Chapter Ii Case No. 08-11586 (KG) (Jointly Administered)

Hanjin Shipping Co., Ltd. (Hanjin) hereby respectfully moves (the Motion to Shorten), pursuant to section 102 of title 11 of the United States Code, 11 U.S.C. 101, et seq. (the Bankruptcy Code) and Rule 9006-1(e) of the Local Rules of Bankruptcy Practice and Procedure of the United States Bankruptcy Court for the District of Delaware (the Local Rules), to shorten the notice period under Local Rule 9006-1(c) and Rule 2002(a) of the Federal Rules of Bankruptcy Procedure (the Bankruptcy Rules) with respect to the Second Motion of Hanjin Shipping Co., Ltd. for Relief from the Automatic Stay pursuant to 11 U.S.C. 362(d), and respectfully represent as follows: 1. Hanjin seeks to shorten the period for notice of the hearing on the Second

Motion required by Bankruptcy Rule 2002(a) so that this Court may consider the Second Motion on November 12, 2008 at 2:00 p.m. when the Court considers the first motion for relief from stay filed by Hanjin on October 31, 2008. In addition. Hanjin asks that this

Court set a corresponding objection deadline for the Second Motion of November Ii,
2008 at 4:00 p.m.. which is the same objection deadline this Court set for the motion filed on October 31. 2008.

2,

As set forth more fully in the Second Motion, the Second Motion is in no

way prejudicial to the Debtors. and granting the Second Motion presents no hardship to

the Debtors. The Debtors do not have any equity in the cargo subject to the Second Motion. Upon information and belief, the Debtors have not paid the shippers the

purchase price for the cargo. Further, the Debtors, as consignees or notify parties, have failed and refused to take delivery of the cargo. The Debtors have in effect abandoned the cargo. Demurrage, detention or extended freight charges continue to accrue on a daily basis. 3. Hanjin seeks a hearing on the Second Motion on shortened notice because

the shippers need to sell and deliver the cargo to third parties in time for the holiday season. In addition, detention and other delay damages continue to accrue. Further, the value of the cargo will decrease, if the cargo cannot be sold or otherwise disposed of in time for the holiday season. The next hearing in these cases is on November 24, 2008

the eve of the Thanksgiving holiday. If Hanjin cannot divert the cargo until that time, the cargo will not be sold this holiday season. This Court has already agreed to hear a similar motion filed by Hanjin on November 12, 2008 at 2:00 p.m., and Hanjin respectfully requests a hearing on the Second Motion at the same time because of the similar issues presented by the two motions seeking stay relief. WHEREFORE, 1-lanjin respectfully requests that the Court (i) approve the shortened notice period; (ii) schedule a hearing to consider the Second Motion on November 12, 2008 at 2:00 p.m.; (iii) set an objection deadline for the Second Motion of November 11. 2008 at 4:00 p.m.: and (iv) grant such other and fbrther relief as the Court deems just and proper.
