7503.1Scopeandpurpose
ThisSubpartshallhavethesamepurposeassetforthinsection750 1.1.ThisSubpartappliestoallactivitiesanddischargesassociated withallphasesofhighvolumehydraulicfracturing(HVHF)operations.

7503.2Definitions
(a)Thedefinitionsinthissectionareinadditiontothoselistedin section7501.2.Termsnotdefinedhereinshallbeasdefinedbythe contextinwhichtheyareused. (b)WheneverusedinthisPart,thefollowingtermswillhavethe meaningssetforthbelow: (1)Accessroadmeansaroadconstructedtothewellsitethat providesaccessduringthedrillingandoperationofthewell. (2)ChemicalAdditivemeansaproductcomposedofoneormore chemicalconstituentsthatareaddedtoaprimarycarrierfluidto modifyitspropertiesinordertoformhydraulicfracturingfluid. (3)Aquifermeansazoneofpermeable,watersaturatedmaterial belowthesurfaceoftheearthcapableofproducingusable quantitiesofwater. (4)Bermmeansastructuremeanttocontainfluidswithinadefined area. (5)BTEXisthetermusedforbenzene,toluene,ethylbenzene,and xylenevolatilearomaticcompoundstypicallyfoundinpetroleum product,suchasgasolineanddieselfuel. (6)BUDmeansaBeneficialUseDeterminationissuedby NYSDEC'sDivisionofMaterialsManagementinaccordancewith6 NYCRR3601.15. (13)ConstructionSWPPPmeansthestandalonestormwater pollutionpreventionplanthatincludesbestmanagementpractices andotherrequirementstocontrolthepollutionofstormwaterduring constructionandpostconstruction. (14)Cuttingsorsamplesmeanschipsofrockcutbythedrillbitand broughttothesurfacebythedrillingfluid.Theyindicatetothe wellsiteworkerswhatkindofrocksarebeingpenetratedandcan alsoindicatethepresenceofoilorgas. (15)Drillingfluidmeansmud,water,orairpumpeddownthedrill stringwhichactsasalubricantforthebitandisusedtocarryrock cuttingsbackupthewellbore.Itisalsousedforpressurecontrolin thewellbore. (16)Finalstabilizationmeansallsoildisturbanceactivitieshave ceasedandauniform,perennialvegetativecoverwithadensityof eighty(80)percenthasbeenestablishedorotherequivalent stabilizationmeasures. (17)Floodplainmeansthe100yearfloodplainasdefinedbythe FederalEmergencyManagementAgency(FEMA). (18)Flowbackmeansliquidsandsolidsproducedduringinitial completionandcleanupofthewellorcleanupofawellfollowing refractureorworkoverofawell. (19)Formationfluidsmeansfluidsinaliquidorgaseousphysical state,presentwithintheporespaces,fractures,faults,caverns,or anyotherspacesofformations,whetherornotnaturallyoccurring orinjectedtherein. (20)Freeboardmeanstheheightabovetherecordedhighwater markofastructuredesignedtoholdwater.Inthecaseofpits, freeboardistheextradepthleftunusedtopreventanychanceof overflow. (22)HighVolumeHydraulicFracturing(HVHF)meanshydraulic fracturingusinggreaterthan300,000gallonsofwatercumulatively intheHVHFPhase. (23)HighVolumeHydraulicFracturingPhase(HVHFPhase) means1)thephasebetweentheconstructionprojectcompletion andtheProductionPhaseand2)anysubsequentrestimulation event.Thisincludeswelldrilling,highvolumehydraulicfracturing, wellstimulationandonsitehandlingandtreatmentofreturnflow. (24)HighVolumeHydraulicFracturingOperations(HVHF Operations)means:(i)ConstructionPhase(ii)HVHFPhaseand (iii)theProductionPhase. (25)HVHFgeneralpermitmeansaSPDESpermitissuedpursuant tosection7503.21ofthisPart. (26)HVHFSPDESpermitmeansanindividualorgeneralSPDES permitforHVHFactivities. (27)HVHFSWPPPmeansthestormwaterpollutionpreventionplan requiredbyaSPDESpermitthatincludesstructuralandnon structuralbestmanagementpracticesandotherrequirementsto controlthepollutionofstormwaterduringtheHVHFPhaseandthe ProductionPhase. (28)Highdensitypolyethylene(HDPE)meansapolyethylene plasticthatisresistanttomostchemicals,insolubleinorganic solvents,andhashighimpactandtensilestrength. (29)Horizontaldrillingmeansthedeviationoftheboreholefrom verticalsothattheboreholepenetratesaproductiveformationina mannerparalleltotheformation. (30)Hydraulicfracturingmeansthepumpingofafluidwithproppant tocreateandmaintainfracturesasastimulationmethodto increaseproductivitybutshallnotincludeworkoveroperations. (31)Hydrocarbondevelopmentmeanstheactivityassociatedwith thesiting,drilling,casing,cementing,stimulationandcompletionof wells,includingbutnotlimitedtounconventionalnaturalgas developmentwells,undertakenforthepurposeofextractionof liquidorgaseoushydrocarbonfromgeologicformations. (32)NaturallyOccurringRadioactiveMaterials(NORM)meansthe radioactivitythatcanexistnaturallyinnativematerials,likesome shales,andmaybepresentincertainwastesfromawell. (33)Operationalcontrolmeansauthorizationtomakemanagement decisionsgoverningtheHVHFoperations. (34)Owner/Operatormeanstheperson,personsorlegalentity

