) read mischief in the directive saying
that it was a calculated scheme to disenfranchise Muslim youths
from having their rights to vote and access other privileges.
In a statement issued last week, SUPKEM demanded an immediate
reversal of what it called the illegal order and threatened unspecified measures if the directive was not rescinded. SUPKEM takes
it with great concern that such a move is illegal, discriminative and
borders on abuse of the basic fundamental rights, said the council
secretary general Adan Wachu.
He said the denial was part of a wider scheme where Muslims were
deliberately discriminated against and denied their basic rights in
the country. North Eastern is not the only case study as all Muslims
across the country are either denied identification cards or branded
as foreigner masquerading as Kenyans under false papers.

Terror trial finds five suspects innocent


As it has always been the case for terrorism related cases, five
people suspected of having links with Al-Qaeda were last week released due to lack of evidence.
Kibera Chief Magistrate Uniter Kidulah said the prosecution failed
to prove its case in court that Ahmed Asman, Omar Noor, Mohammed Hussein, Mursal Hassan and Musa Hussein had illegal weapons in their possessions and had links to a terrorist organisation.
The Anti-Terrorist Police Unit claimed that at the time of their arrest
on December 13, 2007 at Eastleigh estate in Nairobi, the five with
others not in court, were found in possession of ammunition of three
grenades without a firearm certificate.
In her ruling, the magistrate among other things said police did not
produce exhibits of the alleged weapons in courts and failed to produce photographs taken at the scene where the alleged weapons
were recovered.

UK issues arrest warrant for former Israel PM


Former Israeli foreign minister Tzipi Livni
cancelled on Monday a scheduled visit to
Britain after an arrest warrant was reportedly issued for war over war crimes committed
in the Gaza Strip.
Livni, the leader of the centrist Kadima party, was scheduled to visit London to address
the JNF conference. Livni was a foreign
minister when Israel launched three-week
deadly war on the Gaza Strip last year, killing more than 1,400 People and wounding
thousands.
The Israeli onslaught also wrecked havoc on
the infrastructure of the densely-populated
Gaza enclave, leaving some 20,000 homes
and thousands other buildings in ruins.
Former UN investigator Richard Goldstone
has accused Israel of committing war crimes
during the Gaza war. During a visit to the US

in January, Livni was condemned by journalists as terrorist and murderer of Palestinian children.
The arrest warrant against Livni has drawn
praise from the Palestinians. It is a major
step by the international community to hold
Israel responsible for breaching international law and violating Palestinian rights,
Ghassan Al-Khatib, director of the Government Media Center, said. It is a sign on the
rising international awareness of the gravity
of Israels war crimes and violations of international laws and human rights.
Last September, Israeli Defense Minister
faced an arrest warrant for war crimes in
Gaza during a visit to London. In October,
Strategic Affairs Minister Moshe Yaalon
was advised to scrap a visit to London for

They also proposed that as a way of dealing with marginalisation and historical injustices experienced in some areas, the regions should be modeled on the delineation
based on recently created sub-regions. For
Northern Kenya and Lamu and Tana River
districts which have suffered a great deal of
historical injustices, exclusion and marginalization over the years-delineation of counties should be based on the current districts
where every constituency is a district in
order for them to reap from the benefits of
devolution.
Due to the difficulties experienced by members of the community in obtaining citizen-

ship and other legal documents, a suggestion was made to include certificates from
Imams alongside baptismal as binding documents for obtaining citizenship papers.
The leaders also made it clear that the constitution should not leave any loophole that
could sanction same sex marriages and
abortion and said the document need to
explicitly outlaw these vices as it was provided for in the Bomas constitution.
The leaders further suggested that due to
current attempts to muzzle the freedom of
worship, it should be made clear that instruments of worship are safeguarded through
legislation. Every person has the right,
either individually or in community with others, in public or in private, to manifest any
religion or belief through worship, observance, including observance of a day of worship, practice or teaching and call for prayer
to the believers of the said faith.

Updating of the database


The One Shilling Foundation was founded on the premise of improving the social
welfare of Muslims through provisions of
support to projects which will go at length
in improving on the lives and economic
status of Muslims.
Through the policy where each Muslim
contributes a minimum of one shilling a
day towards this cause, we hope to realize and achieve the aspirations of many
Muslims in the country by supporting the
education of our less fortunate Muslim
students, supporting education institutions, healthcare and economic projects
plus other ventures which ultimately will
improve on the lives of our community
members.
We continue to see many Muslims from
different areas of the country joining this
initiative and we are in the process of updating the database of those contributing
this programme.
The database is an important element in
our operations as it enables us to keep
the records of the contributors which assist in maintaining transparency and accountability.
For those who are regularly sending their
contributions directly through MPESA
and ZAP, this has been helpful in updating their records. We however, like to call
upon those who are sending their contributions through MPESA or ZAP agents,
