ARTICLEI TITLEANDDEFINITIONOFTERMS RULE1.TITLE This Resolution shall be known as "The New Rules and Regulations of the Board of Electrical Engineering." ARTICLEIII DUTIESANDRESPONSIBILITIESOFTHEBOARD RULES4.ENFORCEMENTANDEXECUTION

TheBoardintheenforcementandadministrationofRepublicActNo.7920,andintheexecution andperformanceofitspowers,duties,functionsandresponsibilitiessetforththereinshallrelyorseekthe review, approval, supervision, assistance, support and/or advice of the Commission through the latter's offices,divisions,sections,andunits. RULE5.PROMULGATIONOFDECISIONS,RULES,ETC. Topromulgateadecision,resolutionororderinanadministrativecase,orapolicy,ruleand/or regulation,measure,directive,order,circular,orotherresolutionfortheimplementationofRA7920,the Boardshallmeetenbanc andvotepersonally.Bothaquorumandamajorityvoteareprerequisitesforthe validityofanyoftheforegoingactions.Aquorumormajorityvoteshallconsistoftwo(2)membersofthe Board. Any official action of the Board other than a decision, resolution or order issued in an administrativecaseshallbevalid,enforceable,andeffectiveonlyafteritshallhavebeenapprovedbythe CommissionandpublishedintheOfficialGazetteornewspaperofgeneralcirculation.Publicationshallnot be required of a Board's resolution, order, directive or circular whichisinternal,administrativeandnot affectingthepublic,andnorpenalordisciplinaryinnature. RULE6.OFFICIALBUSINESSWITHTHECOMMISSION. Foranydealing,transaction,orbusinesswiththeCommissioner,theChairmanoftheBoardshall be the spokesman, representative or liaison of the Board. He may authorize or designate any of its membersortheSecretaryoftheProfessionalRegulatoryBoards,incaseofhisabsenceorindisposition. RULE7.ASSIGNMENTOFDUTIES. The Chairman shall be responsible for the assignment of duties and responsibilities to the membersandforthesupervisionandmanagementoftheirwork. RULE8.ACTIONONPAPERS,COMMUNICATIONSOROTHERDOCUMENTS. All papers, communications, certificates, decisions or other documents shall be solely and exclusivelyacteduponbytheBoardwithinthepremisesoftheCommission. Appropriatesanctionshallbe imposedbytheCommissionforviolationofthisrule. RULE 9. OPINION ON AND INTERPRETATION OF R.A.7920ANDTHEBOARD'SRULESAND REGULATIONS. TheBoardinthedischargeofitsquasilegislative(rulemaking)powermay issueanopinionon, construction,orinterpretationof,anyprovisionofR.A.7920,oftheBoard'sRulesandRegulations,Code of Ethics, policies, issuances, etc. The issuance of the herein Board's official action shall be released through the Chairman, or a Board Member, or the Secretary of the Professional Regulatory Boards as signatoryifauthorizedbytheChairman. RULE10.ACTIONONCOMMUNICATION. QueriesorcommunicationswhichdonotrequirecollectiveofficialactionorreplybytheBoard, orwhichareministeriallyactionablemaybeansweredandsignedbytheChairmanoraBoardMember,or theSecretaryoftheProfessionalRegulatoryBoardifauthorizedbytheChairman. ARTICLEIV CONDUCTOFEXAMINATION RULE11.PLACESANDDATESOFEXAMINATIONS.