whichownsorleasesthepropertyonwhichtheHVHFoperations areoccurringand/oranentitythathasoperationalcontroloverthe HVHFoperations,includingtheabilitytomakemodificationstothe operationsandauthorizationtomakemanagementdecisionsto assurelongtermenvironmentalcompliancewithenvironmental lawsandregulations. (35)Partialsitereclamationhasoccurredafterallplannedwellsat thewellpadhavebeencompletedandaDepartmentinspector verifiesthatthedrilling/fracturingequipmenthasbeenremovedpits usedforthoseoperationshavebeenreclaimedandsurface disturbancesnotassociatedwithproductionactivitieshavebeen scarifiedorrippedtoalleviatecompactionpriortoreplacementof topsoil.Reclaimedareasmustbeseededandmulchedaftertopsoil replacementandvegetativecoverreestablishedthatwillultimately returnthesitetopreconstructionconditions. (36)Pluggedandabandoned(plugandabandon)meansto permanentlycloseawellwithcementplugs. (37)Primary/Principalaquifers (i)Primaryaquifersarehighlyproductiveaquiferspresentlybeing utilizedassourcesofwatersupplybymajormunicipalwater supplysystems. (ii)Principalaquifersareaquifersknowntobehighlyproductiveor whosegeologysuggestsabundantpotentialwatersupply,but whicharenotintensivelyusedassourcesofwatersupplyby majormunicipalsystemsatthepresenttime. (38)Productmeansamaterialahydraulicfracturingfluidthatis manufacturedusingpreciseamountsofspecificchemical constituentsandisassignedacommercialnameunderwhichthe materialissoldorutilized. (39)Productionbrineorproducedwatermeansliquidsco producedduringoilandgasproduction. (40)Productioncasingmeanscasingsetaboveorthroughthe producingzonethroughwhichthewellproduces. (41)ProductionphasemeansthephaseaftertheHVHFPhase throughterminationofcoverageundertheHVHFgeneralpermit. ThisphasebeginswhentheHVHFphasehasbeencompletedfor allwellsplannedforthatwellpadandpartialsitereclamationhas beencompleted. (42)Proppantmeansagranularsubstance(sandgrains,aluminum pellets,orothermaterials)thatiscarriedinsuspensionbythe fracturingfluidandthatservestokeepthecracksopenwhen fracturingfluidiswithdrawnafterafracturetreatment. (43)Reclaimed/Reclamationmeanstherehabilitationofadisturbed

areatomakeitacceptablefordesignateduses.Thisnormally involvesregrading,replacementoftopsoil,revegetation,andother worknecessarytorestorethesitetopreconstructionconditions. (44)Reservepitmeansamudpitinwhichasupplyofdrillingfluid hasbeenstored,orawastepit,usuallyanexcavatedpit.Itmaybe linedtopreventsoilcontamination. (45)Reservoirmeansawaterbodydesignatedforuseasa dedicatedpublicwatersupplyandisclassifiedasAorAAinits entirety,per6NYCRRParts800941. (46)Stimulationmeanstheactofincreasingawell'sproductivityby artificialmeanssuchashydraulicfracturing,acidizing,and shooting. (47)Storagemeanstheholdingofamaterial,containeror equipmentatasite,notincludingtheamountofmaterialbroughtto thesiteforimmediateuse. (48)TDSmeansTotalDissolvedSolids. (49)Unfilteredsurfacewatersuppliesmeansthosepublicwater suppliesthattheUSEPAandNewYorkStateDepartmentofHealth havedeterminedmeettherequirementsofthe"InterimEnhanced SurfaceWaterTreatmentRule"(IESWTRule)forunfilteredwater supplysystems.TheIESWTRuleisaDecember16,1998 amendmenttotheSurfaceWaterTreatmentRulethatwas originallypromulgatedbyEPAonJune29,1989.InNewYorkState, thisincludestheNewYorkCityDrinkingWaterSupplyWatershed andtheSkaneatelesDrinkingWaterSupplyWatershed. (50)Watershedmeansanareaoflandthatdrainsintoabodyof water,suchasariver,lake,reservoir,estuary,seaorocean. (51)Wellpadmeanstheareadirectlydisturbedduringdrillingand operationofagaswell. (52)WellSitemeansthewellpadandaccessroads,equipment storageandstagingareas,vehicleturnarounds,andanyother areasdirectlyorindirectlyimpactedbyactivitiesinvolvingawell. (53)Wellboremeansaboreholetheholedrilledbythebit.A wellboremayhavecasinginitoritmaybeopen(uncased)orpart ofitmaybecased,andpartofitmaybeopen. (54)Wellheadmeanstheequipmentinstalledonthewellboreatthe groundsurface.Awellheadincludessuchequipmentasthecasing headandtubinghead. (55)WorkOvermeansanydownholeoperationinanexistingwell thatisdesignedtosustain,restoreorincreaseefficiency,makethe wellsafer,orcorrectaknownorpotentialenvironmentalhazard.

