DE: I didn't see anything, I didn't see ... nobody even knows or nobody knew the kid
who hit him except for I guess some kids that were there and left but I didn't
know them. I didn't know anybody there except for the kids! came with.
LC: Okay so you're in the house and you went outside,
DE: Right
lC: and you said you saw Nick on the ground?
DE: Right
lC: Describe that for me.
DE: He was lying on his back, flat on the ground with his head like this. There was
blood coming from his eyebrow and from his nose and some out of his mouth.
LC: Were his eyes opened or closed?
DE: They were closed.
LC: Was he talking?
DE: No.
LC: Was he breathing?
DE: (Affirmative response)
LC: And then you said you went over to him and you picked him up and brought him
into the house?
DE: Yeah me and the owner of the house carried him inside onto the couch and we
tried to wake him up a little more and he started like ... he wasn't like
conscious ... he didn't know what was going on but he was like moving.
LC: And the name of the owner of the house is Brian?
DE: Brian.
LC: So it was you and Brian that picked him up and moved him into the couch?
DE: Yup
LC: Then what happened?

DE: Oh, we, the owner called the police and the ambulance came and they came
inside and tried to wake him up or do whatever to him to see if he was okay and
the police took our names down and we told them what happened and then the
paramedics brought Nick to the hospital.

On 03/24/2002 I was working a 11 pm-7am shift assigned to unit 305 patrolling the town area. At approximately
0252 dispatch recieved a loud party complaint at A second call was recieved about a injured
person laying on the ground in front of the Ocean Wok restaurant. Assisting with the call I drove to the parking
lot of the Ocean Wok upon arrival I was unable to locate the injured party. I continued to patrol the immediate
area looking for the injured subject. VVhile in the area of the state park I noticed a male subject standing the door
way of #5 Ocean Blvd. The subject was waving his arms at mc and turning the lights on and off inside of the
house. I went to the house to investigate the activity. At the house I was meet by
WARD began to yell and point inside the honse. I asked WARD what the problem was. He told me that his
friend was hurt and needed help. I entered the house, there was a young male sitting on a couch with no shirt on.
The male was bleeding from about the mouth, nose and head area. He had a laceration above his left eye. He
appeared to be comming in and out of consciousness. He then began to vomit. I immediately notified dispatch
that I found the injured subject and I needed ambulance. I later \vas infonned that he had alcohol
beverages at the house. The subject was identified as
NICHOLAS CUFF
Fire arrived on scene an attended to CUFF.
There apparently had been a party at the house. There was large quantities alcoholic beverages empty and fuJI
throughout the house. WARD and four others still remained inside the house when I arrived on scene. WARD
said he was responsible for the house while his roommate was away on vacation. WARD nor the four others
where over the age of21 yrs. old. All admitted to consuming alcohol beverages at the house. WARD was placed
under arrest for prohibited sales and illegal possession of alcoholic beverages (SEE AR#272). The other four
were placed into protective custody. They were identified as

CUFF had been transported to Exeter Hospital for his injuries. r was later informed that CUFF had sustained a
broken nose, sever swelling to his head and face. Due to the extent to the head injuries he was transpo!1ed (0
Portsmouth Hospital for further observations.
I asked WARD ifhe knew how CUFF had sustained his injuries. WARD told me that people started leaving his
house when someone came back inside and told him that CUff was laying on the ground bleeding. WARD said
that he and the others went outside and found CUFF on the ground bleeding form his head and face.
WARD said next they brought him in the house and put him on the couch. WARD said he then called the police.
WARD told me that a someone had told him that when CUFF was walking to his car a unknown person walked
up to CUFF and began punching him in the face. WARD could not recall who [old him what had happened or
who might have assaulted CUFF.
While I was speaking with WARD, Sgt. Gidley had been interviewing the others in the house. The others had
denied any knowledge of who had assaulted CUFF. I noticed that SNOOK's nose and eye were swollen. 1
asked him what had happened to his face. SNOOK first was reluctant in answering my question. It was apparent
to me that had been involved in the assault due to the type of injUlY to his face. I asked SNOOK again ifhe had
been involved with the assault. SNOOK then told me that he heard that someone was beating up CUFF so he ran

e and that is when someone punched him in the face. He said that he did not know or see who punched
ile I was speaking with SNOOK, KOVACS began to cry and become very upset. KOVACS wDlkcd up
one of others and lover heard her say that she knew who had punched CUFF. I infonned Sgt. Gidley that
, we might possibly have a witness to the assaull. Sgr. Gidley seperatcd her from the others to interviewed her, He
I later informed me thal KOVACs told him that she had witnessed the assault. She had told him that CUFF,

had walked up behind them and MULREY began punching SNOOK in the face. She then said she heard a yell
and saw MUTRIE on top of CUFF punching him in the face with his fist. KOVACS said that she ran over to
: MUTRIE and tried to make him stop. KOVAC said MUTRIE finally stopped punching him and walked away.
I KOVAC said that she was not sure why MUTRIE had attacked CUFF. She said that they did not know each
other nor did they have any type of confrontation prior to the assault. KOVAC's said that MUTRIE was a tormer
I boyfriend.
I During our contact with SNOOK, EMERSON and MOELLERING they were reluctant and hesitant in
I providing information. They had stated many times that they did not want to get involved.
I EQr in the evening Sgt. Gidley had notified dispatch of the large number of cars parked at
"'e of the vehicles parked there at the time had been regitstered to ML'TRIE (NH . Sgt. Gidley
,-rformed me that he had witnessed MUTRIE's vehicle leaving the scene just prior to the time of the assault.

