UNOPPOSED MOTION OF INDIVIDUAL DEFENDANTS FOR LEAVE TO FILE REPLY MEMORANDUM IN SUPPORT OF THEIR MOTION TO DISMISS Pursuant to Local Rule 7.1(B)(3), Defendants John Bordynuik, Dr. Jacob Smith, Ronald C. Baldwin, Jr., Amy Bradshaw, John M. Wesson, Robin Bagai, Gregory Goldberg, and Theodore J. Henry (collectively, Individual Defendants) respectfully move for leave to file a reply memorandum in support of their motion to dismiss. Plaintiffs counsel does not oppose this motion. As grounds for this request, the Individual Defendants state that the subject matter of their motion to dismiss is factually and legally complex, involving the fiduciary duties of public company board members in the financial restatement context, demand futility, damages, and personal jurisdiction. The filing of a reply memorandum will assist the Court regarding these

issues. The Individual Defendants therefore seek the opportunity to file a reply brief to address the arguments raised in Plaintiffs Opposition. In accordance with CM/ECF Administrative Procedure R, a copy of the proposed reply brief, the length of which is consistent with Local Rule 7.1(B)(4), is attached hereto. WHEREFORE, the Individual Defendants respectfully request leave of this Court to file a reply memorandum in support of their motion to dismiss.