7503.3ProhibitedActivitiesandDischarges

(a)Theprohibitionsinthissectionareinadditiontothoselistedin section7501.3.ThefollowingHVHFactivitiesanddischargesare herebyprohibited,andnoSPDESpermitshallbeissuedauthorizing anysuchactivityordischarge.Alldistancesnotedbeloware measuredfromtheclosestedgeoftheHVHFwellpadtoprovidea marginofsafety. (b)HVHFoperationsonthegroundsurfaceareprohibitedinthe followingareas: (1)within4,000feetof,andincludingthe,unfilteredsurfacewater supplywatersheds (2)within500feetof,andincluding,aprimaryaquifer (3)within100yearfloodplainsand (4)within2,000feetofanypublic(municipalorotherwise)water supply,includingwells,reservoirs,naturallakesormanmade impoundments,andriverorstreamintakes.

7503.4Requirementtoobtainapermit
(a)Therequirementsinthissectionareinadditiontothoselistedin section7501.4. (b)TheowneroroperatorofanHVHFwellshallsubmitanapprovable applicationforanHVHFSPDESpermitoranotificationtoobtain coverageunderageneralSPDESpermitforHVHFoperationstothe Department.Tobeapprovable,theapplicationmustincludethe followingcertifications,documentation,orwherenotedanalternative planapprovablebytheDepartmentthatisequallyprotectiveofwater resources: (1)Documentationfromalegallypermissibledisposalfacilitythat availablecapacityexistsforthedisposaloftheprojectedamountof flowbackfluidandproductionbrineoverthelifeofthewell,and/or identificationandcertificationofavailablecapacityforalternative disposallocations (2)Certificationthatclosedloopdrillingwillbeusedoran approvablealternativeplanthatwillensuretherewillbeno significantadversewaterqualityimpactsrelatedtothedisposalof pyriterichMarcellusShalecuttingsifanonsitepitisapprovedby theDepartment (3)CertificationthatHVHFflowbackfluidswillnotbedirectedtoor storedinapitorimpoundment (4)Certificationthatwithrespecttoonsitepits: (i)suchpitswillbeusedsolelyforfreshwaterandcuttingsthat resultfromdrillingconductedwithairorfreshwater, (ii)forsinglepitsavolumeof250,000gallonswillnotbe exceededandformultiplepitsononetractorrelatedtractsof

landatotalvolumeofallpitswillnotexceed500,000gallons, (iii)totheextentpitsareconstructedinunconsolidatedmaterials, beveledwalls(45degreesorless)mustbeutilized, (iv)thesidewallsandbottomsofpitsarefreeofobjectscapable ofpuncturingorrippingtheliner, (v)thereissufficientslackinthelinerusedinsuchpitsto accommodatestretching, (vi)suchpitlinershaveaminimum30milthickness, (vii)suchpitlinersareinstalledandseamedinaccordancewith themanufacturer'sspecifications,and (viii)pitsareconstructed,coated,orlinedwithmaterialsthatare chemicallycompatiblewiththesubstancestoredandthe environment (5)Certificationthatallwastefluidswillberemovedfromthe wellpadandassociatedstorageareasadjacenttothewellpadno morethan45daysafterstimulationofeachwellunlessotherwise approvedbytheDepartmentaspartofarecyclingplan (6)UnlessanalternativeplanisapprovedbytheDepartment, certificationthatHVHFoperationswillbeconductedonlywherethe topofthefracturezoneatallpointsalongtheproposedlengthof thewellboreisgreaterthanboth2,000feetbelowthesurfaceand 1,000feetbelowthebaseoffreshgroundwater (7)Appropriatedocumentationshowingthatanevaluationof availablealternativechemicaladditiveproductshasbeen conducted.Theevaluationmustbewrittenandprovidedtothe Department.Atminimum,theevaluationmustbeinconformance with7503.11(e)(1)(i)and (8)Certificationthattheapplicantwillutilizechemicaladditive productsthatareefficaciousexhibitreducedaquatictoxicity,and poselessrisktowaterresourcesandtheenvironmentor,asan alternative,documentationtotheDepartment'ssatisfactionthatthe availablealternativeproductsarenotequallyeffectiveorfeasible.

7503.5Exceptions
(a)Theregulationsinthissectionareinadditiontothoselistedin section7501.5. (b)TheDepartment'sdeterminationunderSection7501.5(a)(6)(ii) thatgroundwaterorsurfacewaterqualitywillnotbedegradedshallbe basedinpartuponthecertificationssubmittedincompliancewithand pursuanttosection7503.4.TheDepartmentmaychangeany previouslyissueddeterminationintheeventthatthepermitteefailsto implementanymeasuredescribedinthecertificationssubmittedin compliancewith7503.5.