It is my opinion through speaking with the eye witnese and evidence that MUTRlE and ML'LREY should be
considered the main suspects in this assault. Witnesses did identified :V1LJTRIE as CUFFs assailant. MUTRIE's
vehicle was present at the time ofthc assault.
Dueto the severity of CUFF's injuries I would recommend that MUTRIE be charge with 2nd. degree assault and
this case be passed onto CID.
On 03/24/2002 Sgt. Gidely and I spoke to CUFF's father. He imformcd us that :-!ICHOLAS was still hospitali7.ed
and he was still in serious condidion. We requested when it was possible if we could have l\\CHOLAS releaset\)
the department medical records of his injuries. Mr. Cuff informed us that he had spoke to several people who
were at the party and witnessed the attack, one of those being S:-JOOK. According to Mr. Cuff, SNOOK had
provided him with more of a accurate and detailed story of what had taken place on the night of the attack. Mr.
Cuff expressed his and NICHOLAS friends concern for their saftey due to :VIUTRlE's prior history of violence.

On 03-24-02 I was assigned to back up in unit # 308 on the 11-7 shift At approximalely 2;45 A.M. I responded
to a dispatch call of an man down in the parking lot of The Ocean Wok Restaurant. r arrived on the scene but
did not see an injured party or any subjects at all in the area. The surrounding houses all appeared dark and
quiet. I began a parrol of the immediate area and then proceeded north down Ocean DJvd. , acting on the
possibility the subjects left the area on foot. Approximately 5-10 minutes later r heard Officer BUCZEK radio
dispatch he had an injured subject at and to send the medics. 1 responded to the scene to assist
BUCZEK.
Upon arrival at # 5 Ocean Blvd. ,I noted this location (which was completely dark 5-\0 minutes ago) ,was now
fully illuminated by interior lights. I could see from my cruiser BUCZEK was assisting the injured man inside
of the residence. The neighbor of the residents at # 5 Ocean Bvld. approached me and told me there had been
loud parties at that residence for several days. The man told me the house had been rented to a man who went
away for the weekend and was now being used by the mans friends.
I entered the house and observed a subject sitting on the sofa bleeding from the head. The man appeared
intoxicated and was fading in and out of consciousness. BCCZEK told me the mans name was Nicholas CCFF.
I then observed approximately 75-100 empty beer cans scattered about the house. The house appeared [0 be in
disarray like there was a large party there.
medics arrived on the scene and began to stabilize the injured man for transport to the hospital.
Sgt. GIDLEY arrived on the scene and began to question several of the occupants of the house. None of the
occupants I questioned were ofIegal drinking age. I radioed dispatch to run warrant checks on three of the
subjects. They were identified as ;

All came back without warrants.

, I then talked to a female subject in in the house who stated she had witnessed the assault on the injured party.
She then identified herself as ;

; KOVACS was reluctant to disclose the assailants name saying he was an ex-boyfriend of hers, but when
I reminded of the extent of the injuries CUFF sustained she told me she would tell me his name. KOVACS told

two times. KOVACS told me she physically grabbed MUTRIE and yelled 11 Stop it , what are you doing? Why
are you doing this? 11 ML"TRlE then left the scene. KOVACS then said she also witnessed MUTRIE S friend
identified as Dave MURLEY assault another subject at the party identified as ;

KOVACS told me when SNOOK tried to help CCFF , MURLEY punched Sl\OOK in the face.
I then spoke to SNOOK. SNOOK stated he was "Jumped" by a subject but did not sec his attacker and did not
know his name. I stated to SNOOK it seemed unlikely he did not see his attacker. S('.;OOK again stated he
did not see his attacker or the attacker of CU FF.
I questioned others occupants of the house ,all of\vhich stated they did not see the assaults.
I had the impression several of the subjects saw the assault but did not want to identify the assailants out offear
of retaliation.
After approximately 10 minutes of interviews by Sgt.GIDLEY, I was asked by the Sgt. to transport SNOOK and
KOVACS to the station to get written voluntarily statements from them. I then transported SNOOK to the
station. SNOOK and KOVACS voluntarily wrote out statements but expressed desire not to have to testify in
court.

On 3/24/02 at approximately 0200 hrs r was working an 11-7 shift in unit 309 (supervisor). I was in the area of
Ocean Boulevard and Harbor Road and observed several parked vehicles in the area which I believed were
visiting a residence located at ( Brian Ward). I ran several of the plates out and recognized
many of the names as that of local kids that r have encountered in the past. I could see that the lights were on
inside Ward's residence but r was not able to view anyone inside as tbe sh:ldes and blinds were covering thL'
windows_ I requested dispatch to place a call for service in the log and list alit the registration plates in the
narrative section for reference (see call number 02-3824).
At approximately 0250 hrs while I was on a traffic stop at Ashwonh Avenue and H Street. I heard headquarters
dispatching units to the area of for a complaint of a loud party. I watched the area of the
intersection of Harbor Road and Ocean Boulevard to see if any vehicles left the area and I cleared my stop within
'j about 2 minutes of the calL Just prior to clearing the traffic stop I obscrved 3-4 vehicles leave the Harbor Road
area, one of them being a white Ford Fl50 Pickup truck, which I believed to be Cullen Mutrie. I observed that
I all of the vehicles that departed left in a northerly direction.
i I then travelled up H Street the wrong way as I saw the vehicles pass that location. I caught up to the vehicles in
, the area of A Street and observed two of the vehicles tum left onto Church Street. I then checked the registration
I of the truck in front of mc and confirmed that it was owned by Cullen Mutrie. Having prior knowtedge that
I Mutrie is under 21 and has been known to consume alcohol, I watched the operation of his vehicle as he
continued northbound. Directly in front of him was another vehicle r recognized as one belonging to Brenda

. y, a 1995 Nissan Altim,a color blue. While behind Mutrie's vehicle I heard dispatch advise of another call
area of the Ocean Wok for a reported injured person down in the road. Arriving units advised that they
. were unable to immediately locate any injured person in the area. Mutrie's vehicle then pulled into the driveway
, of the residence located at ,?'????Cliff Avenue. As there \Va:; no indication that Mutrie's vehicle was being
operated by an impaired driver, and there was no equipment problems with his vehicle, no traffic stop was
I performed.

