European Energy Studies This series closely monitors the issues and developments in the field of European energy law and policy by providing an in-depth scholarly and research based yet a practical written and accessible source of information. European Energy Journal The EEJ offers the practitioner and the academic pro-active information on energy law and policy throughout Europe. It reports and comments relevant developments in the areas of internal market, competition law, energy efficiency, renewable energies, climate change, infrastructure, security of supply, and foreign energy policy. Each issue includes regular reports on legislative initiatives, case law and country developments. EEJ is published four times a year.

The EU GEO Laws The legal framework of the European energy sector is undergoing fundamental and continuous changes. This third edition incorporates the conclusions and consequences of the Sectoral Energy Competition Enquiry. The new edition contains an entirely reworked section on anti-competitive agreements and practices by Lars Kjlbye, at the time of writing the Head of Unit in charge of anti-trust in the energy sector in the European Commission. It further examines in detail the developments in individual case concerning long-term capacity reservation and sales/purchase agreements. It also considers recent developments on cases concerning collusion on price and quantity restrictions and looks thoroughly into detail at the consequences of the sectoral enquiry on abuse of a dominant position, particularly regarding discrimination in network access. Revises the section on merger control to take account of developments in the methodology in de ning markets and de ning dominance/signi cant impediment of competition from the sectoral enquiry. Volume VI

The Security of Energy Supply in the European Union


This book examines the latest developments of the European Union's energy policy and particularly the way security of energy supply is taken into account and handled. As one of the three objectives of the EU energy policy, security of supply emerged as a central element of the policy, after the January 2009 gas crisis and now with the consequences of the Fukushima events. The contributions to the book are made by the most informed people on the various subjects given their professional position. It analyses the extensive developments of the concept toward energy security, the impact of the third internal market package on its reinforcement and the major role to be played by infrastructures in ensuring physically the security of supply. It will comment the most recent and relevant instruments adopted by the European Union in the eld of oil, the so-called Oil stocks directive, and gas, the Regulation on Security of Gas Supply. In the eld of electricity, it will report on the experience of the Transmission System Operators working together in the European Network (ENTSO-E) to guarantee security of supply. The external dimension of the EU energy policy will be explained in as far as it aims at security of supply. Three illustrative cases are particularly studied: the Southern gas corridor development, the January 2009 gas crisis and the Baltic Energy Market Interconnection Plan. The relevant EU legislative texts and the recent communications of the Commission on the subject are appended, to o er the direct references of what is discussed in the various sections.

Energy Efficiency in the European Union


The EU has developed an increasingly ambitious energy e ciency policy. In particular with the publication of an EU Energy E ciency Action Plan in April 2000, the issue of e ciency has become a central concern of policy makers. The recent passage of the Energy E ciency Directive underlines this trend: this is a piece of legislation which has the potential to profoundly in uence the activity and behaviour of energy suppliers, consumers, energy service companies and others involved in the energy sector. This volume will cover all areas of EU energy e ciency policy, from the objectives and strategic direction of policy at EU level, to the implications of EU policy for Member States and their energy e ciency action plans. Infrastructures are the backbone of any economy and energy is vital to our way of life. Electricity transmission, gas and oil pipelines, smart grids, storage of energy and later on CO2 transport are essential elements of our present and future energy systems. The energy and climate policies conducted by the European Union since 2007 have led to the third energy package governing the internal electricity and gas markets, to the directive setting the target of 20% of renewable sources of energy by 2020, to the energy e ciency directive and most recently to the regulation establishing the guidelines on trans-European energy infrastructures and to the new nancing programme called Connecting Europe Facility. In ve years time, national energy policies have been drastically reshaped by the EU directives and regulations, now based on Article 194 of the Treaty on the Functioning of the European Union. It is now time to understand fully the importance of these regulatory changes and the resulting europeanisation of the energy policy.

Security of Oil Supplies: Issues & Remedies


Oil has always been identi ed as a strategic commodity, and attracted the interest of governments. This interest has frequently been articulated in terms of control or security of supply - terms whose exact meaning is seldom clearly de ned. Increased dependence on oil from the Gulf today sometimes dubbed an addiction accentuated the security pro le of oil. The possibility of an interruption of oil supplies was considered to have potentially catastrophic consequences for the industrial countries. However, the international oil market has always proven to be resilient and e cient in redistributing ows of available oil to satisfy demand. Oil has very much behaved as a transparently traded commodity, which any party can get for the going price. This book examines the potential threats to security of oil supplies: resource nationalism, political instability, international and domestic armed con ict, and terrorism or insurgency. A separate chapter is devoted to maritime choke points, such as the Strait of Hormuz. Through detailed analysis of historical experience, it is shown that the international oil industry has shown much greater resilience and exibility that is normally acknowledged. The use and impact of strategic stocks as a tool to face potential crises is discuss, and the ambiguous boundary between strategic and intervention stocks explored. The tendency of the international oil market in its current con guration to exaggerate price uctuations is shown to be a main component of the perception of insecurity that is associated with oil supplies. Potential policy initiatives to correct or limit such market insecurity are proposed.