7503.6ApplicationstoobtainindividualHVHFSPDES permits
Therequirementsinthissectionareinadditiontothoselistedin section7501.6. (a)PriortoobtaininganHVHFSPDESpermit,anowneroroperator mustfirstdevelopaComprehensiveSWPPP,whichincludesboth theConstructionSWPPPandHVHFSWPPP. (b)Allofthefollowingcriteriamustbesatisfiedinorderforanowner oroperatortoobtainanHVHFSPDESpermit: (1)ProjectreviewpursuanttoSEQRAhasbeensatisfied,where applicable (2)Whererequired,allnecessaryDepartmentpermitssubjectto theUniformProceduresAct(UPA)havebeenobtained,unless otherwisenotifiedbytheDepartmentpursuanttoPart621ofthis Titleand (3)AcompleteNoticeofIntent,whichcontainsthewellpermit AmericanPetroleumInstitute(API)number,hasbeensubmittedto theDepartmentbytheowneroroperator. (c)AnowneroroperatorshallnotcommencetheConstructionPhase untilitsauthorizationtodischargeundertheHVHFSPDESpermitis effective. (d)AnowneroroperatorcannotbegintheHVHFPhaseuntila certificationissubmittedtotheDepartmentprovidingnotificationthat theConstructionPhaseiscomplete. (e)AnowneroroperatorcannotbegintheProductionPhaseuntila certificationissubmittedtotheDepartmentprovidingnotificationthat theHVHFPhaseiscomplete.

Theregulationsinthissectionareinadditiontothoselistedinsection 7501.11. (a)TheConstructionSWPPPshallincludeerosionandsediment controlpracticesdesignedinconformancewiththeDepartment's technicalstandards(7503.24ofthisPart)ortheequivalent. (b)Theowneroroperatormustensurethatallerosionandsediment controlpracticesandallpostconstructionstormwatermanagement practicesidentifiedintheConstructionSWPPParemaintainedin effectiveoperatingconditionatalltimes. (c)Theowneroroperatormustensurethat,wherepostconstruction stormwatermanagementpracticesarerequired,suchpracticesare operatedandmaintaineduntiltheNoticeofTerminationissubmitted totheDepartment. (d)Forconstructionactivitiesthatrequirepostconstruction stormwatermanagementpractices,priortosubmittingthefinalNotice ofTerminationtotheDepartment,theowneroroperatormustensure oneofthefollowing: (1)thepostconstructionstormwatermanagementpractice(s)and anyrightofway(s)neededtomaintainsuchpractice(s)havebeen deededtothemunicipalityinwhichthepractice(s)islocated (2)anexecutedmaintenanceagreementisinplacewiththe municipalitythatwillmaintainthepostconstructionstormwater managementpractice(s) (3)forpostconstructionstormwatermanagementpracticesthat areprivatelyowned,theowneroroperatorhasmodified,orcaused tobethemodified,thedeedofrecordtoincludeadeedcovenant thatrequiresoperationandmaintenanceofthepractice(s)in accordancewiththeoperationandmaintenanceplanor (4)forpostconstructionstormwatermanagementpracticesthat areownedbyapublicorprivateinstitution(e.g.school,college, university),orgovernmentagencyorauthority,theowneror operatorhaspolicyandproceduresinplacethatensureoperation andmaintenanceofthepracticesinaccordancewiththeoperation andmaintenanceplan. (e)TheHVHFSWPPPmust,ataminimum,includetheHVHF SWPPPGeneralRequirementslistedinsubparagraph(1)below, StructuralBestManagementPractices(BMPs),NonstructuralBMPs, andActivitySpecificSWPPPRequirements. (1)Thefollowingconditionsapplytoallownersoroperatorsof HVHFoperations: (i)HVHFOperationFluidChemicalAdditivesToreducethe potentialforHVHFchemicaladditivestoimpactwaterresources, theowneroroperatorshalldevelopandevaluatealternativesfor

theproposedHVHFadditivesthatareefficaciousbutwhich exhibitreducedaquatictoxicityandposelessrisktowater resourcesandtheenvironment.Inevaluatingthealternative additives,theowneroroperatorshallconsiderthefollowing criteria:(a)theimpacttotheenvironmentcausedbytheavailable alternativeadditiveifitremainsintheenvironment(b)the toxicity,mobilityandvolumeofavailablealternatives(c)the persistenceintheenvironmentoftheavailablealternative(d)the effectivenessoftheavailablealternativetoachievedesired resultsintheengineeredfluidsystemand(e)theeconomicand technicalfeasibilityofimplementingtheavailablealternative. (ii)HVHFChemicalAdditivesUsedonSiteTheowneror operatormustmaintainalistoftheHVHFadditives (volumes/amountsofallchemicals/additivesusedforeachHVHF event). (iii)ProperTransportandDisposalofWastewaterToensure propertransportanddisposalofwastewaterassociatedwiththe HVHFPhaseandtheProductionPhase,theowneroroperator shalloperateinaccordancewiththeapprovedFluidDisposal PlanrequiredbytheDepartment. (iv)ConstructionProjectCompletionTheowneroroperator shall,priortocommencingtheHVHFPhase,(a)developand implementmeasurestoensureallconstructionactivities identifiedintheConstructionSWPPPhavebeencompleted,(b) ensurethatallareasofdisturbancehaveachievedfinal stabilization,(c)ensurethatalltemporary,structuralerosionand sedimentcontrolmeasureshavebeenremoved,and(d)ensure thatallpostconstructionstormwatermanagementpractices havebeenconstructedinconformancewiththeConstruction SWPPPandareoperational. (v)SecondaryContainmentTopreventthedischargeof hazardoussubstances,theowneroroperatorshallprovide, implement,andoperatesecondarycontainmentmeasures.Such secondarycontainmentshallbe:(a)designedandconstructedin accordancewithgoodengineeringpractices,(b)constructed, coatedorlinedwithmaterialsthatarechemicallycompatiblewith theenvironmentandthesubstancestobecontained,(c)provide adequatefreeboard,(d)protectedfromheavyvehicleor equipmenttrafficandhaveavolumeofatleast110percentof thelargeststoragetankwithinthecontainmentarea. (vi)PartialSiteReclamationTheowneroroperatorshall developandimplementmeasurestoensureproperand adequatecompletionoftheHVHFPhase.PartialSite Reclamationwillbecompletedonlyuponverificationbythe Departmentthattheequipmentandmaterialsassociatedwith drilling/fracturinghavebeenremovedandpitsusedforthose

