EDITORIAL
A right for Muslims to chart their destiny if Kadhis' courts not retained
After the conclusion of the 30-day public debate on the Harmonised Constitution Draft which elapsed yesterday, attention
is now focussed on the Committee of Experts (CoE) who were
given the mandate to provide Kenyans with a new constitution.
But as they sit down to prepare and formulate the final document, going by comments from some Christian churches it is
appearing that the issue of Kadhis' courts may prove to be a
decisive factor in the realisation of the dreams of harboured by
many Kenyans to have a new constitution.
Of recent, sentiments from some Church leaders have been vocal against the courts and they have gone ahead to make their
submissions to the CoE to have them thrown out of the constitution. The argument piu forward is that the
inclusion of the courts will be a contradiction of
the principles of State and religion.
Muslim leaders in their submissions to the
Committee of Experts have already stated
their unequivocal stand that the courts should
be included in the document to safeguard the
rights of the more than ten million Muslims.
It is noteworthy to mention that while the Kadhis' courts have been ingrained in the constitution for the last 46 years, the present hullabaloo was never a factor in many of these
years.
Those who have turned up
against the Kadhis' courts
appear to have an illusionary
view that they are the only
ones who are able to chart
the destiny of Kenya. Muslims too play a significant role
in the affairs of this country
and it should be recognised
that they too have an equal a
stake in the countrys destiny.
The history of the Kadhis'
courts has a historical record
predating other formal judicial systems by hundreds of
years. The courts existed
long before the colonization
of East Africa and were part
of the judicial process of the
City States which straddled
along the East African coastline right from Somalia to present
day Mozambique.
At the end of the 19th century, the Sultan of Zanzibar who administered the Coastal strip agreed to hand over the administration of the area to Britain and this was conditional that the
religious rights of Muslims would be safeguarded through the
Kadhis' courts and other institutions.
During the pre-Independence negotiations, differences arose
with regard to the future of the coastal strip as it was still under
the sovereignty of the Sultan of Zanzibar. Suggestions put forward included autonomy, merger with Zanzibar or annexation
to Kenya. In this discussions, the role of the Kadhis' courts and
other Muslim institutions featured prominently.
The Sultan of Zanzibar together with Britain and the Kenyan
Government came to an agreement agreed that the ten-mile
strip will become part of Kenya ON CONDITION that the rights
of Muslims as well as the Kadhis' courts will be preserved AT
ALL TIMES.
This agreement was honoured by the founding father Jomo Kenyatta who ensured that the Kadhis courts were enacted in the
independence constitution. This agreement was recognised by
the United Nations as a pact between two sovereign states and
embedded under the pacts of international treaty.
In October, Chief Justice Evans Gicheru made it clear that any
attempts to expunge the courts from the constitution will be a