Shale Gas in Europe

Opportunities, risks, challenges: a multidisciplinary analysis with a focus on european specificities


Large-scale extraction of shale gas in North America over the last years has led to a growing attention on the potential opportunities and risks of unconventional gas extraction, including in Europe, where available sources are known to exist. The US experience shows that industry-wide extraction of shale gas may positively change the game, leading notably to increased security of supply. But the US experience also demonstrates that intensive extraction of shale gas entails environmental risks, in particular due to the intensive use of horizontal drilling and hydraulic fracturing. Shale gas in Europe assesses the speci cities of large-scale shale gas extraction in Europe from a multidisciplinary viewpoint, that is from the point of view of engineers, economists, policymakers, lawyers and sociologists. Each topic is discussed in the light of the US experience, with a particular focus on highlighting how Europe is di erent. Shale gas in Europe evaluates the potential of shale gas in the EU, including potential risks. The institutional framework into place in the EU is explained as it de nes the legal and regulatory conditions under which industry-wide shale gas extraction will develop. Taking this background into consideration, the authors of Shale gas in Europe seek to anticipate the challenges ahead of shale gas extraction on the continent. Shale gas in Europe nally gives an account of individual stories in some EU countries, ranging from the French ban on shale gas to a wide governmental support in Poland.

Towards a sustainable energy transition in the Southern and Eastern Mediterranean region
In the aftermath of the Arab Spring, Southern and Eastern Mediterranean Countries (SEMCs) urgently need to nd a new path of strong and sustainable socio-economic development. Considering its macroeconomic and energy fundamentals, the region has a great potential for triggering o a new development process and the ongoing political changes can enhance such a new dynamic. The current energy situation in the region is characterized by a rapid increase of energy demand, low energy e ciency, and low domestic energy prices due to extensive universal consumption subsidy schemes. The current energy situation does not appear sustainable and poses several risks to the prospects of socio-economic development of the region. The recent Arab uprisings could provide the EU with the opportunity to play a more meaningful role in the region in the future. Energy is a topic of key importance for both the EU and SEMCs. In view of their geographic proximity, a further market integration would be in the interest of both sides. This book seeks to provide a comprehensive overview of the energy markets in SEMCs, and to propose a new sustainable energy transition for the overall Mediterranean region. In doing so, the book will assess a number of speci c issues such as the regional outlook for electricity and renewable energy, the current situation of the oil and gas sector and its outlook, also taking into consideration the most recent hydrocarbons developments occurring in the Eastern Mediterranean area and, nally, also proposing a series of innovative nancial schemes aimed at fuelling the sustainable energy transition of the overall Mediterranean region.

Vertical Restraints
This new volume analyses in considerable detail the antitrust issues arising from vertical restraints and presents a comprehensive map and critical assessment of current enforcement practice in the European Union. The purpose of the book is to provide extensive guidance to practitioners, businesses and researchers, as well as to contribute to the ongoing debate on the application of EU competition rules to distribution and other vertical agreements. The book contains thoughtful contributions written by leading practitioners and scholars from di erent countries, which address the general framework for assessing vertical restraints and cover a wide range of vertical practices. After discussing the pro-competitive rationale and potential negative e ects of vertical restraints and the introduction of an economic approach by the Commission, the book analyses the block exemption regulation and critically reviews the limits of the 2010 revision of EU rules on vertical restraints. The following chapters then explore in detail enforcement practices concerning the most commonly used vertical restrictions and speci c agreements entered into by rms situated at di erent levels of the production chain. The EUs Climate Policy


This book gives an up-to-date account of the EU's climate policies that apply across the European economy. It explains the nuts and bolts of the world's largest carbon market, the EU emission trading system, as it is now functioning in a new form as of 1.1.2013. It explains the importance of using market forces to reduce greenhouse gas emissions, discusses binding caps, large scale auctions and the use of revenues and support given for modernisation and deployment of innovative technologies, free allocation and 'carbon leakage', action on aviation emissions, the registry IT system, monitoring, reporting and veri cation, the use of international credits and incentives given to action outside the EU. It also discusses the use of clean development mechanism credits applicable from 2013 onwards, the developing links of the EU system with Australia and Switzerland as well as an outlook on pathways to building a truly international carbon market. Another part describes the e ort sharing decision that sets binding national targets for sectors not covered by the EU emission trading system, and explains the EU-level policies that support meeting these targets. These include CO2 emission limit values for passenger cars, energy e ciency regulations, the fuel quality Directive and regulations on non-CO2 greenhouse gases. Activity on land use and forestry is also covered. The nal part describes the main challenges for developing an e ective international climate policy. It sketches the progress to date and in particular the changing dynamics and growing complexity in the climate negotiations. It focuses on the challenges ahead in the negotiations on a new legally binding agreement, to be nalised by 2015 and to be implemented from 2020 onwards.

8th Annual Conference
2012 has been another key year for EU Energy Law and Policy, with important new directives and communications. On June 6, 2012 the Commission published a communication on Renewable Energy that builds on the Commission communication Energy Roadmap 2050 and presents policy measures to accelerate the development of renewable energy. The new Infrastructures Regulation, expected by the end of 2012, will without doubt have a massive impact on the energy market. Infrastructures form the backbone of any economy and energy is vital to our way of life. Electricity transmission, gas and oil pipelines, smart grids, storage of energy and, later on, CO2 transport are essential elements of our present and future energy systems. Energy Security and Safety is another important topic on the Commission agenda; under the new draft regulation (2010/0303(COD)) new initiatives are taken on a.o. safety of o shore oil and gas prospection, exploration and production activities. On Competition Law in Energy Markets, the recent judgments of June 29 on a market sharing agreement involving E.ON and GDF (T-360/09 and T370/09) contains many interesting insights into the EU energy sector. By the end of 2012 the Commission is also expected to publish a new communication on The Internal Energy Market assessing the state of play of the process towards completion of the internal energy market by the 2014 deadline. This review will be instrumental in identifying the necessity of possible further actions required to ensure that this objective is realized.
