WORLDWIDE SALES MARKETING AND DISTRIBUTION

comment
David Balfour wonders whether the latest appeal from artists will bring any pressure to bear on Google

This week a select group of musicians and executives wrote to both to the Telegraph and Prime Minister to highlight and celebrate the vitality of the creative sector in this Olympic month. This was not just a backslapping exercise however, but a call for the government to do more to support the music industry and protect intellectual copyright. The letter ended with a call for the government to implement the long-overdue measures in the Digital Economy Act and also to ensure broadband providers, search engines and online advertisers play their part in protecting consumers and creators from illegal sites. This second sentence was immediately interpreted by many as a veiled attack on Google and its policies on copyright infringement. And wed probably agree this was exactly what was intended. Indeed, with the ISP role in copyright infringement already addressed quite directly in the DEA, the key phrases here were search engines and online advertisers. Sectors of the music industry has made no secret of believing that Google has the British Government in its pocket. Whilst Cameron and co have passionately argued that this is not the case, many are

unconvinced. More importantly however, whatever the position of 10 Downing Street might be, Google remains both one of the greatest enablers of and arguably one of the greatest benefiters from piracy in the UK. It would be foolish to suggest that Google is profiting from piracy as a deliberate corporate policy, but it would be factual to suggest that Google routinely displays vast numbers of links to pirate content, whilst the sites which host that content frequently carry advertising from which Google derives income. Google has often taken an evasive approach to any questions about its role in potentially enabling piracy. It likes to point to its clear takedown procedures, its promotion of legal content and its continuing dialogue with the creative industries. Many feel that its not doing enough however. As a recent Newsnight investigation for the BBC showed, a Google search often places pages of results for pirate content above legitimate content. The company has never been willing to accept this as being problematic, even despite its assertions that it is anti piracy. It always refers to the takedown procedures which, whilst they walk the right line with the law, every one knows are ineffective

at making any real difference. What would make a difference is for Google to influence its search results in favour of legal content and possibly to do more to prevent its own advertising content being carried by sites providing illegal content. None of these arguments are exactly new. So why are Elton John, Simon Cowell, Brian May, Tinie Tempah et al choosing now to highlight the issues? And why might they feel that they can achieve that no previous amount of carefully-considered campaigning or professional lobbying has yet managed? The Olympics certainly provides a hook, an opportunity to celebrate the best of British. Its also clear that politicians and businesses often respond more favourably to appeals direct from stars than they do from industry pressure groups. We feel that theres something odd about this latest appeal however. For one, it doesnt move the arguments or really examine them in the level of depth one might think is required to produce a compelling argument. Furthermore, its an appeal which comes from those who have arguably benefited most from the music industry and therefore provide perhaps the weakest case studies

to claim that the system is not working. The implication that the government is also stalling on implementing the Digital Economy Act is also a strong one. Whilst its certainly taking a long time to implement that Act, isnt that as a result of the rigorous procedures and analysis which needs to be followed as much as an apparent lack of political will? Certainly, if we sought to short-cut the careful implantation of the bill with a quick fix, it would also fatally undermine its credibility. Whilst the detailed ambitions of artists letter remains unclear, it perhaps add more pressure to Google at a time when it seems that the case against its standoffish policies is starting to build. Can Google really continue to play the role of impartial and inactive channel when each fresh analysis seems to leave it with important questions to answer? Perhaps in fact this is the perfect time to call for a little additional political pressure. What remains unclear is whether Google is in awe of the UK government, or vice versa. However, with corporate social responsibility increasingly under the microscope, it doesnt seem ridiculous to expect that Google might soon have to modify its previously-entrenched stance.

