First and foremost, I want to wish everyone a wonderful and healthy new year. This year, we will be focusing on one of the largest projects that the city has untaken in years: the development of the Miami Beach Convention Center district. Last year, we issued a Request for Qualifications (RFQ) to renovate and expand the Miami Beach Convention Center, including the development of a convention center headquarter hotel, as well as adjacent properties available for mixed-use. We will be holding several public meetings to engage you in the process beginning in January (see page 8 for highlights of upcoming meeting dates). It is very important that your voice be heard. In other areas, improvements to parking and transportation are one of the factors that would improve our residents quality of life. In this issue of MB, we talk about some of the new initiatives and others that are being explored. We remain committed throughout the year to the goals of our strategic plan and on making improvements to our infrastructures, services and programs. Thank you for your support as we continue to strive to enhance our level of responsiveness to you and deliver quality services every day.

Contestants submitted close to 1,000 photographs to the LIKE2LOVE MIAMI BEACH photo contest held last year. The photos celebrated what the photographers like to love about our beautiful city. Professional judges selected the finalists from each category (outdoor public activities, cultural arts/ festivals/events, and landscapes/places/architecture). The finalists were posted online for the public to vote for their favorite Miami Beach photo. Miami Beach is in the process of developing the 52-acre Miami Beach Convention Center District. Phase I was the selection of the qualified development teams. Two top qualified teams have been short-listed to continue on to phase II, which will entail the development of the proposed plans for the convention center district by each of the two teams. dr. leslie rosenfeld alejandra Gonzalez needed her daughter to get a physical at the start of the new school year. However, due to financial and social conditions, and transportation barriers, she and many families like hers cannot access health care in traditional office settings. through a partnership of the Citys education Compact and the university of Miami Miller School of Medicine, a mobile clinic now provides free pediatric services at various Miami Beach parks. Gonzalez recently brought her eight-year-old daughter to one of these mobile pediatric clinic currently servicing uninsured children in Miami Beach. I like having the service available so close to home, it makes caring for my daughter very convenient and provides a lot of good information, said Gonzalez. the partnership with Miami Beach has allowed us to provide much needed medical services to the community in their own neighborhood, said lisa Gwynn, d.o., medical director. a 47-foot traveling health facility equipped with three exam rooms, a laboratory, a treatment area and a pharmacy, the mobile clinic provides children from birth to 21 years of age, a plethora of services. these services include everything from well visits, immunizations, health screenings and management of chronic illnesses, to urgent care, mental health and social services. I really appreciate the services the clinic provides. It allows me to keep my child, Gabriel, healthy and know that the doctors are well qualified, said raul Patino.

Gonzlez necesitaba que a su hija se le hiciera un examen mdico al iniciar el nuevo ao escolar. ENCROACHING ON PUBLIC SPACE?

ARE YOUR HEDGES


You encroach when you install private improvements within the public right-of-way (ROW). If you have planted material in the swale in front of your home, built a fence or placed a birdbath, or other feature just outside your property, you have created an encroachment. Miami Beach enforces encroachment laws on a complaint-driven basis. The Public Works Department verifies the complaint and the Code Compliance Division issues a courtesy notice. The property owner must comply by removing the encroachment, such as carefully trimming back trees and hedges, or applying for an after-the-fact permit (landscaping and driveway approaches). Noncompliance may result in a violation and/or penalty fees. The City may also remove the encroachment at the owners expense.

This overgrown shrub obstructs pedestrian and vehicular views creating, not only an encroachment, but also a public safety concern on the public street. It is important to keep your hedges trimmed and maintained regularly from encroaching to avoid a complaint to be filed and, equally as importnat, damage to the plants, which can result from significant trimming.

Free standing structures on the swale, i.e., intercom announcers, water fountains, decorative boulders and stones. WHO IS RESPONSIBLE FOR MAINTAINING THE RIGHT-OF-WAY?


Property owners are expected to maintain what they plant or install on ROWs to prevent blocking the right-a-way, obstructing view, impeding pedestrian access, or causing other safety concerns.

Structural encroachments not otherwise listed, including but not limited to, fences, walls, patios, water fountains, raised planters and decorative boulders. Private signs, except as provided in the City Code. Lighting Loose rock, gravel or any surfacing other than concrete or flat stone/brick installed at grade and grouted.

HOW DO I OBTAIN A PERMIT FOR A RIGHT-OF-WAY?


