EX-PARTE MOTION FOR RESCHEDULING OF HEARING ON KZC SERVICES, LLC AND JOHN BOKEN MOTION FOR RELIEF FROM ADMINISTRATIVE ORDER 00-04 TO ALLOW DISCOVERY ON MATTERS RELATING TO THEIR FEE REQUEST The Collins & Aikman Post-Consummation Trust (the Post-Consummation Trust) requests that the Court Reschedule the Hearing the Court has set on KZC Services, LLC and John Bokens Motion for Relief from Administrative Order 00-04 To Allow Discovery on Matters Relating to Their Fee Request (Docket No. 8628) (the Motion), and states in support thereof as follows: 1. The Post-Consummation Trust is owned by the Debtors former prepetition secured lenders, and is the successor to (a) substantially all of the Debtors remaining assets (other than certain causes of action) and (b) the Debtors obligation to pay professional fees and expenses allowed by the Court. In that capacity, the Post-Consummation Trust is directly impacted by the allowance or disallowance of fees and expenses sought by KZC Services, LLC. 2. The Motion was filed November 21, 2007 and served by mail. A Notice and Opportunity to Object was also filed and served with the Motion. Pursuant to the Notice and Opportunity to Object and Local Bankruptcy Rule 9014-1,

parties wishing to file objections to the Motion have until Thursday, December 6, 2007 to file such objections. 3. 4. The Court has set a hearing on the Motion for December 3, 2007, at 2:30 P.M. The Post-Consummation Trust hereby requests that the hearing be adjourned to a date after December 3, 2007 so that it and other parties may draft and file objections. 5. Counsel for the Trust has consulted with Kenneth A. Nathan, counsel for KZC Services, LLC and John Boken. Mr. Nathan confirmed that his clients have no objection to the rescheduling of the Motion. WHEREFORE, the Post-Consummation Trust respectfully requests that the Court entered the proposed Order attached hereto as Exhibit 1, rescheduling the hearing on the Motion for a date after December 3, 2007, and granting such other relief as may be just and proper.
