On Consuming Riba: The Penalty Thereof Yahya Abu Hassân

1 There is no penalty if the person consuming riba ceases to do so when he is issued a


warning from the revelation.

1.1 Allah said: {So to whomever an admonition came from his Lord and he then
ceased, then to him belongs whatever preceded, and his affair is up to Allah.}
(Qurʾān, Al-Baqarah, 2:275)

1.2 Allah said: {If you repent, then to you belong your capital funds.} (Qurʾān,
Al-Baqarah, 2:279)

2 After having been warned, the penalty for consuming riba is that of a muḥārib [enemy
at war].

2.1 Allah said: {Leave whatever remains of riba if you are believers. But if you do
not, then be warned of a war from Allah and His messenger.} (Qurʾān,
Al-Baqarah, 2:277)

2.1.1 Ibn ʿAbbās commented on His saying: {O you who believe! Be conscious of
Allah and leave whatever remains of riba} until: {Then be warned of a war
from Allah and His messenger}. He said, “So whoever endures upon riba—
not retreating from it—then there is a right upon the imam of the Muslims to
ask him to repent. He should retreat or else his neck should be struck.”

2.1.1.1 Aṭ-Ṭabarī said: al-Muthannā told me: ʿAbd Allāh ibn Ṣāliḥ told us:
Muʿāwiyah told me: via ʿAlī: via Ibn ʿAbbās do. (Tafsīr aṭ-Ṭabarī:
6/25/6261)

2.1.2 Ibn ʿAbbās said, “It will be said on the day of ressurrection to the consumer
of riba, “Wield your weapon for war”.”

2.1.2.1 Aṭ-Ṭabarī said: al-Muthannā told me: Muslim ibn Ibrāhīm told us: Rabīʿah
ibn Kulthūm told us: My father told me: via Saʿīd ibn Jubayr: via Ibn
ʿAbbās do. (Tafsīr aṭ-Ṭabarī: 6/25/6262)

2.1.2.2 Aṭ-Ṭabarī said: al-Muthannā told me: al-Ḥajjāj told us: Rabīʿah ibn
Kulthūm told us: My father told me: via Saʿīd ibn Jubayr: via Ibn ʿAbbās
do. (Tafsīr aṭ-Ṭabarī: 6/25/6263)

2.1.3 Qatādah commented on His saying: {Leave whatever remains of riba if you
are believers. But if you do not, then be warned of a war from Allah and
His messenger}. He said, “Allah threatened them with being killed, as you
can see. He thus made them permissible to kill wherever they are found.”

2.1.3.1 Aṭ-Ṭabarī said: Bishr told us: Yazīd told us: Saʿīd told us: via Qatādah do.