operationshavebeenreclaimedinaccordancewiththeHVHF SWPPPrequirements. (vii)PlugandAbandonToensureadequateclosureofgas wells,andtoaddresspollutantsrelatedtothepluggingofthegas wells,theowneroroperatormustplugandabandonthegas wellspursuantto6NYCRRPart555,priortosubmittingafinal NoticeofTermination.Theowneroroperatorshallincludesuch closurerequirementsintheHVHFSWPPPandmake modificationstotheHVHFSWPPPasnecessary. (f)Theowneroroperatorshallensurethatallflowbackandproduction fluidsarereusedordisposedofinaccordancewithapplicablestate andfederallaws. (g)TheowneroroperatormusthaveaSpillPreventionControland CountermeasurePlan(SPCC)onsitethroughallphasesoftheHVHF operation(ConstructionPhase,HVHFPhase,andProductionPhase). TheSPCCplanmustincludeanexplanationofexistingorplanned materialhandlingprocedures,storagerequirements,secondary containment,andequipment(e.g.,diversionvalves),thatareintended tominimizespillsorleaksatthesite.Measuresforcleaningupspills orleaksmustbeconsistentwiththeproceduresforpetroleumbulk storage,chemicalbulkstorageorhazardouswastemanagementin theEnvironmentalConservationLawandimplementingregulations. QuantitiesandtypesofequipmentspecifiedintheSPCCshallbe presentonsiteatalltimes. (h)Aclosedlooptanksystemmustbeusedinsteadofareservepit tomanagedrillingfluidsandcuttingsforanyofthefollowing:(i) horizontaldrillingintheMarcellusShaleunlessanacidrockdrainage mitigationplanforonsiteburialofsuchcuttingsisapprovedbythe Departmentand(ii)anydrillingrequiringcuttingstobedisposedof offsite,asprovidedinPart360ofthisTitle,includingatalandfill. (i)Flowbackwaterisprohibitedfrombeingdirectedtoorstoredinany pitorimpoundment.Coveredwatertightsteeltanksorcovered watertighttanksconstructedofanothermaterialapprovedbythe Departmentarerequiredforflowbackhandlingandcontainmenton thewellpad.Flowbackwatertanks,pipingandconveyances, includingvalves,mustbeofsufficientpressureratingandbe maintainedinaleakfreecondition.Flowbackwaterrecoveredafter highvolumehydraulicfracturingoperationsmustbetestedforNORM priortoremovalfromthesite.FluidsrecoveredduringtheProduction Phase(i.e.,productionbrine)mustbetestedforNORMpriorto removal,andthegroundadjacenttothetanksmustbemeasuredfor radioactivity.Alltestingmustbeinaccordancewithprotocols satisfactorytotheNewYorkStateDepartmentofHealth. (j)Flowbackwaterandproductionbrinemustbedisposed,recycled orreusedinamannerapprovedbytheDepartment.Transportofall

7503.12DisposalofHVHFflowbackandproduction water
(a)TheHVHFpermitteemustdemonstratethatallflowbackwaterand productionbrinegeneratedbythefacilitywillbetreated,recycled,or otherwiseproperlydisposedofovertheprojectedlifeofthewell.'The projectedlifeofthewell'isdefinedastheperiodoftimestartingwith theinitialdrillingofthewellboreandendingwiththepropersealing andabandonmentofthewellinaccordancewiththeclosure requirements.OnceactiveHVHFoperationsatthesitehaveceased andthegaswell(s)areintheproductionphase,thepermitteemust continuetoproperlycollectanddisposeofallproductionbrine generatedatthesite. (b)AllHVHFpermitapplicationsmustincludeaFluidDisposalPlan, subjecttoDepartmentalreviewandapproval,fordisposalofflowback waterandproductionbrine.TheFluidDisposalPlanshallassure compliancewiththenarrativerequirementsin7503.5(a)overthelife ofthewell,andshallinclude: (1)acertificationbyaproperdisposalfacilitythatavailablecapacity existsatthatfacilityforthedisposaloftheprojectedamountof flowbackandproductionbrineoverthelifeofthewell, (2)identificationandcertificationbytheHVHFpermitteeof alternativeorcontingentdisposallocation(s)withsufficientcapacity toacceptthegeneratedwastewateroverthelifeofthewell (3)projectedconcentrationsofchemicalconstituentsofthe flowbackandproductionbrineoverthelifeofthewell,basedupon additivesused,wellsampling,anddatafromsimilarwells. (4)identificationofallchemicaladditiveproductstobeused,by productname,purpose,andtype,proposedpercentbyweightof water,proppantsandeachchemical,andtheanticipatedvolumeof eachadditiveproductproposedforuse (5)MaterialSafetyDataSheets(MSDS)foreveryadditiveproduct proposedforuse,unlesstheMSDSforaparticularproductis alreadyonfilewiththeDepartmentasaresultofpriordevelopment orwastransmittedtotheDepartmentduringtheapplication processforapreviouswellpermitand (6)Exactchemicalcompositionofanyadditionaladditiveswhich havenotyetbeenproposedforusebeforetheDepartment. (c)Permitapplicationswhichdonotincludetheinformationlistedin (b)willbedeemedincomplete.

