Plaintiff, Godinger Silver Art Co. Ltd. ("Godinger"), for its Complaint against
Defendant, Epic Products, Inc. ("Epic"), alleges as follows:
THE PARTIES
1. Godinger is a New York corporation with a principal place of business at 63-15
Traffic Avenue, Ridgewood, New York 11385.
2. Upon information and belief, Epic is a California corporation with a principal
place of business at 2801 S. Yale Street, Santa Ana, California 92704. Upon information and
belief, Epic regularly conducts business throughout the United States and within this judicial
district.
JURISDICTION AND VENUE
3. Subject matter jurisdiction is based on 28 U.S.C. 1331 and 1338, in that this
action arises under the patent laws of the United States (35 U.S.C. 1, et seq.).
4. Venue lies in this Court pursuant to 28 U.S.C. 1391(b)-(c) and 1400(b).
GENERAL ALLEGATIONS
5. United States Design Patent No. D521,304 ("the '304 Patent"), entitled "LIQUOR
DISPENSER," was duly and legally issued by the United States Patent and Trademark Office
on May 23,2006.
6. Godinger is the owner ofthe '304 Patent, a true and correct copy of which is
attached hereto as Exhibit A.
7. Godinger markets a variety of tabletop and giftware products, including the Fuel
Pump Beverage Dispenser covered by Godinger's '304 Patent.
8. Upon information and belief, Epic has manufactured, used, offered for sale,
and/or sold liquor dispensers, including a product offered for sale and sold under the name
"Chrome Retro Gas Pump Drink Dispenser" (SKU No. 60-78), that infringe the '304 Patent.
9. Upon information and belief, Epic's offering for sale of its "Chrome Retro Gas
Pump Drink Dispenser" has included offering that dispenser for sale on Epic's website,
www.epicproductsinc.com. Attached hereto as Exhibit Bare January 9, 2013 and January
22, 2013 printouts from Epic's website demonstrating Epic's offering for sale of its "Chrome
Retro Gas Pump Drink Dispenser."
10. On January 9, 2013, Godinger sent Epic a letter notifying Epic of its infringement
of Godinger' s '3 04 Patent.
11. As of at least January 29, 2013, Epic has continued to manufacture, use, offer for
sale, and/or sell liquor dispensers that infringe the '304 Patent.
12. On January 29, 2013, Epic offered its "Chrome Retro Gas Pump Drink
Dispenser" for sale at the New York International Gift Fair trade show at the Jacob K. Javits

Convention Center ofNew York, 655 West 34th Street, New York, New York 10001, by
displaying said dispenser at Epic's showroom booth. A picture of Epic's "Chrome Retro Gas
Pump Dispenser" offered for sale on January 29,2012 that was taken at the New York
International Gift Fair trade show is attached hereto as Exhibit C.
13. Upon information and belief, the acts of infringement by Epic are willful,
intentional, and in conscious disregard of Godinger' s rights under the '304 Patent.
14. As a result of Epic's infringement ofthe '304 Patent, Epic has made and will
continue to make unlawful gains and profits, and Godinger has been and will continue to be
deprived of revenue that it would otherwise have generated but for such infringement.
15. Godinger has been and will continue to be substantially and irreparably harmed
by Epic's infringement of the '304 Patent.
16. The extent ofGodinger's damages cannot be determined except by an accounting.
JURY DEMAND
Pursuant to Fed. R. Civ. P. 38(b), Godinger requests a trial by jury.
PRAYER FOR RELIEF
Wherefore, Godinger prays for relief as follows:
A. A judgment that Epic has infringed the '304 Patent;
B. A judgment preliminarily and permanently enjoining and restraining Epic,
its officers, directors, agents, servants, employees, affiliates, attorneys and all others in active
concert or participation with Epic, from infringing the '304 Patent;
C. A judgment awarding Godinger its damages, but not less than a reasonable
royalty, resulting from Epic's infringement;

D. A judgment awarding Godinger an amount equal to Epic's total profits
resulting from Epic's infringement under 35 U.S.C. 289;
E. A judgment that Epic's acts of infringement have been in willful,
knowing, and deliberate disregard of Godinger' s patent rights, and awarding Godinger enhanced
damages under 35 U.S.C. 284;
F. A judgment awarding Godinger its costs, disbursements, and attorneys'
fees incurred in prosecuting this action as authorized by 35 U.S.C. 285 for an exceptional case;
G. A judgment awarding Godinger pre- and post-judgment interest on any
monetary award; and
H. Such other relief as the Court may deem just, equitable, and proper.