ibiza rocks
Breaking the White Isle mould seven years ago, Ibiza Rocks dared to be different and brought guitars and rock stars to the epicentre of the island of 1s and 2s. At its helm are Andy McKay and Dawn Hindle who together have not only built the groundbreaking Rocks brand but are also responsible for the White Isles legendary Manumission nights. With a CV to be proud of, McKay discusses the future of his brand, his breakout into the hotelier industry and the future of clubbing. everyone is going to be adding beds to the properties and because we spearheaded that were really reaping the benefits. Events are about marketing, if you dont have anything behind the event, what are you marketing? I dont see a strong future for a nightclub, I think nightclubs need to have more about them than just ticket sales, thats the change. Weve helped to redefine the market position and most people are playing catch up, we just have to work out how to say ahead. Why did you move into hotels? It was kind of a build it and they will come attitude. We knew that we had to bring these type of people to the island and therefore we needed to create a something much bigger than just an event. The hotel was as bigger a revolution as bringing guitars to the island in the first place was. It was motivated by the fact we needed more people with skinny jeans on the island and they didnt feel very comfortable here, so we built a place for them to feel comfortable. Did you come against any resistance when you put forward the idea of rock music on a famously electronic island? Completely, everyone thought we were crazy and no one thought it would work. We were lucky because if we were anymore ahead of our time then we would have failed, we were there that winter when all of these bands were hitting the playlists so we were just on the cusp of when it became popular, there was a vast amount of luck. There was resistance initially because the word rock was a dirty word in Ibiza back in 2005 and peoples ears were just not tuned to guitar music, whereas now there are guitar rifts being used on nearly every record. Have you seen many copycat events? The surprise to me isnt that people are doing it, its that its taken so long. In 2011, pretty much every club tried to book full live bands and I think people didnt appreciate the cost involved, this year is more based on PA or dance specific urban acts. Theres a more intelligent commercial play for booking acts this year for sure. Youve launched your We Are Rockstars (W.A.R!) weekly night, which seems like a move back to DJs and away from bands, does this signal a shift in scene? Are we leaving behind guitar music? There is a shift in scene. It was primarily about retaining the identity of who we are as Ibiza Rocks but it was also in recognition to the whole bass culture thing we saw. It was a very young youth-driven scene so its very relevant to our agenda. For that reason we still see it as the same genre, only its electronic focused rather than the live band. The thing is, we havent compromised, we have the Maccabees, Kaiser Chiefs, Kasabian and New Order performing I think this years line up is our strongest ever. What levels of return do you see from your artists? Its tiny, this is why I have the hotel, to take a 2million risk for a single digit percentage return is crazy. You have to look at it as a marketing activity. Its profitable marketing. This is why I think you will see a shift in the market soon, a lot of people look to club nights as the business but I cant see how it can be a business for much longer. What are you working on for the future if you see Rocks as a 360 package? Weve just opened a second hotel in Mallorca and signed a third which doubles the size of our hotel there, weve also opened the second bar in Ibiza, the Ibiza Rocks Diner. We took on Pikes in Ibiza last April, it was a change for us in that its aimed outside of our youth brands and more towards 30 -40 year olds but its gone down really well. We are also looking very seriously at a winter program in a snow resort, whether we will open it this winter or not we dont know yet, but that will be the next move.

Hows your seventh Ibiza Rocks season going? Its going surprisingly well. Given the climate you dont want to get too excited about how things might happen so weve been very realistic about expectations, however, everythings up which is amazing. Its not that significant financially because its still early and its all about the peak of the season but, in terms of where we start out trend were much, much more optimistic on where we started two months ago. The opening was a technical sell-out and significantly up on last years, which was a massive event with Plan B. Why do you think sales are up so much? Brands and trust are very important now and we have one of the very few strong youth brands. I think the fact that we are quite 360 in our model with a lot of holiday, hotel and bed sales is in our favour. In the next five years, especially in Ibiza and Mallorca,