A person's need to feel import is something perfectly natural, something instilled in human nature. It may well be that this feeling is
behind many of humanity's greatest inventions, achievements, and
noble acts. This is why Allah mentions to us that Abraham (peace
be upon him) said: And ordain for me a goodly mention among
posterity. [ Srah al-Shu`ar' : 84]
Prophet Muhammad (peace be upon him) said: If a son of Adam
dies, his good works come to an end except for three: charity that
keeps providing benefit, knowledge that people still benefit from,
and a pious child who supplicates for him.
This is an indication that people like to feel that they are important,
and feel that they will be valued and that their works will endure
even after they die. This is why the Prophet (peace be upon him)
guided us to continuous charity, enduring beneficial knowledge,
and a pious son or daughter who prays on our behalf.
Those who belittle and deride others, and who defame their characters, do not profit themselves anything but pain and bitterness. It
makes no difference whether they are officials, educators, parents,
or anyone else.
Our society is in need of programs to teach people this basic truth.
All too many people have inherited from their cultures and this is
a fact for many societies throughout the world of which some are
Islamic societies contempt for women, looking upon the woman
her as if she is a creation of a lesser degree, a second class citizen and in some cases it seems that they treat her more as if the
phrase tenth class would be more appropriate.
Up to today, some of us are prisoners to this base mindset, as if
they had never heard the guidance of the Prophet (peace be upon
him) or benefited from the revelation sent down to us by Allah. Such
people are still toiling under the legacy of the pre-Islamic times of
ignorance, in spite of the fact that in our present age, many banners
are being raised, like those of human rights, women's rights, social
justice, and equality. It is so bad that some of us look upon these
terms and concepts with bewilderment and suspicion.
This is in spite of the fact that the guarantee of human rights that is
at the core of our faith is loftier and nobler than anything set down
in any declaration of human rights anywhere in the world. This is as
true today as it has been in the past.
The problem here with respect to the issue of women and to that
of the young woman in particular is the result of the coming together with the ideas of the new ignorance with those of the days
of ignorance of old.
First of all, people come with all sorts of biases against women, like
the notion that women are inherently treacherous. Then you have
the fact that in some cultures, the birth of a daughter is received
with ignominy and considered a bad omen.
Thirdly, women are still viewed in some circles as not being entitled
to have their own opinions or to make their own decisions. There is
a saying: Consult with them but do not heed what they say. Some
people might even have gotten the notion in their heads that this
blatant lie is a saying of our Prophet (peace be upon him)! Then
there is the idea that a woman's place is in the kitchen. Here we
have another dubious saying: Were a woman to reach Mars, she
would still wind up in the kitchen.
These concepts, though prevalent, are from the pagan Arab culture
of the times of ignorance. These notions are alien to Islam. They are
not from the teachings of our Prophet (peace be upon him). Allah
says: So their Lord accepted their prayer: That I will not waste the
work of a worker among you, whether male or female, the one of
you being from the other. [ Srah l `Imrn : 195]
Allah also says: Lo! men who surrender unto Allah, and women
who surrender, and men who believe and women who believe, and
men who obey and women who obey, and men who speak the truth
and women who speak the truth, and men who persevere (in righteousness) and women who persevere, and men who are humble
and women who are humble, and men who give alms and women
who give alms, and men who fast and women who fast, and men
who guard their modesty and women who guard (their modesty),
and men who remember Allah much and women who remember Allah has prepared for them forgiveness and a vast reward. [ Srah
al-Ahzb : 35]
Many of our daughters feel cheated and resentful on account of the
unequal treatment given to them in comparison with their brothers.
When a girl's brother brings home passing marks from school, everyone gets happy he is congratulated, and rewarded with gifts, even
if his grades were not all that good. When she comes home with her
diploma after having attained the highest academic distinctions, she
is told: That is not importantwhat good is it to you? Things like
this are commonplace.
Because of such things, the climate becomes conducive to the call
of westernization, which is seen by many young women as a source
of salvation from the oppression of the societies in which they live.
I listened to a speech given in Egypt by an activist for women's
liberation. She spoke of such things. Her stance was a reaction to
customs and circumstances that exist in her society which have
nothing to do with Islam, but which were really the legacy of the
former times of ignorance.
A woman, just like a man, needs to have her importance acknowledged, her grievances heard, and her aspirations fulfilled. If these
needs are not met for her with her family and at school, she is going
to find ways to fulfill them elsewhere. The media today is giving her
all sorts of lessons in this area.
Psychology teaches us that, though you are not necessary going
to convince others or change their minds by listening to them, you
are going to endear them to you and make them more sympathetic.
One of the most notable qualities of great and influential people is
their ability to listen to others and to show them proper regard.
The person who speaks to you may feel in his heart that he has
been wronged or that he has been disenfranchised. He may have
a point of view that he is passionate about and that he wishes to
communicate to you. You have to afford him a proper outlet to air his
grievances. If you do not give him a proper hearing, his grievances

1 green pepper
salt
1/2 teaspoon cumin powder
4 crushed cardamom pods
1/2 teaspoon cinnamon

Method
Wash and strain goat meat. In large pot boil the goat meat in
water, add about 1 tbs salt for 2 hours or until meat is tender.
Drain meat and save goat stock later for rice if desired. Add
olive oil to skillet once oil is hot add the strained goat meat and
fry 2 minutes.
Add onions and green pepper stir to fry together 3 mins. Dont
let the onions and pepper get mushy they need to stay firm and
still have a vibrant color.
Add cumin, cloves, garlic paste, ginger paste, cinnimon,
cardemom, ghee, and salt and pepper to taste. stir for 1 minute.
Add cilantro and squeeze juice from lemon for flavor -- not too
much lemon mabey like 1 tbs from the 1/2 lemon. Stir.
Serve and enjoy with yellow spiced somali rice and fresh banana..

