The Constitution The founding fathers understood that one day the Constitution may not collaborate with

the time period. Therefore, the fathers stated that it may be changed or amended, and today the citizens have 27 amendments. The Fifth Amendment is most important because, it reduces blackmail and unfair jurisdiction, and reduces repeated trial and keeps fair treatment throughout. Also this keeps eminent domain, or in other words the process the government has to take in order to obtain private property and turn it into public property. In todays terms the Fifth Amendment means that no one is to testify against themselves unless there are witnesses or evidence. A criminal commits a murder and blackmails a person who later testifies that indeed he or she committed that murder. The real criminal then gets away with it because the murderer has been found. This is why no one is able to testify against one self, and there needs to be enough evidence or witnesses to prove that indeed the individual had committed a crime. This prevents criminals from getting away with the crime, and this is why the Fifth Amendment is the most important of all 27 amendments in the Constitution. The Fifth Amendment gives citizens fair treatment during trial, and most important of all no repeated trials, or double jeopardy. An innocent person had walked out of trial, when that same innocent person got arrested for the same reason as before. That person would then have to go through the same pain as in the previous trial, and later come off trial innocent. Again, the same person that got arrested for committing the same crime would then be arrested once more, and the pattern would follow. The fathers understood that if the person who is actually innocent or in some cases even guilty, but keeps on getting arrested on and on, would result in an unfair trial. This is because that person would

then spend half of their life in a courtroom going over the same case, until the judge decides that they are guilty. Due process is also included within the Fifth Amendment. It means that everyone obtains the same treatment from the government, and in trials. No government officials are allowed to discriminate against others in court cases, etc. because it leads to unfair trail. In result, the Fifth Amendment is the most important because of double jeopardy and due process. Eminent domain is the process the government has to take when obtaining private property of an individual and turning it into public property. The government needs to pay the private owner a reasonable amount for the property in order to take it. If the government would be taking anyones property, then it would be violating the natural rights of property. The government needs to treat everyone, including the peoples property equally. Thus, the Fifth Amendment is the most important because it influences eminent domain, which keeps the peoples private property from harm. On the other hand, one may state that the Fifth Amendment is not as important as the First Amendment, because it lists the rights of the people the government cannot violate. If the rights of the people were not to be written in the Constitution the government would most likely violate them. For example, a person wanted to be Jewish but the government did not allow it, and later it arrested the person for it. The rights to religion, press, and assembly in the US are basic rights that the people could practice and do without getting arrested for. Therefore, the First Amendment is the most important amendment in the Constitution. One could disagree that the Fifth Amendment could not be the most important amendment because it does not protect us totally from the government. The Ninth

Amendment gives us protection of all our basic rights not listed within the Constitution. Since the Constitution does not state all of our rights, the Ninth Amendment gives us full authority on the government not violating other rights that were not listed within the Constitution. Therefore, the Ninth Amendment is the most important because it gives us full authority that our rights would be secured even though they were not listed in the Constitution. It is true that people would obtain their rights from the First Amendment, but the Fifth Amendment provides the people with equal treatment in trial, and a fair trial. If a person was to exercise his or her beliefs in the First Amendment to loosely, and then that person would get arrested, the Fifth Amendment would promise them a fair trial. The Fifth Amendment controls whether or not the court cases are constitutionally accurate. In those court cases the First Amendment is being discussed because someone practice them to loosely. Therefore, the Fifth Amendment is the most important amendment. From the Ninth Amendment the founding fathers were afraid that the government would find a way to violate the rights of the people. They added an amendment to protect the future unknown rights of the Americans. This only explains that there are other rights out there, in result the federal government would then have to respect the future unknown rights but only if they like it or not. Like gay marriage, the gays state that the governments ruling against gay marriage is unconstitutional, but the Federal government decides whether or not that right does belong to the Ninth Amendment. The Fifth Amendment states the powers individually and there is no questioning about the amendment. Therefore, the Fifth Amendment is the most important of all the amendments.

The Fifth Amendment to the Constitution is the most important amendment within the constitution, because it reduces blackmail and unfair jurisdiction, repeated trial and keeps fair treatment throughout, and eminent domain. Let the Constitution rule and the Fifth Amendment stay the most important of all amendments in the U.S Constitution.
