The Law Firm is representing each of these defendants individually; these defendants

do not comprise a committee of any kind. 4. Upon information and belief formed after due inquiry, none of the defendants

represented by the Law Firm has filed a claim against the Debtors. A claim (no. 1050) was filed against the Debtors by Cogentrix Inc. on July 18, 2005 in the amount of $123,781.50. Cogentrix Inc. is not represented by the Law Firm, but is a defendant in adversary proceeding no. 07-04845. 5. The Law Firm has no written contract of representation with any of the defendants

described above other than ordinary and usual retainer/engagement letters. 6. Upon information and belief formed after due inquiry, as of the date of this statement,

the Law Firm does not hold any claims against, or equity interests in, the Debtors. 7. I declare under penalty of perjury that the foregoing is true and correct.