I then headed for the scene of the complaint at While enroute, units advised that they
'located the injured party and they requested that Hampton Fire Department. I stopped briefly at 144 Ashworth
i Avenue to check on a car tire that also damaged the building, Wally's Pub. I advised Captain Rusty Bridle of the
I ambulance request as he was getting the call from his dispatch. I then continued to and
arrived at the same time as the Hampton Fire Department.

, I entered the residence and saw the victim laying on his back on the couch. I observed that the victim, later
1 identified as Nick Cuff, had cut above his left eye running through his eyebrow_ He appeared to be intoxicated

and was vomiting. Hampton Fire personnel were attending to him and asking some of the attendees ifhe was on
anything other than alcohol.

While the HFD medics were attending to Cuff, Brian Wards roommate arrived homt!. I believe his name was
Sean. He was not at the residence when we first arrived and when I spoke with him he did not appear to have
been drinking. He told me that he had just gotten in from Cancun with his girlfriend. He was confronted by the
landlord, Eddy Gilmore. Gilmore told him that he was throwing him out.
I inquired with the above subjects who had beat up Cuff, but none were forthcoming with infornlation.
I then retrieved the digital camera from my cruiser and took several photos of the interior of the residence.
Photos will be attached to both this incident report and the arrest report for Brian Ward 02-272-AR.
I requested that Officer Daignault respond to our location whcn he was clear his previous call. Upon his arrival I
directed him to transport Brian Ward to the PO and to begin booking him for Prohibited Sales and Illegal

I heard Sean ask Kovacs who beat up Cuffand I observed Kovacs lean forward and speak to Sean. I then asked
Sean to step outside in order to speak with him. Once outside I asked Sean what Kovacs had said to him and he
tol d me that she said that Cullen Mutrie and David Mulrey had beat up Cuff. Sean told me that he would prefer
that his name not be mentioned in revealing Mutrie's name. I then asked Kovacs to step outside. I told her that I
believed she witnessed the incident and that she knew who assaulted she app<::ared reluctant and eventually
told me that she had witnessed Cullen Mutrie repeatedly hit Cuff with his fists while Cuffwas on the ground.
She also told me that she saw Mulrey hit Snook when Snook attempted to stop Mutrie from hitting his friend,
Cuff.
HFD ambulance transported Cuff to the Exeter Hospital.
I then directed Officer Buczek and Officer Bratsos to take custody of the remaining subjects and bring them back
to the PD for statements and a to make arrangements for a ride as all were under the age of 21 and had been
drinking.
I transported Kovacs to the PO and requested that Officer Bratsos take a statement from her what she
witnessed. Kovacs expressed concern of retaliation by Mutrie, and requested that her name be kept OUt of the
incident.
On 3/24/02 at approximately 2315 hrs r met with Officer Buczek and Nick Cuffs father in the officer's room.

Ufftold us that his son was transported from Exeter Hospital to the POltsmouth Hospital due to a head
. He advised us that he had spoken to his son but his son had no recollection of the incident. I advised him
t we would like to go forward with the case and would need both a statement and medical records when :':-ick

I called the Cuff residence and there was no answer. I called the Portsmouth Hospital and spoke with Anita
Thomas, RN, nurse for Cuff. She told me that Cuff was not speaking to anyone, he was awake but not coherent.
She further said that the parents had prohibited any visitors. She told me to call back the next day.
3/26/02
Mr. Lester Cuff came into the station about 1000 hrs. and wanted to speak with me. Lester told me the
following:
In the early morning hours of March 24, 2002, the Stratham Police Department woke him up and told him that
his son was in the Exeter Hospital being treated. He went to the Ex.eter Hospital Emergency Room with his wife
1 and saw his son. Mr. Cuff said that Nick was in and out of conciousness suffering from swelling on the brain, a
broken nose, a laceration over his left eye that was stichcd up, facial lacerations, facial swelling and bruising.
Later that morning Nick was shipped to the Portsmouth Head Trauma Intensive Care Unit. He remained there
until Monday, March 25, 2002 when he was placed in a regular room. Nick was still hospitalized at this time.
: Mr. Cuff felt that the investigation was not proceeding as fast as he thought it would and wanted to provide me
with information that he had developed on his own.

24, in a quest to retrieve his son's vehicle and to find out what went on he first contacted Katie
He Katie up at her hOllse and they went to 5 Ocean Blvd. They talked about lhe assault on the
way there and she told Mr. Cuff that it was Cullen Mutrie who attacked Nick Cuff. Kovacs said that Snook, Cliff
and Kovacs were going to Portsmouth to get some food. They left the house and walking to a friends car

when Cullen Mutrie attacked Nick Cuff Kovacs said that she is afraid of Cullen's retribution on her. Kovacs
also said it was Dave Mulrey who hit Snook in the face causing his bloody nose.

: Me Cuff and Kovacs arrived at 5 Ocean Blvd. and was greeted by Jesse, he could not remember her last name.
They all searched for Cuffs keys to his car. Cuffs car was parked several spaces south of the residence in a
metered spot. They never found the keys but Mr. Cuff took all of Nick's possessions that remained at the house.