TheregisteredElectricalEngineerandRegisteredMasterElectricianLicensureExaminationsshall be held in the City of Manila and other places twice a year. Upon recommendation by the Board, the places/venues and dates of examinations for the year shall be included in the Schedule of Professional LicensureExaminationsfortheyearissuedbytheCommission. TheBoardshallissueschedulesoftheinterview/oralexaminationofapplicantsforregistrationas ProfessionalElectricalEngineerssubjecttoapprovalbytheCommission. RULE12.PROGRAMOFEXAMINATION. TheBoardshallissueaprogramforeveryscheduledexaminationindicatingthereinthesubjects with their dates, time and percentage weights, the instructions, and the names and signatures of the ChairmanoftheBoardandtheSecretaryoftheProfessionalRegulatoryBoards,notlaterthantwenty(20) dayspriortothefirstdayoftheexamination. RULE13.THEPUBLICATIONOFTHEEXAMINATION. The dates and the venues of the licensure examination shall be published in a newspaper of generalcirculationand/ordisseminatedthroughschools,collegesanduniversitiesofferingthecoursesand throughtheaccreditedandintegratedelectricalengineeringassociationatleastone(1)monthpriortothe firstdayoftheexamination. RULE14. REQUIREMENTSFORREGISTRATIONASPROFESSIONALELECTRICALENGINEER. AnapplicantforRegistrationasProfessionalElectricalEngineer,shallsubmitthefollowingdocuments: 1. PRCApplicationForm(PRCFormNo.101) 2. PermanentRegistrationRecordCard(PRCFormNo.203) 3. ProofofPhilippineCitizenship,e.g.CertificateofNaturalization,voter'saffidavit/IDCard,Philippine Passport/Visa 4. CertificateofLiveBirthand/ormarriagecontract(ifapplicantisamarriedfemale) 5. NBIclearance 6. ValidCertificateofRegistrationandaValidProfessionalLicenseasaRegisteredElectricalEngineer. 7. Certificate of Experience PRC Form No. 104 (Revised August '95) duly accomplished and certified underoath.ThisservicerecordshallbereckonedfromthedatetheapplicanttookoathasanREE(or ASSOEEorASSTEE). 8. TechnicalReport/Thesis/DissertationPaper.Priortowritingthereport,theproposedtitleandoutline shallbesubmittedtotheBoardforapprovalastosubjectmatter,organization,technicalcontentand presentation.Ifdisapproved,theBoardshalladvisetheapplicantcitingthereasonstherefor.Five(5) copiesshallbesubmittedtotheCommission,four(4)ofwhichwillberetainedbytheCommission, and the fifth copy shallbereturnedtotheapplicantafterhiscopyhasbeenstamped"RECEIVED." Thereportshallbeoflegalsizeandbookbound. Thefollowingelementsofthereportshallbeincludedintheordergivenbelow:

Affidavits signed by three licensed professional electrical engineers to the effectthattheexperience recordsubmittedbytheapplicantisfactualandthatthetechnicalpapersubmittedwasactuallyand solelypreparedby theapplicant. The Board may call thevouchingPEEforaninterviewinconnectionwiththeaffidavitexecutedin favoroftheapplicant. 10.Briefdescriptionofthemostsignificantandoutstandingachievement/contributionoftheapplicantin thefieldofelectricalengineering. After these submittals are received by PRC, they will be reviewed by at least two (2) Board Members who will then set schedules for the oral examination or interview. Those who will qualify first for the interview will be interviewed first regardless of what year they were registered as ASSO EE's or ASST EE'sorREE's.Theindividualinterviewwillbenecessaryintheassessmentoftheexperience,competence andthereadinessoftheapplicanttorenderprofessionalelectricalengineeringservice.Theinterviewshall bescheduledasoftenasrequiredthroughouttheyearatthePRCheadofficeinManila. Theapplicantobtainingpassingratingsontheoralexamination/interviewwillqualifyforregistrationas aprofessionalelectricalengineer. The results shall be posted on the PRC Bulletin Board and the examinee shall be furnished with the results. The release of the results may or may not coincide with the release oftheresultsforRegistered ElectricalEngineersandRegisteredMasterElectricians. Anyapplicantwhofailedintheoralexamination/interviewshallnotreapplyuntilafteratleastone(1) yearfromdateofnoticeoffailure.Inthereapplication,Rule14shallbeobserved. RULE15. QUALIFICATIONS OF APPLICANTS FOR REGISTRATION AS PROFESSIONAL ELECTRICAL ENGINEER WHO WHERE REGISTERED AS ASSISTANT/ASSOCIATE ELECTRICALENGINEERUNDERR.A.184. AssistantElectricalEngineerorAssociateElectricalEngineerwithvalidCertificateofRegistrationanda valid Professional License issued under RA 184 and with four (4) years or more of active electrical engineering practice after his registration under the foregoing grade, may apply for registration as a ProfessionalElectrical EngineeronlysubsequenttohisregistrationasRegisteredElectricalEngineerunderSec.42(a),Art.Vof RA7920. RULE16. REQUIREMENTSFOREXAMINATIONASAREGISTEREDELECTRICALENGINEER.