(d)Thedisposaloptionsforproductionbrineandflowbackarelisted below. (1)Theprovisionslistedbelowapplytooffsitedisposalatpublicly ownedtreatmentworks: (i)SPDESpermitsareissuedtowastewaterdischargers, includingtreatmentfacilitiessuchasPublicallyOwnedTreatment Works(POTWs)operatedbymunicipalities,inaccordancewith Sections7501and7502ofthisPart. (ii)TheDepartmentsharespretreatmentprogramoversightwith theEPA.IndirectdischargestoPOTWsareregulatedby6 NYCRR7502.9(b),NationalPretreatmentStandards,which incorporatesbyreferencetherequirementssetforthunder40 CFRPart403,"GeneralPretreatmentRegulationsforExisting andNewSourcesofPollution." (iii)Inaccordancewith6NYCRR7502.9,40CFRPart403, and40CFR122.42,NewYorkStatePOTWpermitteeswith industrialpretreatmentorminipretreatmentprogramsare requiredtonotifytheDepartmentandUSEPAofnewdischarges orsubstantialchangesinthevolumeorcharacterofpollutants dischargedtothepermittedPOTW. (iv)APOTWmusthaveanapprovedpretreatmentprogram,or minipretreatmentprogram,developedinaccordancewiththe abovereferencedregulationsinordertoacceptindustrial wastewaterfromnondomesticsourcescoveredby PretreatmentStandardswhichareindirectlydischargedintoor transportedbytruckorrailorotherwiseintroducedintoPOTWs. TheDepartmentmust,priortoindirectdischarge,determineif theSPDESpermitneedstobemodifiedtoaccountforthe proposeddischarge,changeorincrease. (v)Flowbackwaterandproductionbrinefromwellspermitted pursuanttothisPartmaybeacceptedbyPOTWsonlywhere suchPOTWshaveapprovedpretreatmentorminipretreatment programsinsubparagraphs(iii)and(iv)ofthisparagraph. (vi)Priortobeingallowedtoacceptproductionbrineand flowback,thePOTWmustperformaheadworksanalysisforthis wastewatersourceandsubmitsuchanalysistotheDepartment andEPAforapproval.Suchwastewatermayonlybeaccepted bythePOTWiftheheadwordsanalysismeetstherequirements of40CFRPart403andtheStatePollutantDischargeElimination System(SPDES)permitforsuchPOTW.Theheadworks analysismustdemonstrate,amongotherthings,thatthePOTW iscapableofremovingthecontaminantsexpectedtobepresent intheflowbackwaterandproductionbrine,includingbutnot limitedtoTotalDissolvedSolids,NORM,barium,bromides, BTEX,andchemicalspresentintheadditivesusedinthe

developmentofthewells.Theheadworksanalysisprocess includesthefollowingsteps: (a)uponsubmittalandapprovaloftheheadworksanalysis,the DepartmentmaymodifythePOTW'sSPDESpermittoinclude appropriatemonitoringandeffluentlimitsforthiswastewater source.TheSPDESpermitforthePOTWshallinclude specificdischargelimitationsandmonitoringrequirements, includingroutinereportingofmonitoringresults (b)TheDepartment'sproceduresforPOTWacceptanceof HVHFwastewaterdischargesaredetailedinDivisionofWater GuidanceDocument1.3.8.1,GuidanceforAcceptanceof HVHFWastewaterbyPOTWs (c)Thepermitteemaydischargeflowbackwaterand productionbrinetotheheadworksofaPOTWonlyifsuch POTWhasundertakenanapprovedheadworksanalysisand modifieditsSPDESpermitinaccordancewithsubparagraphs (i)(viii)ofthisparagraph.Eachdischargeofflowbackwater andproductionbrinetotheheadworksofthePOTWshall includethefollowingdocumentation: 1.Themanifeststatingthesourcewellofthewastewater, theidentityoftheHVHFpermittee,andallchemicalsusedin additivesinthehydrofracturingofthewell 2.Thevolumeofwastewatertobedischargedand 3.AnassayoftheconcentrationsofHVHFchemicals present,includingTDS,NORM,andBTEX. (vii)ShouldthePOTWmeetallrequirementsofthissubpart,any flowbackwaterandproductionbrinetreatedbysuchPOTW mustbeintroducedtotheheadworksofthePOTWandreceive fulltreatmentunlessotherwiseexpresslyapprovedbythe Department. (viii)ThePOTW,atitssolediscretion,mayrefusetoacceptany sourceofHVHFwastewaterandmayconsiderthe characterizationoftheHVHFwastewater,lackofrequiredHVHF wastewatersourcedocumentation,inspectionoftheHVHF wastewater,orotherverifiableevidencethattheHVHF wastewatermaycauseorcontributetoaviolationofthe permittee'sSPDESpermitconditions.Shouldsuchrefusal occur,theHVHFwastewatershallbesenttothecontingent disposallocationidentifiedintheHVHFpermittee'sFluidDisposal Plan. (ix)ThePOTWmustdemonstratethatithasanapproved methodofresidualsdisposalincompliancewithParts360and 364ofthisTitle.