They were a jacket, shirt, t-shirt, shoes, wallet, cell phone and a smashed beer bottle in the jacket pocket. In
conversation with Jesse, she told them that she had spoken to Cullen that morning but did not state what they
talked about. Me Cuff leaves Kovacs there and goes to the hospital. At approximately 1530 hrs. that date, Mr.
1 Cuff took photos of Nick's injuries.
At approximately 2300 hrs. Mr. Cuff came to the station and spoke with Off. Buczek and Sgt. Gidley. They
explained the status of the investigation.
, On Monday, March 25, 2002 at approximately 0630 hrs. Mr. Cuff called Jason Snook. It was agreed that he
I would pick Snook up at his house, take him for coffee and talk about the incident. About 0830 while sitting at

the Exeter Dunkin Donuts Snook told Mr. Cuff what he remembered.' Snook said that Cufr, himself,
and Katie Kovacs decided to go to Portsmouth and get something to eat. As they were leaving
was hit from behind and went down. Snook go lip and was hit in the nose and left eye. Snook said that he

id it and so did but she left right away and he never saw hel; again that night. Snook said he

Snook said that he and the other friends, referred to later on as the Exeter Boys, along with Martin Mulrey,
Dave's younger brother, went to a party in Stratham. Dave was already at the palty and Dave called Martin.
They all end up at
Snook heard from Jerry George that Martin pulled Dave Mulrey off of Snook.
Mr. Cuff then called Jerry George. George told Mr. CufT that he 'ijas in thc house at 5 Ocean Blvd. when the
fight happened. He went outside and saw Nick on the ground having been beat. George ran back inside yelling
who did this and saw a guy sitting at the table, all out of breath and breathing heavy. George said it was Mutrie.
Geroge then ran back outside and helped 0iick get brought into the house. When they carne back in, :Ylutric was
gone. George further said that Mutrie's girlfriend was DanieJJe. George said that when he first went back into
the house the only people inside was Cullen Mutrie, (later identified as Kovacs and
himself.
George told Mr. Cuff that he had talked with Mulrey after the fight and \hrtin told him that he pulled
Dave off of Jason.
George told Mr. Cuff that he went to the hospital after Nick did to see Nick and on the way to the Exeter
Hospital, Geoge called Dave Mulrey on his cell phone and asked him why he attacked Jason Snook. Mulrey
....... and threatened George but never answered the question. George went to the Exeter Hospital with Seth
....,earson,2 McPhearson told George that he thought this was a pre-planned attack.
Mr. Cuff gave me signed releases for both hospitals and told me that he thought I should know that the blood
alcohol in Nick was abou at .10 and that there was marijuana in Nick's urine.
I told Mr. Cuff that I would take over the investigation and asked him not to pursue anything further. I told him
that if he did he could jeopardize our case. Mr. Cuff agreed to this and assured me that he would refer all
questions and comments to me. I thanked Mr. Cuff for his time and we agreed that I would speak with :.rick latcr
that day at the Portsmouth Hospital.
At approximately 1600 hrs. on March 26, 2002 I spoke and took a taped statement from Nicholas Cuff while he
was a patient. In his room, #425 was only myself and )lick while that statement was given. Nick told me the
following:
He worked that day and came home shortly after 7:00 PM. He relaxed, watched TV and spoke with Jason Snook
several times. It was agreed they would go out about 9:30 PM. Cuffpieked up Snook at his hOllse and they went
to the apartment belonging to Matt Powell, Portsmouth Ave., Stratham, KH. While there they ran into Martin
Mulrey. Luke Mollering and Dan Emerson were at this party as well.
Martin Mulrey used Nick Cuffs cell phone and called Dave Mulrey. There was no answer but Martin left a
message. Dave called Martin back on Cuffs cell phone. Cuff talked to Dave Mulrey and asked to speak with
KAKovacs. Kovacs spoke with Cuff then put Brian Ward on the phonc. Cuff asked ifhe and friends could go
house, Ward agreed. Cuff told Ward that they would be there shortly. Cuff, Snook, Emerson and
ollering left Powell's house and went This was a home that Cuff had been to twice before
with Kovacs: Jerry George and Martin Mulrey go to 5 Ocean Blvd. on their own.

Cuffsaid he was there about and hour or so and played some drinking games. Cuff said he drank about 4 beers
at Ward's and one Kahalua and milk at the party in Stratham. Cuff said the marijuana in his urine was old and
from Friday night. Cuff said he had no drugs on Saturday night and he was not on any mt;dication at time
either. During this time he remembers the police shining their spot lights on the cars parked outside. Brian Ward
closed up the curtains, shut lights off and quieted everyone down until the police left.
Cuff said Katie Kovacs and the girls, and Jamie Bennett decided that they v,ranted to go to
Gilley's or across the street from Gilley's to another party. Cuff said that they all left the house and the next thing
he remembers is waking up at the Portsmouth Hospital. Cuff said he doesn't remember who left the house first or
even being outside.
Cuff said that Katie Kovacs has filled him in on the missing details.
Cuff stated he found out this night that Katie Kovacs used to be the girlfriend of Cullen Mutrie and this could be
the possible reason that Mutrie assaulted him.

I received several calls from Mr. Cuff this date. He told me that Nick was being released this date, however
they did find a concussion at the base of the skull.

scrapes are evident along the hood of the car. Will vicw car and take repo11 on 3/28/02.