AnapplicantfortheexaminationasRegisteredElectricalEngineershallsubmitthefollowing: 1. PRCApplicationForm(PRCForm101)forexaminationdulyaccomplished 2. PermanentRegistrationRecordCard(PRCFormNo.203) 3. ProofofPhilippineCitizenship,e.g.CertificateofNaturalization,PhilippinePassport/Visa,Voter's affidavit/IDcard 4. CertificateofLiveBirthand/orMarriageContract(ifapplicantisamarriedfemale). 5. Transcript of Records with the nameofthedegree/orcourse,thedateofgraduationandS.O.No. unless exempt therefrom due to accreditation of a course by the CHED or to being a state school/college/universitygraduate RULE17. REQUIREMENTSFOREXAMINATIONASAREGISTEREDMASTERELECTRICIAN. AnapplicantfortheexaminationasRegisteredMasterElectricianshallsubmitthefollowing: 1. PRCApplicationForm(PRCForm101)dulyaccomplished 2. PermanentRegistrationRecordCard(PRCFormNo.203) 3. ProofofPhilippineCitizenship,e.g.CertificateofNaturalization,PhilippinePassport/Visa,Voter's affidavit/IDCard. 4. CertificateofLiveBirthand/orMarriageContract,ifapplicantisamarriedfemale. 5. TranscriptofRecordswithnameofthecourse,dateofgraduationandS.O.(B)No.unlessexempt therefrom due to accreditation of a course by the CHED, TESDA, DECS, or to being state school/college/universitygraduate. 6. Certificate or affidavit on specific record of practice or apprenticeship issued by instructors, trainors/supervisors who are themselves registered electrical practitioners. For this purpose, PRC FormNo.104(RevisedAugust'95)shallbeused. RULE18. REGISTRATIONOFASSOCIATE/ASSISTANTELECTRICALENGINEERANDMASTER ELECTRICIANUNDERR.A.NO.184. Successful examinees in Associate/Assistant Electrical Engineer or Master Electrician licensure examinationswhohavenotyetregisteredforlackofageunderR.A.No.184maynowregisterifheisnow 21/18yearsold,respectively. RULE19. RELEASEOFTHERESULTSOFTHEEXAMINATION. The Board upon approval of the Commission shall release officially the results of the licensure examinations not later than twenty five (25) days from the date of the examination. The names of the successful examinees with the names and grades of topnotchersandthenamesoftopperformerschools shallbeofficiallypublishedinthenewspaperofgeneralcirculation.Examinee'sreportofratingshallbe mailedwithinone(1)monthfromthedateoftherelease. RULE20. REEXAMINATIONOFFAILEDSUBJECTS. 1. ForProfessionalElectricalEngineers:

IftheapplicantwasconditionedinanyofthesubjectsorhascompletelyfailedthePEEexams under RA 184, he may apply for the same PEE grade under RA 7920 without undergoing any written examination provided he complies with the requirements outlined under Rule 14 of the hereinRules. Ifhefailedinthewrittenexaminations,butwasgivenapassingmarkinhisEngineeringReport underRA184,heshallsubmitthetitleofhisreportandthecorrespondingratingobtained.Heshall submit the relevant and essential requirements of Rule 14. He shall also undergo the oral examinationorinterviewconductedbyatleasttwo(2)BoardMembers. The board members shall make final recommendations to the Commission based on the evaluationofthedocumentsreceivedandtheresultsoftheoralexamination/interview. 2. ForRegisteredElectricalEngineersandRegisteredMasterElectricians: If an examinee obtains an average of seventy percent (70%) or above buthasadisqualifying ratingofbelowfiftypercent(50%)inanyofthesubjectclusters,hegetsaconditionalmark.Hecan remove the condition by taking the examination on the same subject cluster again and again if necessary until he shall obtained a rating of seventy percent (70%) or more on the same subject cluster.Thesubjectstobetakenshallbeasdescribedinthecorrespondingsyllabiprescribedbythe Board. ARTICLEV ISSUANCEANDREISSUANCEOFCERTIFICATEOF REGISTRATIONANDPROFESSIONALLICENSE RULE21. REGISTRATION AND ISSUANCE OF CERTIFICATE OF REGISTRATION AND PROFESSIONALLICENSE. Uponcompliancewithallthelegalrequirementsforregistration,aregistrantshallbeallowedtoenrol his/her name and other essential data in the Roster of Professional Electrical Engineers, Registered Electrical Engineers and Registered Master Electricians, and accordingly, shall be issued with the CertificateofRegistrationandProfessionalLicense. RULE22. TAKINGTHEOATHOFPROFESSIONAL. AllapplicantsforregistrationasPEEs,REEsorRMEsshallbeallowedtotaketheiroathsassuchonly aftertheyshallhaveregistered. RULE23. RENEWALOFPROFESSIONALLICENSE. TheProfessionalLicenseshallberenewedeverythree(3)yearsonthebirthmonthofthePEE,REEor RME upon compliance with Continuing Professional Education (CPE) requirement, unless exempted therefrom,anduponpaymentoftheannualregistrationfeesforthree(3)years. RULE24. DELISTING. APEE,REEorRMEwhohasbeendelinquentinthepaymentofhis/herannualregistrationfees forfive (5) consecutive years since his/her last payment shall not be allowed to continue practicing his/her profession after the delisting of his/her name from theRosterofPEEs,REEsorRMEs.Thesaidperiod may be interrupted upon surrender of a Certificate of Registration and/or Professional License to the Commission. RULE25. LIFTINGOFDEFERMENTOFREGISTRATION.