(2)Theprovisionsbelowapplytooffsitedisposalatprivatelyowned industrialtreatmentfacilities: (i)Applicationandpermitdevelopmentrequirementsforprivately ownedoffsiteHVHFtreatmentfacilitiesaresimilartothose requiredforotherindividualSPDESpermitteesaslistedin Sections7501.6through7501.20ofthisPart.Operationof theseFacilitiesshallbeincompliancewithsection7502, OperatingInAccordancewithaSPDESPermit. (ii)Eachdischargeofflowbackwaterandproductionbrineto thesetreatmentfacilitiesshallincludethefollowing documentation: (a)ThemanifeststatingthesourcewelloftheHVHF wastewater,identityoftheHVHFpermittee,andtheHVHF chemicalsusedinthehydrofracturingofthewell,aswellas anyotherinformationrequiredunder6NYCRRPart560 (b)ThevolumeofHVHFwastewatertobedischarged,both perunittimeandtotalvolumefromthatsourceand (c)AnassayoftheconcentrationsofHVHFchemicals present,includingTDS,NORM,andBTEX. (iii)AdditionalSPDESapplicationrequirementsspecifictoHVHF wastewatertreatmentfacilitiesinclude: (a)TreatabilityanalysisforallHVHFadditivesexpectedtobe dischargedtothefacility (1)TreatabilityanalysisforNORMandTDS (2)ExpectedeffluentconcentrationsofallHVHFspecific parameters. ThisinformationmustbesubmittedalongwithApplication FormNY2C.Applicationssubmittedwithouttheinformation listedabovewillbedeemedincomplete. (b)PrivatelyownedoffsiteHVHFwastewatertreatment facilitiesconstructedspecificallyforthetreatmentanddisposal ofwastewater,whichtreatflowbackwaterandproductionbrine forreusemayormaynothaveanassociateddischargeof wastewatertothewatersoftheState. (iv)HVHFwastewatertreatmentfacilitieswhichgeneratewater forreuseinpermittedHVHFoperationsthatdonotincludea dischargetothewatersoftheStateasaresultoftreatment systemeffluentorotherdischargedonotrequireaSPDES permit,unlessotherancillarydischargesaregeneratedaspartof thetreatmentsystem. (v)TheHVHFwastewatertreatmentfacilitymustprovidea demonstrationsuchfacilityhasanapprovedmethodofresiduals

(i)Thefacilitymustprovideademonstrationthatthewastewater treatmentfacilityhasanapprovedmethodofresidualsdisposal incompliancewithParts360and364ofthisTitle. (ii)NoresidualsmayremainattheHVHFsitefollowing completionofwelldevelopmentinaccordancewith554.1(c)(3)of thisTitle. (a)Nodischargeofwastewatertothegroundorsurfacewatersofthe Stateispermittedforonsitetreatmentandrecycling. (b)Theonsitefacilityshallbemaintainedandconstructionand stormwatermanagedincompliancewiththeonsiteequipment requirementscontainedintheHVHFGeneralPermitandthe regulationslistedundersection7503.4above. (4)Theprovisionsbelowapplytodeepwellinjectionpursuanttoa SPDESpermit. (i)Theowner/operatorofthedisposalwellmusthaveUSEPA approvalandaSPDESpermitfordeepwellinjection.The owner/operatorshallapplyforandreceivecoverageunderthe EPAUndergroundInjectionControl(UIC)programforTypeII disposalwellspriortoapplyingforaSPDESpermitin accordancewithsection7501above. (ii)ThecharacterizationandSPDESpermitapplicationprocess fordisposalwellsissimilartothatforPrivateOffsiteWastewater TreatmentFacilitiesasdescribedinSection7503.12.2(2)above. Inadditiontotherequirementslistedtherein,thefollowing informationshallalsobepresentedaspartoftheapplication: (a)Fullcharacterizationofdisposalstratawaterqualityfor HVHFflowbackparameters (b)Geotechnicalinformationregardingtheabilityofthe disposalstratatoacceptandretaintheinjectedfluid,including anestimateofavailablecapacityand (c)AwaterqualityanalysisofthereceivingstratumforTDS, chloride,sulfateandmetals. (iii)TheDepartmentmayproposemonitoringrequirements and/ordischargelimitsintheSPDESpermitinadditiontoany requirementsincludedintherequiredUSEPAUnderground InjectionControlpermit.Themonitoringrequirementsand