At 1300 hrs. I took a taped statement from Katie Kovacs. She told me the following:
Kovacs arrived at the party earlier in the evening with Lindsey Nason and Lauren (LNU), cousin of Nason.
Cullen Mutrie arrives with David Mulrey. Kovacs spoke by cell phone to Cuff and he told her that he was
coming over. Cuff arrived to the party with Snook, Luke Mollering, Dan Emerson. Bennett,
Nason, and Lauren LNU leave the house and are outside sitting in Bennett's Ford Escort, parked in front of the
house in a metered spot. Cuff, Snook, Emerson and ;Vlollering with Kovacs are leaving the house together and
Cuff leaves first followed by Kovacs. The two start walking to the Escort. Kovacs then sees Mulrcy
1 ng to Snook and hit him in the face. Kovacs states this assault to thc best of her knowledge was
nprovoked. Kovacs states she then looked over and saw Cuff on the ground with Mutrie over him. Kovacs
watched Mutrie hit Cuff in the head twice with a fist. By this time she \vas able to get to Mutrie and pulled him

off of Cuff and separated the two. Kovacs said Cuff was on the ground bleeding. She went inside the house.
Cuff was brought into the house and put on the couch. He was attended to by the Paramedics and she went
downstairs and laid down in a bed. She said she was crying. She then was brought to the Hampton Police
Station where she filled out a written statement.
At 1506 hrs. I met with Brian Ward and took a taped statement. He told me that there was a gathering at his
house and a fight did break out. Ward told me that he did not witness the fight but after it was done Cuff was
lying on the ground outside. Someone told him to call the Paramedics and Ward called. Ward sa id that CLI ff was
brought into his house and placed on the couch until the Paramedics and Police arrived.
At 1730 hrs. I met with Jason Snook and took a taped statement. He told me the following:
He was with Nick Cuff and they were out for the night. Cuff spoke to Kovacs on his cell phone and Cuff told
Snook that they were going to "the house in Hampton" (Laler identified as 5 Ocean Blvd. rented by Brian Ward,
a place that Snook and Cuff had been to be/ore.)
Cuff, Snook, Emerson and Mollering arrive at 5 Ocean l3lvd. Approximately 0230 hrs. the four with Kovacs
leave the house.
Snook is jumped and hit in the face causing a possible broken nose, bloody nose and facial lacerations. Snook
says he was treated by the Hampton Fire Department personnel, however no run sheet was done. Snook states he
see who hit him, it happened so fast. Snook says he lost conciousness. When Snook came to, he went
where Cuff was lying and was hit another two times. Snook eventually makes it to Cuff and sees him
lying on the ground. Snooks makes it back into the house into the living room. CutI is brought inside and placed
on the couch. Snook says Brian Ward made a call to the Paramedics. The Paramedics and Police arrive and
Snook remembers putting Cuff on his side because he is vomiting up blood. The Paramedics treat and transport
Cuff and Snook came to the Police Station to fill out a statement. Snook told me he was apprehensive to fill out
any statement because he doesn't want to miss his May 16th enrollment date for the US Navy. Snook feels any
involvement by him would preclude him from active duty with the Navy.
3/28/02
I met with Mr. Cuff at the residence in Stratham and viewed 1\ick's car. Clearly visible on the hood are several
scratches and dents. The vehicle is registered to Nick and the inspection is current. The rest of the vehicle
remains in good physical appearance_
I also received a second rol1 of negatives from Mr. Cuffofphotos taken of Nick.
At 1:30 PM, I spoke with she told me the following:
She arrived at the party early before the guests came. Shortly before the fight broke out she left 5 Ocean Blvd.
and was in Jamie Bennet's car with Lindsey Nason, Lauren (Doe) Jamie Bennett. The car was parked left wheel
to curb and Cate was sitting in the passenger side of the vehicle. Cate said that Nick was talking with her when
Cullen came from the rear of Nick and jumped him then was on top of Nick and hitting him in the face. She was
....:..G and the Bennett car left the scene. Later she talked to some of the partygocrs to find out what happened

ulrey.Whenshe got outside everything was done. said she came back inside and Mutric came in shortly
behind her. She asked Mutrie ifhe was OK and Mutrie stated yes. Brian Ward then told the remaining
partygoers to leave. left with Mulrey. Mulrey drove her home.
Later that day she went to loes NY Pizza with Mutrie. She denies hearing any conversation about the fight from
Mutrie.
4/2/02
At 12:30 PM I met with and took a statement from Jamie Bennett. She told me that she went to 5 Oeean Blvd.
and right before the fight, she, Lindsey Nason, Lauren (Doe), Katie Kovacs, Nick CLIff were
leaving. She, Nason, (Doe) and were in the car and Cuff was talking to when Mutrie
came from behind and jumped Cuff. Bennett said that she saw Mutrie hit Cuff in the head and her first reaction
was to honk the hom to stop the fight; she did, the fight continued.
Bennett said she ran out of the car to see if Cuff was alright. She went to Cuff and tried to wake him up. His
eyes were half closed, she shook him and slapped his face but he was totally unresponsivc_ She could see blood
over his forehead.
She heard people yelling at her to get back in the car, she did. The occupants then told Bennett to drive, she stlid
she was afraid to run Cuff over, but she maneuvered the' car and they left. They went to a parking lot, parked and
Oalling people on their phones to see what was happcning.
en nett said that she did not drink any alcohol that night, she did not eat or drink at the party and was not
medicated.