the sound of the olympics

How brands use sponsor music, by John Groves. a piece of music that is so linked to another brand? Admittedly, we must make allowance for individual subjectivity, but when I first saw this spot, I was wondering why I found myself thinking about Microsoft? At the beginning of the TV commercial the song is just hinted at with the guitar riff, and I was wondering if perhaps Omegas watches had gone electric and are using the Microsoft operating system? As the song was used for Windows 95, maybe Omega think we have forgotten? Even though it was a mega licensing deal costing reportedly costing $3,000,000, which was a fortune back then. (It is still a fortune now!) Or maybe they consider that people that watch the TV are too young? It is a riddle. By the way, Mick Jagger has announced that the Stones will not be appearing at the Olympics as he doesnt consider them to be ready for such a prominent occasion at this moment in time. Visa Visa has been an Olympic sponsor for 25 years. This year they lead into the Olympics with a European campaign featuring Usain Bolt, the Jamaican sprinter. The music in the commercial is a song called Mile High City by Ocean Colour Scene, which made number four in the charts back in 1997. I only recognise it as the theme music to Lock, Stock and Two Smoking Barrels by Madonnas ex, Guy Ritchie, which makes for an interesting bit of borrowed recognition. Parallel, or overlapping, they have a campaign called Global Cheer which aims to motivate fans to record their cheers online as an encouragement for the athletes. The car brand Mini are also in on the act of encouraging us to record our voices for athletes, but in this case they dont want cheers, but roars. And it is not online; they have turned a number of Minis into recording studios. Cool! Their current campaign features is Take Over the World by the Courteeners, which seems to have someone singing the Coca Cola Sound Logo in the background? It is not clear which is the official Visa music as they both seem to be currently in use. What is interesting is that in their video of Usain Bolt having a kick around, they use neither. Instead they are using reggae tune. He is from Jamaica. Reggae. Get it? (And why do I think of Puma and not Visa when I see Usain?) Even if the public probably wont remember Visa for their music, the chances are pretty high that they will nevertheless be remembered, albeit negatively, for their exclusivity deal, which makes it impossible to use any other card for Olympic transactions that theirs. Samsung Samsung gets full marks for musical relevance by featuring Beethovens Ode to Joy. The socialists and communists have their Internationale and for the rest of us, when all else fails, there is always Ode to Joy. It has a long history in connection with the Olympics and also happens to be the anthem of the European Union. In a recent survey in the UK, 69% would like to have classical elements in an Olympic theme song and the first piece of music that comes to their minds is this one. Unfortunately, I would give the spot zero marks for believability, as it features David Beckham apparently playing the melody by kicking balls at individual drums on the wall. In another Olympic spot featuring David Beckham, they use atmospheric background music in the style of Vangelis. Yes, well had they used Chariots of Fire, I would have understood the Olympic tie-in, but I dont understand the missed chance to acoustically link both Beckham commercials by using Beethoven. What is more, Samsung is one of the few brands that do have a Sound Logo. Millions of televisions over the whole planet use it as a start-up sound. Although they may not use it consistently in all their TV advertising, at least they have it. And it is known. Why they chose to leave it out for something as huge as the Olympics is a mystery. Coca-Cola Although some marketing experts may consider Coca-Cola to be the number one, in a recent German study of the best global brands, 3000 consumers surprisingly placed Coke only at number fifteen. Nevertheless, this megabrand long since understood that by getting a song on the radio and possibly in the charts, they will be creating free advertising. This was the early version of viral communications. They managed to do it a number of times - with Id Like To Teach The World To Sing and First Time by Robin Beck. Then, for the Euro 2012, Coke presented the song Lets Get Crazy by Gogol Bordello, which was offered for downloading via QR codes on the cans. Their Sound Logo was embedded in typical football singing manner. It feels like it is part of the song and not like some stuck-on advertising. Although Coca-Cola is the undisputed king of music use in advertising, it is only recently that they have discovered Sound Branding in a formal sense. Whereas in the past, they were purely campaign based and would change their sound signals accordingly, they now have a common brand sound element running through all the music

There are seven London 2012 Official Olympic Partners and seven London 2012 Official Olympic Supporters. There is also a long list of London 2012 Official Olympic Providers and Suppliers. At the forefront are the eleven Worldwide Olympic Partners, most of which have long-term association with the Olympics and includes Acer, Atos, Coca-Cola, Dow, GE, McDonalds, Omega, Procter & Gamble, Panasonic, Samsung and Visa. In the context of the Olympics, CocaCola has an unprompted recall of more than 25% and it is one of the few brands that can be easily recognised with closed eyes. We will come to Coke in a minute, but lets take a look at how some of the other sponsors are using music this time. Omega Lets kick off with Omega, who are using Start Me Up by the Rolling Stones for their Olympic sound communications. I cant help asking: Why ever would a brand want to use

the sound of the olympics

they use for their brand communications namely, the Coca Cola Sound Logo. It was featured prominently in the song Waving Flag, the official 2010 FIFA World Cup Theme Song in South Africa, performed by a nice young chap called Knaan. This was the first really noticeable use of sound branding in its formal definition. The Sound Logo was inserted as a vocal Wo oh oh oh oh. It is very predominant but, as it was virtually unknown at this time, in blends in perfectly with the song. There was a phase in 2011 when the Sound Logo was used rather discreetly, maybe with good reason: The T-Mobile Sound Logo, which stands beside Intel as possibly the worlds best or best used Sound Logo, had the problem of being much to in-your-face; it was used to often, and, as it is so predominant, it created the opposite effect by getting on peoples nerves. T-Mobile managed to get the curve just in time, and cushioned the pending wear-out effect by using different instrumentations. (This proves how important the design criteria adaptability is when developing Sound Logos and other key brand sound elements.) Coca-Cola chose Mark Ronson to produce the music for their 2012 Olympics campaign Move to the Beat, as he was considered to be an icon in the UK and the best connected man in the music business. The basic idea was to compose a song over a rhythmic loop made up of sounds made by Olympic athletes. Instead of just using stock material, Ronson jetted round the world to personally record the sounds of table tennis, running, archery, hurdles and taekwondo. In November 2011, the basic groove was presented from which the song Anywhere in the World was developed, which he says was inspired by London. The song is the core music element for their campaign. Besides using it in TV commercials it is intended to be used on all mobile and digital platforms and at Coca-Cola events. Although using loops of the sounds of the product itself may not be original, this concept somehow feels right for the Olympics. Not just because he lovingly recorded the sounds himself, it allowed the possibility of showing him actually doing it, by producing a making of. This makes the whole idea more emotional and personal. It also puts the accent on authenticity and quality. Im reminded of the lengths they went to make some of the Star Wars sounds and in the film Saving Private Ryan, where for a large part of the movie, the sound effects were the key storyteller. As to the usage, we must wait and see. From what is available at the time of writing, the two minute version starts of with the Sound Logo, but the 60 second version only quotes it almost subliminally at the end while the trailer doesnt feature it all. Although the concept is good, its questionable if this song will go into the annals of history. Maybe it will grow on me?

