Report 1: Resettlement Policy Framework

Here, we need links to the constitution, is there any article regarding land ownership, loss of land for public purposes, compensation? All articles should be translated into English ADB standards to be summarized 3. Preliminary Survey of Numbers of Affected Households and of Population to be Replaced

There are three things to do: First, when visiting the final line corridor and the land required for the substations (mainly in Sherbagan) list all houses and all other buildings (e.g. schools) which have to be demolished and people resettled o mark place in map and provide GPS data by N and E coordinates

Secondly, we need to know how much agricultural properties are along the line corridor. So we need detailed information on average agric. land sizes per hh in the different districts. Thirdly, we have to know o o o o 4. 5. how many towers (corner towers and suspension towers) will be constructed on used land which has its owners, how many towers will be constructed on private grazing areas, how many towers will be constructed on community grazing areas, how many towers will be constructed on barren or waste land which has no owners.

Process of Preparing and Approving the Resettlement Plan Comparision of National regulations With ADP Policy requirements

We need a full list of all relevant national Afghan documents which refer to land acqusition, resettlement and compensation payments. Some regulations are already listed in the Fichtner Social Safeguard Information. However, a full translation of the document titles (name of law/decree/circular, date of approval) and of all specific paragraphes is required.

It is important to find out in detail how compensation is valued (how the value of lossed products and housest is assessed) 6. Valuing Affected Assets and Compensation of Losses

This is one of the key issues of the survey. We need for all districts regarding agriculture a full list of all agricultural products represented in the area of the line corridor by type (from wheat to carrots, onion, etc.) even if we have 30 different types!!! the average yields of these agric. products per hectare in tons/ha, on-farm price for all agric. products (on-farm is more or less the wholesale price, not the price for customers on the local markets) in AFG per kilogramm, input costs per hectare for the various products.

The same is required for fruit trees all trees in the areas, number of per hectare, yields of fruits per hectare, on-farm price for products, input costs for farmers per hactare of fruit trees

For the fields, channels, etc. we need to know the costs for replacement (local market price/labour costs) one meter of wood fence, one meter of fence from iron wires, one meter of clay made wall, sticks for grapewines per piece, meter of small (max. 100 cm) concrete channel.

Value of average timber tree (poplar), mulberry tree, etc. if sold for cutting to people.

Value of houses and adjoining buildings: Establish categories of houses (for example traditional simple, middler, better; modern simple, modern better) and prices for new constructions of such houses, Provide costs for various types of stables, stores according to the local traditions.

Demographical data by district affected by the transmission line (see maps) on population figures, pop. per sqkm, by sex and by age distribution

Data on ethnical distribution is possible per district Which are minorities, which majorities in the different districts? Which languages are spoken? Are some groups being discriminated amongst the ethnical groups, Why they are discriminated?

purchasing household devices, purchasing agricultural inputs and utensils, purchasing animals, enrolement of boys and girls to school, go to health clinics for treatment, marriage of sons and daughters?

(Please consider difference between boys and girls as objects of decision) 4.2 4.3 Constraints for Potential Participation of Women in the Project What are the legal, cultural or religious constraints to the potential participation of women in the Project? What is the relation between Islamic religious legislation and traditional customs? Could women became members of a supervisory committee which follows up the assessment of losses and valuation of damages and compensation payments? Would women profit from electricity supply by opening shops or/and starting businesses (if e.g. they would get crdits)? Employment Opportunities Within the Project Can women in the project districts be employed in the project district as unqualified workers in the project? (e.g. cleaning construction site from shrubbs, transport of utensils, etc.)? Can women be employed as kitchen staff for work camps? Would women be able to come to a work camp or a construction site and sell (in front of the camp) their farm products, sweets and drinks to the workers? Are there any other job opportunities for women in the context of the project (for example transport with donkeys)? Is there a chance that physically handicapped men would be employed by the construction firms for the transmission line and/or the substations?

How do their senior staff members view this aspect? Do they think that it would be important to include gender issues into planning and implementation of a transmission line project (including construction of substations)?

See Resettlement Policy Framework 6. Analysis of the Institutional Capacity

The key staff of DABS and the concerned staff of the relevant ministries will be trained on the content of the Resettlement Policy Framework and their role and responsibility in its implementation, i.e. the preparation of the LARP, inclusive the consultation process and the social assessment. This will be done within the frame of a seminar for all related people and organizations in Kabul. So, what are the current capacities of DABS and the Ministry of Energy? Do they have a Project Management Unit (PMU)? If yes, which staff and which qualification?

Do they have a social expert? If yes, which qualification?

Do they have a Monitoring and Evaluation Unit? If yes, which staff and which qualification?

How do staff members view their capacities regarding the implementation of land acquisition and resettlement according to international standards if an excellent performance is essential for the disbursement of the ADB credit? you should tell them: ADB will not release the loan in case that people are complaining regarding the fairness of the process.

Training Requirements of DABS and Ministry

From the assessment under chapter 6 the training requirements are dissipated. Please assess in discussion with the concerned staff the personal views regarding the existing qualification for land acquisition and resettlement according to international standards, demands for training (detailed information on what would be needed is required)