I contacted Atty. Gillen and told him that I had a warrant in hand for Mutrie. He told me that before the end of
the day Mutrie would tum himself in. He further told me that his client would not answer any questions.
At 1556 hrs. this date Mutrie surrendered himseifat the station on the warrant. He was processed and bailed.

and r said yes. Mutrie stated that he understood and I told him that I would be talking directly to

4/8/02
( met with and spoke to Daniel Emerson, see transcripts. Emerson told me that he was at the Str8tham Party then
.vent to (he Hampton Party at 5 Ocean Blvd. Emerson told me that he was inside when several people went to
:he door cause something was going on outside. Emerson said that he pushed his way through and went out and
;aw Cufflying on the ground next to a car. Emerson said that he went over to Cuff who was lying motionless
.vith blood coming from his eye and mouth. Emerson said they tried to wake Cuffbllt he did not wake up.
3:merson said he and "the owner of the house", Brian Ward, carried Cuff inside and put him on the couch. Ward
for the ambulance. Emerson said that he was taken into protective custody. Emerson said he was drinking

State v. Cullen Mutrie
I, Officer WAYNE M YOUNG, of the Greenland Police Department, being duly sworn, hereby dep'8se and say;
1. That I'm presently employed by the Greenland Police Department and have been since 1999. Prior to being
employed by the Greenland Police Department I was employed by the Brentwood and Danville Police
Departments dating back to 1995. I'm currently a Patrol Officer and my duties include handling all classes of
crimes and I conduct my own investigations. I have had training classes from the New Hampshire Police
Standards and Training Council in prosecution, domestic violence investigations, child abuse investigations and
sexual assault investigations.
2. That on July 24, 2010 at approximately 7:21 P.M. Officer Hartmann and I were dispatched to a domestic
disturbance at 517 Post Rd in which Cullen Mutrie( was arrested for Simple Assault.
the female victim, was granted an emergency restraining order agalrfsfCillfen: from Judge Koroey
of the Salem District Court. A condition of the emergency restraining order was Cullen must relinquish his
, firearms.
4. That I had prior knowledge that Cullen was in possession of a shotgun during a call for service in which
Officer Simmons and I responded to his residence.
5. That I asked Cullen if he had 'any firearms and he said no. I inquired about the shotgun he had a few years
prior and he told me it was his fathers. I told Cullen I knew that his father had passed away and he said the
shotgun was at his mothers residence in Hampton Falls.
6. That told me she knew Cullen had at least five firearms inside the residence and his vehicle. She told me
Cullen usually has one on him, one in his vehicle, one in the living room(inside the coffee table) and a few in his
b.edroom.
7. That Cullen signed a consent form so we could retrieve his firearms. The residence was locked and Cullen
contacted his mother, Beverly Mutrie who responded to the scene with the keys to the residence.
8. That I entered the residence using the keys Beverly had provided me. The first place I went to was the living
room where told me Cullen keeps a firearm inside the coffee table. The coffee table was the type of table
which the top lifts up and things can be stored inside. I lifted the top of the coffee table and I immediately
a silver scale and a plastic bag which contained several vials. All the vials were in a liquid form except
which was powder. The labeling on the vials indicated that they were steroids. Since I found the steroids I
Immediately stopped my consent search for the firearms, exited the residence and secured it.
9. That Detective Kurkul drafted a search warrant for the residence which was granted byJudge Gardner out of

the Portsmouth District Court. The search warrant was for fIrearms and drugs.

10. That Detective Kurkul, OffIcer Hartmann and I executed the search warrant. That during the course of the
search, firearms, ammunition and steroids were confiscated per the search warrant. All the items were secured in
the cruiser, transported to the Police Station where there were entered into evidence and secured in the evidence
room.
11. That the vials were transported to the New Hampshire State Lab where they were tested. On January 18,
2011 the results were provided to the Police Department from the lab.
12. That the vials tested positive for the following steroids and quantities, 3.50 grams of the controlled anabolic
, steroid drug trenbolone acetate, a quantity of the controlled anabolic steroid drugs trenbolone acetate and
nandrolone decanoate, 8.46 grams of the controlled anabolic steroid drug nandrolone decanoate, 8.79 grams of
the controlled anabolic steroid drugs testosterone propionate, testosterone decanoate, testosterone isocaproate and
testosterone phenylpropionate, a quantity of the controlled anabolic steroid drug testosterone cypionate, 6.35
grams of the controlled anabolic steroid drug boldenone undeecylenate and 8.60 grams of the controlled anabolic
steroid drug stanozol.
Based upon the foregoing information, there is probable cause to believe that the defendant did commit a crime
of seven counts of Possession Of A ControlledlNarcotic Drugs pursuant to RSA 318-B2,I.
Wherefore, I request the issuance of an arrest warrant and an order for a duly authorized officer to take the
defendant and bring him before a court having jurisdiction.

made them aware of the incident. They told me to confiscate the firearms per the emergency restraining

I called Detective Cormier at the Police Department. I told him the emergency restraining order had been granted
and Cullen was ordered to relinquish his firearms and ammunition. I told him that the residence was locked and
asked him to speak to Cullen about providing us the keys. Cullen signed a consent form so we could retrieve his
firearms and ammunition. Cullen contacted his mother who was going to respond to the Police Department to
get the house key so the house could be unlocked.
A short time later, Cullen's mother:

arrived on scene. Beverly was confrontational and wanted to know why we had to go inside the residence.
Beverly said the property was hers and that the vehicles in the driveway were hers as well. Beverly started to ask
questions about the case and legality questions about a search warrant, etc. I told Beverly that I was under the
assumption that she came to the residence to let us in since it was all locked up. I told her Cullen had already
signed consent, that he has been living at the residence and driving both vehicles that were parked in the
driveway.
After a lengthy discussion, Beverly handed me the keys.

ed Cullen on his cell phone who was still at the Police Department. Beverly agreed to go back to the Police