The news that the Big Chill festival is effectively over came as no surprise to us. It moved a long way from its roots at Union Chapel on a Sunday. Co-founder Pete Lawrence, said he was never happy about the two London bars that extended the brand name, as there was little affinity with the core values. Last years festival had Chemical Brothers and Kanye West headline to what had become a generic weekend. The irony is Festival Rupublics Latitude caters to a crowd who are seeking a Big Chill vibe. It sounds like another event could take its place, lets hope the festival market can stand an effectively new entrant. Are we missing something, or was the DJ Shadow releasing some tracks via BitTorrent a bit of a nonstory? They made it sound like it was the seed of a new model. Well investigate further. Lots of positive conversations at BMIs summer party last week. It
seems sync is holding up well, especially when the world is your market. No great revalation, but always nice to hear.

Roc For Life K.Koke ft. Wale

Roc Nation/Sony RCA
Released: August 27 The heat on London-based rapper K.Koke is reaching epic proportions in the UK and is now spreading Stateside, leading to a deal with Jay-Zs label Roc Nation. The 27-yearold is the first British rapper to sign to the music moguls label. Roc For Life is the first track available from his debut album I Aint Perfect, which is due for release in January 2013. Featuring US rapper Wale, this is a great introduction to K.Koke. His autobiographical lyrics track his journey from the rough streets of NW London, where he was involved with drugs and acquitted of murder last year, to the dream he is following of becoming a global superstar. K.Koke looks the real deal and with anticipation building on a daily basis, views across his YouTube channel have reached 15 million and are growing daily. Video.

How Do I See? Lovepark

unsigned/Warp/Republic of Music Released: August 13 Label and publishing interest has built to a peak as forthcoming Lovepark single How Do I See? displays the bands excellent sync potential with their left-of-centre sound nestling somewhere amongst Grizzly Bear, Bombay Bicycle Club and Alt-J. Produced by super hot Alt-J producer Charlie Andrew, also known for his work with Chapel Club and as a member of Laurel Collective, the single has picked up strong support from Jen Long who gave them their national radio debut on Radio 1. She also hosted Loveparks London launch party which was packed to the rafters with A&R. Further supporters on radio include Tom Robinson on 6Music and John Kennedy on Xfm both chipping in with spot plays. In the last couple of months theyve been named Best New Band in Brighton paper Argus, picked up some great press including a fresh 405 feature, and made their national TV debut on Channel 4s Great Escape coverage. The forthcoming show at The Lock Tavern is already shaping up to be another packed crowd. This version of How Do I See? has picked up a sync on Misfits and is picking up other sync interest. London Gig: August 16, White on White @ The Lock Tavern NW1

secret garden party

We arrived on Saturday afternoon by which time the mud had turned to treacle, making it hard to move between stages (on Sunday it hardened in the sun). There were no running orders available so we followed the advice of the Head Gardeners and wandered randomly between the numerous stages. So what did we see? Members of the public mud wrestling in bikinis or fighting each other wearing giant floppy boxing gloves and blindfolds in the Colosillyum. A oneman band playing Genie In A Bottle and Feel It by The Tamperer, making us wonder if he has been playing the same set for the past ten years. A kazoo band playing We Will Rock You. The customary paint fight between festival virgins and veterans. Will & The People covering the Pixies Where Is My Mind? We saw Orbital, whose set featured Heaven Is A Place on Earth by Belinda Carlisle which we suspect will prove to be a more enduring contribution to popular culture than any Orbital track. We saw Jake Bugg, a young man who could be accused of being musically regressive, but seems to be connecting (see this Independent interview for more on Jake). We saw Ryan Keen whose song Focus epitomises the current batch of singer songwriters (its about careerism). We saw Lamb, who we remember as one of the B list bands who broke through in the slipstream of Portishead, but who seemed to be fondly remembered by the sizeable contingent of thirty-something festival goers. And they did at least play some original songs - there are probably more horn players at SGP than songwriters. All in all, its an odd aesthetic but somehow it works. This was SGPs tenth anniversary year. We were watching James Lavelle DJ when the celebrations were going on in earnest, but from what we could gather they involved planes flying overheard drawing heart shapes in the sky, and parachutists falling to earth as colours sprayed from their feet. Why is Secret Garden Party held in higher regard than other festivals? Why does it sell out year after year? Because the festival remains true to its values, resists the temptation to whore itself out to brands, and goes the extra mile in everything it does - a bit like a great artist.