Some encroachments in ROWs can be permitted. However, the City may remove or request that the encroachment be removed if it needs to build or perform any construction in the ROW, or if a valid complaint is verified. Permits are required to protect the rights of the public and to prevent damage to underground utilities. The law even requires that a call be made to 811, at least three days before any digging is done within the right-ofway, so that underground utilities can be properly marked. Property owners can apply for a permit with the Public Works Department. ROW permit fees may vary depending on the project size and location. ROW permits and the review/ approval process without revisions or encroachments are typically finalized within one to two business days. However, if a structure is proposed to be placed in the ROW, a revocable permit is required. This needs the approval of the City Commission and may take several months. Property boundaries are identified and shown on a certified property boundary survey prepared by a licensed land surveyor. A property owner is responsible for all surveying costs. Check your yellow pages or the web to find a land surveyor.

Transportation Wheels
During the 2012 Miami Beach Community Survey, a large percentage of residents opined that the city did not have sufficient parking. Half of them said they would take a local bus or ride a bicycle, and a third voiced support for public transportation to the mainland. Miami Beach continues to make great strides when it comes to improving its parking and transportation options whether you use a vehicle, bicycle or bus. The latest efforts are making it easier to hit the beach, dine, shop and have fun in the city by offering more parking solutions and exploring other ways to facilitate getting around. City officials are looking at new ways to improve mass transportation in, out and around the island. This includes preliminary discussions exploring a wire-free overhead streetcar as a possible solution that would provide a connection between Miami Beach and Miami to help improve circulation within the island. In early 2013, officials will also study the possibility of linking the high density residential and commercial areas of North and Middle Beach to South Beach, with a new bus circulator similar to the South Beach Local. A draft of the feasibility study, funded by a grant from the Miami-Dade Metropolitan Planning Organization, has been completed. City officials will be meeting with Miami-Dade Transit to determine, among other procurement options, whether or not a partnership with the county similar to the South Beach Local circulator can be implemented. The bicycle continues to be a popular mode of transportation for many on the beach. One in four South Beach residents walks or cycles as their primary mode of transportation. Recent Census data lists Miami Beach as one of the countrys top ten cities for biking to work. The city boasts approximately 150 bike racks and an estimated 500 that will be added by 2015. This past November, the Deco Bike rental program, launched in 2011, celebrated its four millionth ride and $1.6 million in total trips. The Citys Atlantic Greenway Network Master Plan brought a shared lane to Washington Avenue. A new bike path is currently being completed on Dade Boulevard, and future bike lanes will installed along Washington Court and 22 Street, with connection to the beachwalk. I cant wait until this project [Dade Boulevard project] is completed, it will make me feel much better about riding my bike, said Dania Diez, who rides for fun, exercise, and to her job from the Venetian Islands to Collins Avenue, and does not own a vehicle. The Dade Boulevard path will create an east-west connection from the Venetian Causeway to Convention Center Drive. Other wheels are also turning in Miami Beach. Segways are fairly new to Miami Beachs transportation scene. Recently, Miami Beach adopted

regulations concerning the operation of these two-wheeled devices in the interest of safety. The Citys Code prohibits Segways from exceeding eight miles per hour or operating in certain locations, said Miami Beach Transportation Manager Jose Gonzalez. The Code prohibits the devices from operating on the interior pathways within Collins Park and South Pointe Park, Lincoln Road Mall, and the sidewalk on the west side of Ocean Drive. The City Code also prohibits Segway use on public facilities including City Hall, historicallydesignated City properties, police and fire stations, and parking lots and garages, except when used by persons with disabilities. New City Code provisions also establish responsibilities for Segway users and for businesses that rent, lease, or provide tours. The City is in the process of evaluating additional regulations including those relating to minimum age and weight,

SeGWay ReGUlaTIoNS Miami Beach City Code Sections 70-66 through 70-71 miamibeachfl.gov The City is in the process of evaluating additional regulations including those relating to minimum age and weight, operating hours, and equipment. As vehicles are still the preferred method of getting around for most people, many efforts are being made to improve parking programs. In the last several years, Miami Beach has added more than 1,500 additional parking spaces. The latest addition is the new Sunset Harbour parking garage with 460 parking spaces and retail on the ground floor. Another public, state-of-the-art, 400-space parking garage by world-renowned architect Zaha Hadid will be breaking ground in the next year in the Collins Park neighborhood. It [Sunset Harbour Garage] is very convenient and you can still find a lot of parking, plus the security is great, said Leny Calle, who works at Sunset Clothing, which relocated from Lincoln Road to the Sunset Harbour neighborhood to join the new businesses opening up in the area. South of Fifth resident Albert Levy also uses the Sunset Harbour Garage. You can actually find parking outside now, too, said Levy. There are other new parking options on the horizon. The City is installing 750 new parking stations by 2014 that allow users to pay for parking with a pay-by-plate option. The City has already installed 300 of these stations, which also alerts technicians via text message when a station needs repair. There is also a new parking application for smart phones coming soon. The new app will provide parking information and availability at garages, said Miami Beach Parking Director Saul Frances. For residents and visitors who choose to drive electric vehicles, there is a municipal car charging station at the 13 Street and Collins Avenue garage. The station is available 24 hours a day, seven days a week. The new parking options also reduce the chances of people parking illegally and getting towed. However, if you do get towed, public towing fees for Miami Beach residents did not increase when towing fees for non-residents did. In general, Miami Beach is becoming a much better place as far as more parking, and the plans for more public transportation would be good, said Diez.