Beverly left and Officer Russell and I unlocked the front door. I walked in the front door and hallway area which
leads to the living room which is to the right. I looked in this room first because told me Cullen keeps
firearms in that area. There was a coffee table in front of one of the couch's. It was a coffee table which the top
lifts up so I lifted it up. As soon as I lifted the coffee table I observed a silver scale and a plastic bag which
contained several vials. All the vials were in liquid form except one which was powder. I looked at the vials and
detennined them to be some type of steroids by the labeling. I placed the scale and plastic bag where I found it
and called Chief Maloney and Sergeant Sawyer. They told me to stop the search for the firearms, secure the
residence and apply for a search warrant.
I contacted:

and made him aware of the incident. Detective Kurkul told me he would respond to the Police Department and
begin working on the search warrant.
A short time later, Beverly returned with the vehicle keys. I told her that we were applying for a search warrant
and that we did not need to get in the vehicles at this time. Beverly began to question me regarding now applying
a search warrant and I told her we changed our minds. Beverly was confrontational and I told her the matter
not going to be discussed any further and asked her please not to interfere.
I requested Officer Russell stay at the residence while I respond to the Police Department to serve Cullen with the
emergency restraining order.
Once at the Police Department, I served Cullen with the order and I faxed it to NHSP(Headquarters). I

I also called and made her aware of Cullen's bail status and conditions.
Cullen inquired about pressing charges against for the damage to his vehicle. I provided Cullen with a
statement to fill out regarding the incident. I told Cullen to fill out a statement and return it to the Police
Department. I told him once we receive the statement, it will be reviewed and handled appropriately.
Cullen was told a search warraI?-t was being done for the residence as well as the vehicles. Cullen was told he
could not go inside the residence and vehicles until the search warrant was executed. Cullen inquired about
giving consent to search the vehicles for the firearms so he could drive one of the vehicles while the search
warrant was being executed. Cullen signed the consent form for the vehicles which were parked in the driveway.
I then spoke to Detective Kurkul and we decided not to search the vehicles that we would just include the
vehicles in the search warrant. Cullen was advised of out decision. '

Judge Gardner granted the search warrant and faxed it back to the Police Department.
Detective Kurkul and I responded to the residence and executed the search warrant.

6. Several boxes of ammunition, loose ammunition and ammunition in the magazines of the firearms.
Photographs of the firearms and the ammunition were taken in the area where they were located inside the
residence. The firearms and ammunition were secured in the trunk of the cruiser and transported to the Police
Department where it was secured in the evidence room.

Saturday July 24,2010 at approximately 9:30 pm I was contacted by Officer Young and asked to come in to
. st with completing a search warrant for 517 Post Rd the home of:
Cullen Mutrie
Officer Young informed me that he had arrested Mutrie for Simple Assault against his girlfriend and that he had
obtained an emergency order of protection for her from the on-call judge. As a part of that order the judge
completed the box that required Mutrie to relinquish all firearms and ammunition to a peace officer. OffIcer
Young knew that Mutrie had a shotgun in the past and the victim of the assault told Officer Young that there
were firearms in the house and that he generally keeps a pistol in his vehicle. After speaking with Mutrie Officer
Young had obtained written consent from Mutrie to enter his home for the purpose of removing firearms and
ammunition. Officer Young had entered the living room because this was area where he was told by the victim
that a firearm would be found. Officer Young had raised the top of a coffee table in the living room. When he did
this he saw a number of vials and a scale. From the bottles he saw Officer Young recognized the vials to be what
he knew as steroids. Officer Young stopped his search, secured the residence and returned to the police
department to secure a search warrant.
A search warrant was completed for the residence at 517 Post Rd to include the home, garage, and two vehicles
NH a 2006 BMW and NH a 2004 Chevy 2500 which were parked in the driveway. In the
search warrant and supporting affidavit I requested permission to search for any and all firearms and ammunition
as well as any and all illegal drugs and related equipment used in the consumption, processing or use of or sale of
drugs. The warrant and affidavit were faxed to Judge Gardner and after her review she issued the warrant for
and locations requested.
Once the warrant was in hand I went to 517 Post Rd and a search ,vas conducted for the items. Officer Young,
! Hartmann and myself conducted the search and the first room searched was the living room. Located on the top

i shelf of a book case which was built into the wall and located to your left as you walking the room were a :

all three weapons were loaded and in holsters. Located in a humidor on the second shelf were unlabeled bottles
with a amber liquid in them. Located in the coffee table was a yellow manila envelope containing 3 bottles of
HCG, 2 bottles of Deca 300, 1 bottle of Sustanon 300 and 1 bottle of Par abo Ian also in the coffee table was a
plastic bag with the following items in it : 2 bottles Parabolan, 1 bottle Uni Bold, 1 bottle Tcyp 300, 1 bottle
Sustailon, 1 bottle Trenbolone Mix 150, and 1 bottle Stanozolol
Located in the living room closet were a bag containing 3 cclml syringes and 20 gague x 1112 needles, also
Winchester 7.62 ammunition, and Remington 12 ga shotgun shells.
Located in the far right comer of the living room was a:

in a case unloaded with 2 magazines.

