MOTION FOR ALLOWANCE OF ADMINISTRATIVE EXPENSE CLAIM AND REQUEST FOR IMMEDIATE PAYMENT COMES NOW SEVEX North America, Inc. f/k/a ATD, Corp. (Sevex), by and through undersigned counsel and pursuant to 11 U.S.C. 503(a) and (b), moves this Court to allow Sevex an administrative expense claim and to direct immediate payment of said claim to Sevex. As grounds for this Motion, Sevex states the following: 1. The above-captioned debtors (the Debtors) filed their petitions for relief under

Chapter 11 of the United States Bankruptcy Code on May 17, 2005 (the Petition Date).

11 U.S.C. 503(b) provides that there shall be allowed administrative expenses

. . . [for] the value of any goods received by the debtor within 20 days before the date of commencement of a case under this title in which the goods have been sold to the debtor in the ordinary course of the debtors business. 11 U.S.C. 503(b)(9). 3. Sevex provided goods to the Debtors that (1) were received by the Debtors within

20 days before the Petition Date and (2) were sold to the Debtors in the ordinary course of the Debtors business. 4. Specifically, Sevex provided the following goods (the Goods) on the following

The Goods were all received by the Debtors within 20 days of the Petition Date. The Goods were used in the ordinary course of the business of the Debtors and

these transactions were made according to ordinary business terms. A true and correct copy of

the invoices corresponding with the Goods is attached hereto as Exhibit A and incorporated herein by reference. 7. Sevex hereby asserts an administrative claim against the Debtors pursuant to 11

U.S.C. 503(b)(9) in the amount of $43,698.28, which represents the value of the Goods. 8. Sevexs claim of $43,698.28 for the Goods is therefore due to be paid

immediately as an administrative expense claim pursuant to 11 U.S.C. 503(b)(9). WHEREFORE, Sevex moves for an order (1) allowing it an administrative expense claim of $43,698.28 and directing the immediate payment to it of said amount as an administrative expense claim and (2) for such other and further relief as is just.
