Gillespie moves the Court for an Order of Protection Against Ryan Christopher Rodems and states Mr. Rodems telephone plaintiff at home January 5, 2010 at 11:06am. The call was of a harassing nature. Mr. Rodems did not identify himself at first, and merely repeated whatever plaintiff said. After Mr. Rodems identified himself, plaintiff asked the purpose of his call. Mr. Rodems was disrespectful and would not address plaintiff as "Mr. Gillespie". This is a long-standing problem with Mr. Rodems. When Mr. Rodems became argumentative, plaintiff terminated the call.

COOK, Defendants. / -------....-------- PLAINTIFF'S MOTION FOR AN ORDER OF PROTECTION AGAINST RYAN CHRISTOPHER RODEMS Plaintiffpro se, Neil J. Gillespie, moves the Court for an Order of Protection Against Ryan Christopher Rodems, and as grounds therefore states: 1. By Order dated December 30, 2009, the Court canceled a hearing improperly set by Mr. Rodems for January 19, 2010 at 4:00pm. The Court reset the hearing for January 26, 2010 at 3:00pm to include all outstanding motions, see Order Canceling and Rescheduling Hearings. (Exhibit 1). 2. Mr. Rodems is apparently unhappy with the Court's Order, and left two voice messages on plaintiff's answering machine January 4, 2010. Mr. Rodems stated that he would not cancel the hearing set for January 19, 2010 at 4:00pm, and made a number of suggestions and claims. 3. Plaintiff responded to Mr. Rodems by faxed letter January 5, 2010, and provided him a copy ofthe Court's Order Canceling and Rescheduling Hearings. (Exhibit 2). Recordings of Mr. Rodems' phone call and messages are available to the Court as evidence. All calls on plaintiff's home office business telephone extension are recorded for quality assurance purposes pursuant to the business use exemption of Florida Statutes chapter 934, section 934.02(4)(a)(I), and the holding of Royal Health Care Servs., Inc. v. Jefferson-Pilot Life Ins. Co., 924 F.2d 215 (11th Cir. 1991). WHEREFORE, plaintiff respectfully requests this Court enter an Order of Protection against Mr. Rodems and requests the following: a. Order Mr. Rodems to stop making harassing phone calls to plaintiff. b. Order Mr. Rodems to address plaintiff as "Mr. Gillespie" at all times in this litigation. c. Order Mr. Rodems to undergo a psychological assessment or other test to determine his fitness to represent his law fmn, Barker, Rodems & Cook, PA. d.
