BILL NO.

7 DAYWORKS AND CONTINGENCIES



DAYWORKS

The Contractor is required to include the following quantities of labour, materials and plant to be executed as Dayworks for the purpose of ascertaining the cost of works where work cannot otherwise be properly measured and valued.

The total value of this section as priced by the Tenderer shall be deemed Provisional under the terms of this Contract.

The Oaywork sheets shall be numbered and fully describe the Instructions to which they refer and shalf be summarised and submitted to the Engineer for verification, not later than the end ottne week following that in which the work has been executed or earlier if the Engineer so directs. The Contractor shall arrange for signed copies of the daywork sheets to be returned to him by the Engineer. A signed copy of the daywork sheets should then be fully priced out and sent to the Quantity Surveyor within one month of the work being executed.

Except in cases of prior agreement, any decision with regard to payment on a Daywork basis for any variation shall be made by the Engineer

Overheads

The term overheads applicable to labour, materials and plant shall be deemed to include the relevant items from the following:-

Head Office charges

Site supervision and site staff including foreman's time and extra charges made to leading or foreman craftsmen and gangers. Foremen and leading hands are chargeable only when working as tradesmen and shall be brought to account at the rate of the respective tradesmen required for the work.

Overtime and extra payments for night or weekend working where not specifically ordered or subsequently sanctioned in writing by the Engineer to be worked on daywork

TIme lost due to inclement weather.

Bonuses and all other incentive payments.

Apprentices study time.

Employer's contributions to National Insurances including any staff pension funds.

Contributions for annual and public holidays.

Fares and time allowances for travelling.

Subsistence and periodic leave allowance.

Safety and welfare facilities.

Third party and Employer's Liability Insurance.

Sick payor insurances in respect thereof.

Tool and other similar allowances.

Use. repair and sharpening of small tools.

All non-mechanically operated plant, speciaJJy erected scaffolding and staging and trestles, protective clothing. artificial lighting, storage facilities and the like that may be in general use on the site.

All other liabilities and obligations whatsoever.

Labour

The Contractor shall quote the rate he requires for his labourers and craftsmen in the following schedule and extend the rate by the hours stated.

The rate quoted is to be an inclusive rate covering all charges includlnq>

Wages.

Overheads, as previously defined.

Profit.

Materials The Cost of materials used in Oayworks shall be charged at invoice cost. All invoices are to be made available to the Engineer at the time the relevant Oaywork sheets are submitted to him. All cash discounts shall be allowed to the Employer.

Attendant labour on mechanical plant and labour erecting and dismantling other plant shall be paid for as "labour".

Where plant is employed on Daywork the Contractor shall be reimbursed for the use of mechanically operated plant and transport for the time engaged in daywork at the rates contained in the Plant Schedule. These rates include for Contractor establishment charges, overheads and profit. Mechanical Plant not included in the Schedule shall be paid for at rate analogous to the Schedule.

Standing and breakdown time shall be deemed to be included in the rates.

Plant that is working inefficiently due to mechanical defect or deficiency shall be paid at rates pro-rata to the rated capacity of the plant.

Labour involved in servicing and maintenance of plant shall be deemed to be included in the rates for plant