HOMELESS NOT HELPLESS


Ivette Daz The homeless are not new to South Florida. Our regions weather, the tourists and the ocean are a big attraction. According to Homeless Census conducted in August 2012, there were approximately 186 homeless persons living in the streets of Miami Beach, with about 144 in South Beach. The first thing we offer them is shelter and rehabilitation services to get them back on their feet, said Homeless Program Coordinator Katherine Martinez of the Homeless Outreach Team (HOT) at the City of Miami Beach. HOT works to reduce the number of homeless, by providing them outreach, shelter, rehab and relocation assistance services. While a good number of homeless persons accept help, many do not. The vagrants within the homeless community commit crimes and are usually repeat offenders. A new partnership between HOT and the Miami Beach Police Department (MBPD) is addressing this segment of the homeless community. MBPD assigned a full-time police officer to address aggressive panhandling, illegal camping and public drunkenness by habitual vagrants. Officer Ysidro Llamoca works with HOT and started the Habitual Misdemeanor Offenders program, with public safety as its primary focus. Llamoca networks 24/7 with HOT and helps them do outreach in South Beach, addresses vagrant issues citywide, and works closely with homeowner and merchant associations. My approach is one of dignity and compassion. For those who want and accept our assistance, we work extremely hard to get them the services they require, said Officer Llamoca. For those who repeatedly refuse services and are arrested for violating state laws, a different approach is taken. Officer Llamoca now appears in court to make sure that the vagrant enlists in a rehab program to get him/ her off the street, or tries to get a bond to keep them in jail. Before the program, our officers would sometimes arrest the same vagrant twice during a 10-hour shift, said Miami Beach Police Captain Mark Causey. Nick Kazumoff owns a restaurant on Lincoln Road. He says that while some of the homeless mind their own business, others walk by his business intoxicated, and sometimes keep customers away. They ask for money from the people at the tables; its an ugly picture overall, said Kazumoff. Herbert Hofer has been a resident on Ocean Drive for 24 years. He says his neighborhood has seen its share of problems with the homeless. Now theyre doing the job they are supposed to be doing for the neighborhood, said Hofer. We dont have the same amount of homeless in the street now; they are either in jail or have left the city, said Causey.

The chronic offenders have moved on to other cities. Better documentation and tracking of our vagrants and panhandlers. Less complaints from the public related to urinating in public, camping in public parks and streets. Less panhandling on Lincoln Road, 5th Street corridor, Alton Road and Ocean Drive. Fewer physical threats to the HOT team. Less public drunkenness, sleeping on sidewalks/ bus benches, bathing in the public restrooms.

Miami Beachs beachwalk is the gateway to the ocean and the beach.The beachwalk is a convenient way to explore some of our citys terrific destinations. It is the Citys vision to have the on-grade paver beachwalk run north/south along the coast as a continuous recreational path for cyclists and pedestrians. All the sections of the boardwalk eventually will be replaced with the on-grade path that supports multiple modes of alternative transportation. Through its low impact design with marine turtle friendly lighting the on-grade

path will support both the protective dune system and sea turtle nesting habitat. As upland properties redevelop along the elevated boardwalk, the City will work with them to continue the beachwalk until a seamless and continuous path is completed. A new portion of the beachwalk is currently being built from 45 to 47 streets (behind the Eden Roc), similar to the beachwalk system south of 23 Street and north of

64 Street. Access to the beach, street, and adjacent properties is being maintained for boardwalk users during construction.The project is expected to be completed this summer. The City is also currently in the planning and design phases for the beachwalk from 47 Street to 64 Street.As upland properties redevelop along the wooden boardwalk in the future, the city will work with them to continue constructing the at-grade beachwalk.

The proposed beachwalk from South Pointe Drive to 5 Street will be constructed in two phases. The first phase, South Pointe Drive to 3 Street, broke ground and construction will begin soon. Enjoy the best of Miami Beach and take a stroll on the Beachwalk.