And do not come near to the unlawful sexual intercourse. (AlIsraa' 17:32) The Messenger Muhammad salallahu alayhi wa
sallam said, "When a man commits fornication, faith departs
from him and there is something like a canvas roof over his
head; and when he quits that action, faith returns to him" (Abu
Dawud).
Undoubtedly, all Muslims are aware of the prohibition of adultery and fornication. However, many of us live in non-Muslim society where this crime has become widespread and commonly
accepted. This crime has even crept into some Muslim homes
to the extent that we find some who are proud to see their son
entering the house with a girl accompanying him.
In today's English, unlawful sexual intercourse by a married
person is called adultery; sexual intercourse by an unmarried
person is called fornication. Unlike English, Arabic has only one
word for both cases zina. Throughout the history of religions,
zina always has been prohibited; however, its prohibition is
more emphatic and forceful in Islam. Zina is regarded as one of
the gravest of all the major sins. Over fourteen hundred years
ago, Prophet Muhammad (peace and blessings be upon him)
prophesied that among the signs of the Day of Judgment is the
prevalence of illegal sexual intercourse. "It is from the conditions of the Last Hour that knowledge would be taken away and
ignorance would prevail (upon the world), liquor would be drunk,
and adultery would become rampant" (Muslim).
Prophet Muhammad salallahu alayhi wa sallam viewed zina as
a serious crime. It is reported that Allah's Messenger ordered
that an unmarried man who committed illegal sexual intercourse
be scourged one hundred lashes and sent into exile for one
year (Al-Bukhari).
A person has committed zina if he or she voluntarily and deliberately performs sexual intercourse with other than his or her
spouse. When a boy promises a girl marriage and she believes
him without any further adieu, without involving her family, she
is giving away her honor for the desire to be with that boy. When
the wife or husband get involved in an extra-marital affair for
whatever reason, they are reducing their level of commitment,
their adulthood, their families to emotional instability and the
rights of the animal which have less choice than that of humans.
One might think that the only way a person guilty of zina can
be forgiven is by undergoing the prescribed punishment (hadd),
but scholars have said that a person who commits a sin should
repent to Allah Almighty. The repentance should be sincere, and
the guilty person should perform lots of righteous acts and acts
of worship.
Furthermore, the person should feel remorse and have no intention of ever committing the sin again. The repentance will
not be accepted if it is done during the throes of death,.There
are many ways that Muslims can protect themselves from zina.
Salah (prayer), both obligatory and supererogatory, is one of the
strongest defenses against zina. Allah Almighty says Surely
prayer keeps (one) away from indecency and evil, and certainly
the remembrance of Allah is the greatest. (Al-`Ankabut 29:45)
Regular fasting is another way of suppressing sexual desires,
as Allah's Messenger prescribed it for young people who could
not afford to get married. Another way to keep away from zina
is by reminding yourself how you would abhor and dislike it for
your mother, daughter, sister, brother, and aunt. This was how
Prophet Muhammad explained it to a man who came seeking
permission to commit zina. The Prophet told him to remember
that Satan watches and waits for you to be distant from your
Muslim brethren, then he makes his attack. And so among the
things that will deter you from zina is to always be in the company of righteous people who will remind you of Allah Almighty.
Remember that saying "no" to someone who invites you to commit zina will secure you a place of shelter under the shade of
Allah's throne on the day when their will be no shelter except
His.
We ask Allah Most High to protect us from the evil of zina, to accept out righteous actions, and to shower us with His bounties
in this life and in the hereafter.