If the disciplinary action imposed under Section 28, Art. II of R.A. 7920 is not the cancellation of examinationpapersand/ordebarmentfromtakingthefutureexamination,therespondentexamineewho has passed the examination may be allowedbytheCommissiontoregisteruponrecommendationofthe Boardafterthelapseofnolessthanone(1)yearfromthedateofthedecision. RULE26. REISSUANCEOFCERTIFICATEOFREGISTRATION. APEE,REEorRMEwhoseCertificateofRegistrationhasbeenrevokedmay,afterthelapseofone(1) year from the surrender thereof, be reissued with such certificate upon approval by the Commission,afterhe/shehasestablishedtotheBoardthathe/sheisstillfittocontinuepracticinghis/her profession. RULE27. REGISTRATIONNUMBERANDEXPIRYDATEOFTHEPROFESSIONALLICENSE. ThePEE,REEorRMEshallindicatehis/herCertificateofRegistrationwiththedateofissuanceandthe expirydateofvalidityofhis/herProfessionalLicenseinthedocumenthe/sheissues,signsandusesinthe practiceofhis/herprofession. ARTICLEVI MISCELLANEOUSPROVISIONS RULE28. ADMINISTRATIVEINVESTIGATION. The conduct and procedures of an investigation initiated by theBoardagainstanexamineeoraPEE, REE or RME shall be governed by the provisions set forth in Article IV,V,andVIoftheCommission pertainingtothe"RulesandRegulationsGoverningtheRegulationandPracticeofProfessionals"and/or any other rules that may be issued by the Commission, Board, or the President of the Republic of the Philippines.TheRevisedRulesofCourtshallbesuppletorytotheforegoingrules. RULE29. GROUNDSFORDISCIPLINARYACTION. The Board shall invoke the hereunder causes in imposing a penalty of: cancellation of examination papers and/or debarment from examination of examinees reprimand or revocation of Certificate of Registration or suspension from the practice of the profession of PEEs,REEs,RMEsorcancellationof SpecialPermitholders: 1. ThegroundssetforthinSections28and29,ArticleIIIofR.A.7920 2. Violation of anyofthehereinRules,anypolicyoradministrativeissuanceissuedbytheBoardor Commission 3. ViolationofanyprovisionofR.A.7920 4. BreachoftheCodeofProfessionalEthicsforProfessionalandRegisteredElectricalEngineersand RegisteredMasterElectricians. RULE30. ENFORCEABILITYOFTHEBOARD'SDECISION. ThedecisionoftheBoardimposingadisciplinaryactionagainsttherespondentinanadministrativecase shallbecomefinalandexecutoryunlessitisappealedbytherespondenttotheCommissionwithinfifteen (15) days from the receipt of the decision. The Board's or Commission's decision is appealable by the respondenttotheCourtofAppealsinaccordancewiththeproceduresprovidedundertheRulesofCourt. RULE31. APPLICABILITY OF THE "RULES AND REGULATIONS GOVERNING THE REGULATIONANDPRACTICEOFPROFESSIONALS".

Intheenforcement,implementation,andadministrationoftheprovisionsofR.A.7920andtheherein "The New Rules and Regulations of the Board of Electrical Engineering", the Rules and Regulations GoverningtheRegulationandPracticeofProfessionalsshallbesuppletorilyapplicablethereto. RULE32. EXAMINATION,REGISTRATION,LICENSEFEESANDFINES. TheAccountingDivision,outoftheten(10%)percentcollectedexaminationfeesfromtheexaminees, shallprovideandkeepaseparatebookofaccountforatrustfundthatwilldefraytheestablishmentand maintenance of the Center for continuing education and research and out of the fifty percent (50%) collectedasregistrationandlicensefees,andfines,shallprovideandkeepaseparatebookofaccountfora specialfundforthesupervisoryandregulatoryfunctionsoftheBoard.

RULE33. SEPARABILITYCLAUSE. If,foranyreason,anysectionorprovisionoftheherein"RulesandRegulations"ortheapplicationof such rules and regulations or provision to any person or circumstance is declared unconstitutional, unlawfulorinvalid,noothersectionorprovisionofthis"RulesandRegulations"shallbeaffectedthereby. RULE34. EFFECTIVITYCLAUSE. Theherein"RulesandRegulations"shallbe,uponapprovalbytheCommission,beeffectiveafterfifteen (15) days following its full publication in the Official Gazette or any newspaper of general circulation, whicheverisearlier.