dischargelimitswillbedeterminedduringthesitespecific permittingprocessrequiredbytheUniformProceduresActand the1992FindingsStatement,andshallinclude: (a)EffluentlimitsforBTEXandotherHVHFspecific parameterswithClassGSAstandardsandguidancevaluesas listedin6NYCRRPart703 (b)Anyothereffluentlimitsnecessarytobeprotectiveofthe overlyingpotablewateraquifersystemsandwatersofthe State,basedupondistancetodrinkingwatersuppliesor sources,surfacewaterbodiesandwetlands,topography, geology,andhydrogeology (c)Theproposedwellconstructionandoperationprogram and (d)Potentialrequirementforupgradientanddowngradient monitoringwellsinstalledinthedeepestidentifiedGAorGSA potablewateraquifer. (5)Theprovisionsbelowapplytoinjectionofproductionbrineinto thestratafromwhichitwasproducedpursuanttoaSPDESpermit. Notwithstandingtherequirementslistedin6NYCRR556.5,the injectionofproductionbrinedescribedin6NYCRR556.5is regulatedpursuanttothisSubpartandrequiresaSPDESpermit. ThefollowinginformationisrequiredaspartoftheSPDESpermit application: i.Thedisposalstratawaterqualityshallbefullycharacterizedfor backgroundwaterqualityandHVHFchemicals ii.Geotechnicalinformationregardingtheabilityofthedisposal stratatoacceptandretaintheinjectedfluid,includinganestimate ofavailablecapacity iii.Awaterqualityanalysisoftheflowbackwaterorproduction brineforHVHFchemicals iv.Injectionwellconstructionandoperationalcontrolinformation showingthatthewellmeetstheapplicableUSEPAUICClassII injectionwellstandardsaspromulgatedunderParts144148of theFederalUICRegulationsandSections1423and1425ofthe SafeDrinkingWaterActand v.Alongtermmonitoringprogramconsistingofaminimumof one(1)monitoringwellscreenedatthedeepestidentifiedfresh drinkingwaterstratum,withperiodicmonitoringforTDS,NORM, andotheridentifiedHVHFparameters. (6)Theprovisionsbelowapplytodisposalofproductionbrinein accordancewiththetermsofaDepartmentapprovedBeneficial UseDetermination.Productionbrinemaybedisposedin accordancewiththetermsandconditionsofaDepartment

approvedBeneficialUseDetermination(BUD).Inadditiontothe requirementslistedin6NYCRRParts360and364,thefollowing informationshallalsobepresentedaspartoftheapplicationforthe BUD:radiologiclimitscontaminantlimitsandoperational requirementssuchasmaximumbrineapplicationfrequencyand maximumbrineapplicationrate. (7)Otherdisposaloptionsthatmaybeproposedbythepermittee subjecttoDepartmentalreviewandapproval.TheDepartmentwill provideguidanceconcerningthesubmittalofotherdisposal options.

7503.13MonitoringrequirementsinHVHFSPDES permits
(a)Theregulationsinthissectionareinadditiontothoselistedin section7501.13. (b)FortheConstructionPhase,HVHFPhase,andtheProduction Phase,allstormwaterdischargesmustbemonitored,recordedand reportedinaccordancewiththetermsandconditionsofapplicable individualorgeneralpermitstoensureeffectiveoperation. (c)TheHVHFSWPPPmustincludeprovisionsformonitoringand recordingthevolumeofallwaterdeliveredtothewellpadsitefrom eachsource.Recordsmustbemaintainedofeachtruck/pipeline deliveryofwaterandthesourceofsuchwater.Thereportsshallbe keptonsiteandfurnishedtotheDepartmentuponrequest. (d)TheHVHFSWPPPmustincludeprovisionstometerthevolume ofwaterusedateachwelleachtimethereishighvolumehydraulic fracturingeventduringtheHVHFPhase.Thevolumemustbe meteredwithanautomaticcontinuousrecordingdevice(orits equivalent)thatmeasurestowithinfivepercent(5%)ofactualflow. ThereportsshallbekeptonsiteandfurnishedtotheDepartment uponrequest. (e)TheHVHFSWPPPmustincludeprovisionstomaintainarecord oftheamountsofallchemicals/additivesassociatedwitheachtime thereisahighvolumehydraulicfracturingstageduringtheHVHF Phase.Thislistmayexcludeanyinformationthathasbeen determinedtobeconfidentialbusinessinformation.Therecordshall includealistoftheindividualchemicals/additiveswithChemical AbstractServices(CAS)registrynumberandMaterialSafetyData Sheets(MSDS). (f)TheHVHFSWPPPmustincludeprovisionstometerthevolumeof allflowbackwaterandproductionbrinewithanautomaticcontinuous recordingdeviceorequivalentthatmeasurestowithinfivepercent (5%)ofactualflow.Thereportsshallbekeptonsiteandfurnishedto theDepartmentuponrequest. (g)TheHVHFSWPPPmustincludeprovisionstorecordthevolume

(h)Priortositedisturbance(foranewwellpad)orspud(foran existingpad),thewelloperatormustsampleandtestallresidential waterwellswithin1,000feetofthewellpadforwhichthewaterwell ownerhasgrantedpermission,andprovideresultstothewaterwell owner.Ifnowaterwellsareavailableforsamplingwithin1,000feet, eitherbecausetherearenoneofrecordorbecausethewaterwell ownerdeniespermission,thenallresidentialwaterwellswithin2,000 feetofthewellpadforwhichthewaterwellownerhasgranted permissionmustbesampledandtested.Ongoingwaterwell monitoringandtestingmustcontinueatotherintervalsspecifiedby theDepartment.
