MOTION FOR EXPEDITED HEARING ON MOTION TO SELL REAL PROPERTY FREE AND CLEAR OF ALL LIENS, CLAIMS AND ENCUMBRANCES

TO THE HONORABLE LEIF M. CLARK, JUDGE, UNITED STATES BANKRUPTCY COURT: NOW COMES, Delta Produce, L.P. (hereinafter "Debtor") in the above-referenced styled and numbered Chapter 11 bankruptcy case, and files this its Motion for Expedited Hearing on Motion to Sell Real Property Free and Clear of All Liens, Claims and Encumbrances, and in support thereof would respectfully show the Court the following: 1. Contemporaneously herewith, the Debtor filed its Motion to Sell Real Property Free and

Clear of All Liens, Claims and Encumbrances. 2. The Debtor requests expedited consideration because the Debtor needs to liquidate its

assets to avoid future taxes, as well as cancel the insurance costs and pay creditors. The real property is not being used. 3. The Debtor has found a party interested in purchasing the real property and has executed

a settlement statement. However, the proposed purchaser has indicted that it desires to close the purchase before the close of May. Unless the sale closes in May, there is a strong chance the purchaser will walk the deal.

WHEREFORE, PREMISES CONSIDERED, the Debtor requests that the Court expedite the hearing on the Motion to Sell Real Property Free and Clear of All Liens, Claims and Encumbrances, and set the Motion for hearing as soon as possible, and for such other and further relief to which Debtor may show itself entitled.