Feature
The goal of the "Ahmadiyya Mission" is, and has always been, to
confuse uninformed Muslims, divide the Ummah, prevent resistance
to oppressors (Jihad), and provide an alternative to non-Muslims
who find the message of Islam appealing. Quite cunningly, they
do so by using Islamic terminology and teachings, and hiding the
controversial writings of their founders. Even when their leaders
mention the Kalima (I bear witness there is only one God and Muhammad is his messenger), they are referring to their founder who
proclaimed himself to be (God forbid) the so-called second coming
of the prophet Muhammad and not the true Prophetof Allah.
Muslim brethren everywhere should not be confused by Ahmadiyya leadership's superficial use of Islamic concepts to promote their
cult.
In 1974, after an exhaustive examination of all the evidence presented for and against the Ahmadiyyas, the Muslim World League (Rabita Alami Islami) -- which represents all religious scholars from every
Muslim country of the world -- passed an unanimous resolution declaring the Ahmadiyya or Qadiani Movement and its leadership are
out of the fold of Islam. Indeed, "Ahmadiyya Movement in Islam" is a
man-made organization with no divine authority or guidance.
May Allah expose the falsehood of the Ahmadiyyah leadership and
show its unfortunate followers the path to the perfected and completed religion of Allah: Al-Islam.
however, will only be if she sees that what she has to say is taken
seriously.
Many people do not seek a solution to their problems as much as
they are seeking a sympathetic heart that feels their pain and in
which they can find solace.
If we are to place ourselves in the world-view of our daughters, this
means that we must be able to abide in our young girl's spirit, her
heart, her feelings, and her sensitivities. It means for her to know
that we are with her, not against her.
The third good listening skill that we need to master is to be able to
guide the conversation in the direction that we want it to go. A girl
may not be able to speak openly about everything that concerns her,
or she may not know how to express herself about some things. She
may become confused or say something by mistake. We must not
hold her to her mistake or judge her on account of it. Instead, we
must help her to communicate to us what she is trying to say. We
need to make her feel that the atmosphere is relaxed and normal.
A mother might find it advantageous to talk about her own experiences when she was young and how she went through a lot of the
same things.
The girl might need to speak about something that is troubling her
but not be able to bring herself to say everything. For this reason, a
mother might take the matter too lightly or accuse the girl of not being able to speak, or call her stupid or simple. I have heard girls say
things like: No one ever understands what I say.
She might mean that there is no one in her family who agrees with
what she wants. In this, her family could well be in the right. However, she might also mean that no one pays any serious attention to
what she has to say, and this is a serious problem.

Govt finally owns up to Gitmo detainee
After constant denials, the government has now apparently acknowledged that the Kenyan Guantanamo detainee Abdulmalik
Muhammad is a Kenyan citizen.
This came out after Justice and Constitutional Affairs Minister Mutula Kilonzo called for his release and subsequent return to Kenya
from the notorious Guantanamo Bay concentration camp in Cuba
where he has been detained for more than two years.
Mutula said they was no reason for the continued detention of Abdulmalik saying his rights were being violated.
The minister made the comments last week in Mombasa during celebrations to mark the 61st anniversary of the Universal Declaration
of Human Rights. He took a swipe at the United States which he
said while it was at the forefront in advocating for human rights
principles, at the same time it failed to live to such principles and
continued to keep in custody the likes of Abdulmalik who have been
detained for a long period without legal recourse.
The coordinator of Muslim for Human Rights (MUHURI) Hussein
Khalid said Abdulmaliks rendition was a classic example of how individual rights were sold by the government to foreigners. He called
on the government to prevail on the US administration to return the
37-year-old father of three back to Kenya who was handed over to
US authorities soon after his arrest in Mombasa in February 2007.
The government was buoyed by the arrests when it claimed that
the suspect played a role in the attempt to down an Israeli airline
in Mombasa. His lawyers and human rights groups have however
maintained that his case stems from a coerced confession. Cori
Crider from Reprieve, a London-based human rights group said that
Abdulmalik, while in Kenyan custody, was beaten and threatened
with castration and rape and "was forced to confess to all sorts of
crimes the Americans were looking for at the time."
Last year, a Reprieve investigator Clara Gutteridge said the US had
considered releasing Abdulmalik due to lack of evidence to incriminate him, however, the Kenyan government was reluctant to take
him back claiming the he was not a Kenyan national.
Abdulmaliks family has sued the government demanding for Sh2
billion as compensation for his wrongful detainment and torture.
His family maintains he was held in Kenyan custody without charge
contrary to Kenyan law and was tortured while in detention. The
lawsuit was filed on Nov. 18 and the first hearing on the case case
was postponed until January next year.

The leaders also made it clear that the constitution should not leave any loophole that
could sanction same sex marriages and
abortion and said the document need to
explicitly outlaw these vices as it was provided for in the Bomas constitution.
The leaders further suggested that due to
current attempts to muzzle the freedom of
worship, it should be made clear that instruments of worship are safeguarded through
legislation. Every person has the right,
either individually or in community with others, in public or in private, to manifest any
religion or belief through worship, observance, including observance of a day of worship, practice or teaching and call for prayer
to the believers of the said faith.