After completing the search on the house, we then moved the two vehicles in the driveway. When searching the
bed room we came upon keys to the truck. The truck was searched and nothing was found. We were unable to

that we could not get into the BMW. We asked that he respond and we would turn over the keys to the house and
he could open the BMW or we would be forced to tow the vehicle. A short time later Mutrie returned our call and
indicated that he would come to our location and give us access to the vehicle. After about 45 minutes Mutrie
drove by our location and opened the BMW by using the wireless remote to the vehicle and continued on not
stopping. The vehicle was checked and in the glove box of the vehicle were the following items:

just as the search of the vehicle was .completed Mutrie pulled up to the front of the house and stopped there. I
approached the vehicle and informed him that I would be going back inside the house to add the two items I
found in the BMW to the return list. Mutrie had asked if we found money in the kitchen drawer. I told him we did
! and that I would feel better if he came inside and confirmed that the money was there with me present. Mutrie

ed ifhe would be arrested ifhe he got out of the car. I told he maybe arrested at a later date but he would not
ow. Mutrie exited his vehicle and we went inside together. We walked to the drawer where the money was
ocated and he confrrmed it was there. I then added the two items and left the home leaving a copy of the warrant
with the return listing the items removed. When getting into my cruiser Mutrie came out and was standing on the

conducted on drugs we sent to them. When drugs were recovered they were believed to be anabolic steroid and
they were sent to the lab for confirmation. The report which will be attached identified the vials sent up as

I, Officer WAYNE M YOUNG, of the Greenland Police Department, being duly sworn, hereby depose and say;
1. That I'm presently employed by the Greenland Police Department andhave been since 1999. Prior to being
employed by the Greenland Police Department I was employed by the Brentwood and Danville police
Departments dating back to 1995. I'm currently a Patrol Officer and my duties include handling all classes of
crimes and I conduct my own investigations. I have had training classes from the New Hampshire Police
Standards and Training Council in prosecution, domestic violence investigations, child abuse investigations and
sexual assault investigations.
2. That on July 24, 2010 at approximately 7:21 P.M. Officer Hartmann and I were dispatched to a domestic
disturbance at 517 Post Rd in which Cullen Mutrie( 4-27 -82) was arrested for Simple Assault.
3. That the female victim, was granted an emergency restraining order against Cullen from Judge Korbey
of the Salem District Court. A condition of the emergency restraining order was Cullen must relinquish his
4. That I had prior knowledge that Cullen was in possession of a shotgun during a call for service in "\vhich

5. That I asked Cullen if he had any firearms and he said no. I inquired about the shotgun he had a few years
prior and he told me it was his fathers. I told Cullen I knew that his father had passed away and he said the
shotgun was at his mothers residence in Hampton Falls.
6. That told me she knew Cullen had at least five firearms inside the residence and his vehicle. She told me
Cullen usually has one on him, one in his vehicle, one in the living room(inside the coffee table) and a few in his
bedroom.
7. That Cullen signed a consent fonn so Vie could retrieve his firearms. The residence was locked and Cullen
contacted his mother, Beverly Mutrie who responded to the scene with the keys to the residence.
8. That I entered the residence using the keys Beverly had provided me. The first place I went to was the living
room where told me Cullen keeps a firearm inside the coffee table. The coffee table was the type of table
which the top lifts up and things can be stored inside. I lifted the top of the coffee table and I immediately
noticed a silver scale and a plastic bag which contained several vials. All the vials were in a liquid form except
one which was pOWder. The labeling on the vials indicated that they were steroids. Since I found the steroids I
stopped my consent search for the firearms, exited the residence and secured it.
9. That Detective Kurkul drafted a search wan-ant for the residence which was granted by Judge Gardner out of

the Portsmouth District Court. The search warrant was for firearms and drugs.
10. That Detective Kurkul, Officer Hartmann and I executed the search "\varrant. That during the course of the
search, firearms, ammunition and steroids were confiscated per the search warrant. All the items were secured in
the cruiser, transported to the Police Station where there were entered into evidence and secured in the evidence
room.
11. That the vials were transported to the New Hampshire State Lab where they were tested. On January 18,
2011 the results were provided to the Police Department from the lab.
12. That the vials tested positive for the following steroids and quantities, 3.50 grams of the controlled anabolic
steroid dmg trenbolone acetate, a quantity of the controlled anabolic steroid drugs trenbolone acetate and
nandrolone decanoate, 8.46 grams of the controlled anabolic steroid drug nandrolone decanoate, 8.79 grams of
the controlled anabolic steroid dmgs testosterone propionate, testosterone decanoate, testosterone isocaproate and
testosterone phenylpropionate, a quantity of the controlled anabolic steroid drug testosterone cypionate, 6.35
grams of the controlled anabolic steroid drug boldenone undeecylenate and 8.60 grams of the controlled anabolic
steroid drug stanozol.

of seven counts of Possession Of A ControlledlNarcotic Drugs pursuant to RSA 318-B2,I.

for analysis. The selected vial was found to contain 8.46 grams of yellow
liquid the analysis of Which documented the presence of the contr.olled
anabolic steroid drug nandrolone decanoate.
Three (3) glass vials, each containing a brown liquid, labeled "Parabolan;
trenbolone cyclohexylmethylcarbonate 10 mi" one (1) of which was
selected for analysis. Ti,e selected vial was found to contain 8.38 grams
of brown liquid the analysis of which indicated the presence of the
controlled anabolic steroid drug trenbo)one cyclohexylmethylcarbonate.
Due to the lack of a known laboratory reference standard this drug could
not be confirmed.

NOW COMES the State of New Hampshire, by and through the Rockingham County
Attorney's Office, with this Assented-To Motion to Continue, and in support thereof states as
follows:
1. The defendant stands charged with four counts of Possession of a Controlled Drug.
2. This matter is scheduled for a plea and sentencing hearing on January 20,2012 at 9:00 a.m.
3. Undersigned counsel for the State will be out of the office and therefore unavailable the
morning of January 20, 2012 due to a previously scheduled commitment.
4. Accordingly, the State respectfully requests that the Court continue the plea and sentencing
hearing in this matter.
5. The defendant in this matter is not incarcerated.
